MINUTES November 10, 2021 INDIAN LAKE BOROUGH COUNCIL MEETING The regularly scheduled meeting of the Indian Lake Borough Council was held on November 10, 2021, at 6:00 P.M. at the Indian Lake Borough Office and via Zoom. THOSE PRESENT: Bob Hanson Scott Hollern Kim Yantus Paul Balint Joe Lazzaro Shaun Nemeth Jay McClatchey, Mayor Kirsten Siehl, Office Manager Michael Barbera, Solicitor Jerry Bellak, Chief of Police Dean Snyder, Roads and Maintenance THOSE ABSENT: Curt Morgese Visitors - Dick Stern, Bri Alianiello, Jeremey Sturtz, Jim Bent, Pam Tadken, Randy Musser, Chris Broach, Matt Sprung ORDER OF BUSINESS 1. Pledge of Allegiance 2. The meeting was called to order at 6:00 by Hollern. 3. Yantus moved to approve the minutes the October 13 meeting, Balint seconded. 4. Welcome Visitors - Dick Stern, Bri Alianiello, Jeremey Sturtz, Jim Bent, Pam All ayes, motion carried. Tadken, Randy Musser, Chris Broach, Matt Sprung 5. Public Comment: A. SVFD Proposal - Bri Alianiello, Jeremy Sturtz and Jim Bent from the Shanksville Volunteer Fire Department presented their proposal to implement a dive platform in the lake for training purposes. Alianiello stated the closest training facility is 5.5 hours away, this would allow for more frequent training. Alianello stated the platform would be 20' under water and approximately 100' from the breast of the dam. The platform would not be visible to boat traffic and would be anchored to the lakebed with cement drums. Buoys would be placed identifying the location of the platform and flags would be deployed during active training sessions. They would limit their training to low traffic days and would avoid weekend as much as possible. The dive team has their own communications system and safety teams that would be in a boat as well. Snyder questioned if it would interfere with the valve at all? Bent stated they will be sure to stay clear of the valve and could place the platform to one sign or the other. Barbera suggested having the Borough named as an additional insured and the Borough would require a certificate of insurance. He also suggested having CME review the plan. Hollern will contact CME and reconnect with more information. B. Cheyenne & Condo Waterlines - Matt Sprung, on behalf of Terry St. Clair, stated the HOA of Kickapoo was turned over to the residents but it was questioned who owned the water and sewer lines. It was discovered the Borough never officially took ownership. Musser provided the 'as builts' and Sprung stated the lines were installed to Borough specs. It was decided Snyder will review the plans and get comfortable with the terrain and Barbera will review with intent to draft a deed of dedication. C. Chris Broach - Broach applied for a waterfront encroachment permit at Algonquin Park. He stated it appears that there is unaccounted for property within the park. Broach owns two lots in the park separated by the 25' of frontage owned by the Borough. Hollern suggested allowing council to do some research and will get back to him with an answer. 6. Financial Reports - Hollern moved to approve the Profit & Loss Budget Performance, Unpaid Bills (including the additional invoices received), Summary of Account Balances and Previous Year Comparison reports as presented for the General, Water and Sewer funds, Balint seconded. All ayes, motion carried. A. PennVest Requisition - Hollern moved to approve PennVest Pay Requisition #7, PennVest will be paying $284,977.81, and $5,322.87 will be paid out of Indian Lake Borough equity, totaling $290,300.68. Hollern moved to pay Requisition #7; Hanson seconded. All ayes, motion carried. B. Budget Adoption - Hollern stated a public hearing was held at 5:30, there was no public comment. Hanson moved to adopt the proposed 2022 budgets (General - $1,362,000, Water - $312,500, Sewer - $40,700), Lazzaro seconded. All ayes, motion carried. 7. Zoning/Building Report - See attached report. Snyder report the sewer issue at Pine Cover is going to be resolved, they will be asking for a release of easement. Hufford issued a Stop Work Order for 1877 Peninsula; the owners requested a Zoning Hearing Board. The Zoning Hearing Board met on the variance for Incardona's boathouse, they approved a 2' variance for a 15' flat roof variance but did not approve the storage shed on top. The variance was requested due to the size of Incardona's boat and their want to install a boat lift to accommodate storage of their boat. The current height restriction 8. Shoshone Sediment - Hollern commented the initial dredging project has been delayed while obtaining