August 9, 2022 The City Council oft the City of Clyde, Texas, met in a Regular Meeting at Clyde City Hall, 222 Oak Street, Clyde, Texas on August 9, 2022, at 6:00 p.m. with Mayor Pro Tem Paul McGuire presiding. Councilmembers present: Paul McGuire, Thomas Martin, James Rector, Tammie Coffman (6:01 p.m.) and Danny A. White. Staff present: City Administrator Chris McGuire, City Secretary Connie Thornton, Public Information Specialist Nancy Woods, Librarian Linda Cavanaugh, Director of Community Services Terry Davis, Public Works Director Jerry Perkins, and Chief of Police Robert Dalton. An open meeting was held concerning the following subjects: 1.0 CALL TO ORDER AND ANNOUNCE A QUORUM IS PRESENT At 6:00 p.m., Mayor Pro Tem McGuire called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Pro Tem McGuire 3.0 PLEDGES TOU.S. AND TEXAS FLAGS All - led by Mayor Pro Tem McGuire. 4.0 COUNCIL COMMENTS 5.0 PUBLIC COMMENTS Council recognized Denis Whitmire for 5 years of service toi the City of Clyde Public Works Department. Mayor Pro Tem McGuire opened public comments at 6:01 p.m. As there were no comments, Mayor Pro Tem McGuire closed the public comments at 6:02 p.m. 6.0 CONSENT AGENDA 6.1 Rector moved and White seconded to approve the minutes from the regular meeting of July 12, 2022, as printed. Motion carried unanimously. 7.0 REGULAR AGENDA 7.1 White moved and Coffman seconded to Order an Election, for the General Election of 7.2 Chris said the proposed values are from the numbers we received from the Callahan County Tax Assessor. The average home value is $94, 176.00 and the average taxable home value is $86,572.00." This ratei is .31 cents! belowi the voter approval tax rate. With the average home value taxable rate at $86,572.00 that will be an increase of approximately $16.44 a year or $1.37 a month. On al home valued at $100,000.00 the yearly cost would be approximately $19.00 a year or $1.50 a month. Chris went on to explain the city has seen a significant increase ini fuel this year and we are seeing an November 8, 2022. Motion carried unanimously. 18% increase in our health insurance for next year. Retirement matches for the city will also have an increase next year. McGuire stated he knows our city staff White moved and stated to adopt the proposed tax rate of $0.007250 which willl be a 2.57% increase in the property tax rate with a Public Hearing to be held on September 13, 2022 and direct the city secretary to post notifications and postings. Rector seconded the motion. White- aye, Rector- - aye, Coffman - aye, Martin- -aye, 7.3 Chris stated the value for the building located at 106 Cedar Street is valued at $299,000.00 and the Chamber of Commerce who owns the building is willing to selli it to the City for $45,000.00 and loan forgiveness of $21,000.00 which is owed to the EDC. Ifa approved the building would be repurposed as a community center and senior citizens facility. Coffman stated she was excited by this idea, and it was the perfect Coffman moved and McGuire seconded to approve the: settlement agreement for the building located at. 106 Cedar Street. Motion carried unanimously. 7.4 Chris informed council that we are in coalition of cities which are represented by Lloyd Gosselink to negotiate on behalf of the cities for the best possible rates. After negotiation they have reached a mutual agreement and this eoutonrepresentsthat agreement. Our attorney has already looked over the resolution and has approved by signing it for council. Coffman asked how much an increase each household could expect. Robert O'dell with Atmos Energy said a residential home could expect around $4.60 a month and commercial entity around $14.50 a month. McGuire inquired if Atmos was ready to expand into the new housing additions. O'dell stated they were Rector moved and Coffman seconded to adopt A RESOLUTION of the city council of the city of CLYDE, Texas, approving a NEGOTIATED settlement between the atoms cities steering committee ("ACSC") and ATMOS ENERGY CORP., mid-tex DIVISION regarding the company's 2022 rate review mechanism filing; declaring EXISTING rates to be unreasonable; adopting tariffs that reflect rate adjustments consistent with the NEGOTIATED SETTLEMENT; finding the rates to be set by the attached settlement tariffs to be just and reasonable and in the public interest; approving an Attachment establishing a benchmark for pensions and retiree medical benefits; REQUIRING THE COMPANY TO REIMBURSE ACSC'SREASONABLERATEMAKING EXPENSES; determining that this RESOLUTION was passed in accordance with the REQUIREMENTS of the Texas open meetings act; ADOPTING A SAVINGS CLAUSE; declaring an effective date; ANDI REQUIRING Delivery OF THIS RESOLUTION TO1 the company and the ACSC's understands cost containment and appreciated them. Motion carried unanimously. 