the proper documentation. CME has the E&S plan completed and is waiting for review by Keith Largent the local DEP Representative. Future dredging will continue to be discussed, Lazzaro has offered to head the project. Nemeth suggested using a drone to identify the problem areas while the lake is lowered. B. Bridge Proposal Snyder reported they are waiting until spring to C. Old Backhoe - Snyder is pricing out new tires for the old backhoe. A. Liquor License Renewal - Barbera reported the license needs renewed by December 1. Siehl has obtained access to PLCB Plus to complete the renewal with assistance from Barbera. A Change of Control will need completed after new council members have been sworn in. Hollern moved to authorize Siehl and Barbera to renew the liquor license and all ancillary permits for 2022, Lazzaro seconded. All ayes, motion carried. A. Ladies Association Correction - Alison Finui asked that a correction be made in the October minutes, the 'Indian Lake Ladies Association' is willing to contribute to the awning at the Peninsula Club. McClatchey reported 'No Parking' signs were installed along North Shore Trail where hunters were parking on the side of the road and a draft agreement regarding unattended/Ploating boats, with the Marina has been presented prepare bid packages. 9. McClatchey asked if the current ordinances can be separated from the old/repealed ordinances on the website to allow for easier understanding. Hanson explained the difficulty of researching ordinance history and suggested putting a committee together to review the ordinances. Chief Bellak reported Trick or Treat at The Lodge was a success. Chief Bellak reported there was a minor accident at the hotel entrance of The Lodge were a vehicle hit a pedestrian. He suggested having mirrors, signs or a crosswalk installed. Snyder will look into C. Water and Sewer Report - Snyder reported the water leak was located and will be repaired on November 12. The valve was closed, and the lake is i. Shanksville/PADS Meeting Balint circulated the proposal from CME to perform services for Component 3M with a cost of approximately $5,000. Hanson motioned to authorize Balint and CME to proceed, Hollern questioned if there was an agreement with the Shanksville treatment plant before moving forward with CME, Hanson replied that there is no agreement but the services with CME would still be recommended to move forward, Nemeth seconded. Sewer Plant Inspection - Snyder reported the sewer plant was inspected November 9, the ammonia nitrate and suspended solids were a little high, but no fines were expected at this time. Barbera stated if a notice of violation is received, it can be negotiated. D. Planning/Zoning Report: Tadken and Lewis attended the Somerset County Municipal Summit and noted that emergency services are struggling and asked municipal authorities to create committees to better support fire i. Tree Ordinance Revision - Tadken circulated the revised tree ordinance for review. She believes a professional forester should be retained as a consultant. She has asked for comments on the most recent revision to be received by the December Planning Commission meeting to provide Council with the final draft for the ii. Old Business: New Business: A. AirBnB - Pennsylvania is pushing for short term rental to not being permitted in R-1 zoned lots unless permitted by the zoning ordinance. Tadken thinks holding a record of property owners and a contact person would be reassuring the surrounding residents in the event of an issue. Hollern suggested tabling the discussion until December. Hollern and Siehl asked Council members to share their thoughts on what the discussion regarding short term rentals should incorporate prior to any additional discussion. Council needs to know what reasons we are looking into for future discussions on short term rentals. 3 B. Emergency Management Coordinator = Hollern commented that with Miscoe's resignation the position of EMC was left vacant, himself and McClatchey were going to share the responsibilities, but other residents showed interest. Hollern nominated Craig Tadken as Emergency Management Coordinator for Indian Lake Borough, Lazzaro seconded. All ayes, motion Executive Session - Hollern moved to go into executive session at 8:24 for two matters of litigation in which identifiable claims have been made, seconded. All ayes, motion carried. Council returned from executive session at 8:42 with no additional business to discuss. Lazzaro authorized Barbera to withdraw the reverse assessment appeals, Hanson seconded.