7.5 Chris informed the council the quilting business the Feathered Star, owned by Shaula Patton along with the help ofcouncilwoman Tammie Coffman are wanting to make a quilt to hang in the City of Clyde council chambers. Shaula Patton addressed council, showed materials, and shared ideas on how this would happen. She stated she would like to have a site at the upcoming Oktoberfest and have input from citizens int the making of the quilt. They can sew a strip and be ap part of the creation of this quilt. Coffman stated she was looking forward to the citizen participation. White moved and Martin seconded for the city to issue $250.00 for the making ofthe CityofClyde quilt. Motion carried unanimously with Coffman abstaining. 7.6 Chris stated this was another property that the property line crossed the city's easement. By granting this variance it will have no impact to our easement or city services. Martin moved and Rector: seconded to grant a variance for Lot 1 and the North 1/2of Lot2, Block. 15, Original Town of Clyde, Callahan County, Texas, according to the map or plat thereof recorded in Volume 1, Page 9, Plat Records, Callahan County, Texas. Motion carried unanimously. 8.0 CITV/ADMINISTRATOR REPORTS Chris updated the council on several items: 1. Walk through on Public' Works building, the contractor is addressing issues on the list, 2. Wastewater treatment plant design has been submitted to TCEQ which includes membrane upgrades. There will have to be 60 days oft testing after the final plans. 4. Smart water meter installs starting in September. Postcard and door hangers will go out 6. The new Police Department building is 75% complete but the floors, ceilings will not be installed or finished until the HVAC: system is installed and it is not due to be here until sometime in October. Water and Sewer being done by Public Works. 7. The sports complex is wrapping up clearing the land then they will start on utilities and construction. There will be a water line tied into for the AG Barni fori the school. 8. Rubber mulch will be laid in the playground area at the City park. It will give 81 feet ofi fall protection. Rector questioned if the rubber would be heating up and Chris stated this is 9. The sidewalk project is finished. McGuire asked if the business owners would be putting something up in front of the sidewalks for bumper protection for the sidewalks and cars. 10. McGuire inquired about the sanitation and where we were on that. Chris said we would be taking possession oft the last truck next month. Rector asked if the same schedule would continue for trash pickup. Chris stated it would and we would be doing a phase out with Republic Services where we learn the routes and exchange out poly carts. Our poly carts will be green whereas Republics are blue that will make it easier on citizens to and we: should be taking possession of the buildingi in August. 3. The manhole refurbishment is 95% complete. to citizens for information and set up. 5. Sewer line replacement finishing with final approval from TCEQ. made special for playgrounds and such and will not heat up. Chris stated the City could investigate doing that. see when the swap outs begin. 9.0 FINANCIAL STATEMENT were no questions or comments. The. July 31, 2022, Financial Statement: Summary was available to Council for review. There 10.0 EXECUTIVE SESSION/The Council may enter into Closed or Executive Session to discuss the following:) The council entered into executive session at 6:37 p.m. The council returned to open session at 7:34 p.m. Rector moved and Coffman seconded to hire one additional: school resource officer and to update the contract with Clyde Consolidated Independent School District. Motion carried White moved and Martin seconded to extend the contract, for the City Administrator, for unanimously. one additional year.
