Hall, 222 Oak Street, Clyde, Texas on September 13, 2022, at 6:00 p.m. with Mayor Rodger Brown presiding. Councilmembers present: Rodger Brown, Paul McGuire, Thomas Martin, James Rector, Tammie Coffman, and Danny A. White. Staff present: City Secretary Connie Thornton, Public Information Specialist Nancy Woods, Librarian Linda Cavanaugh, Director of Community Services Terry Davis, Public Works Director Jerry Perkins, Chief of Police Robert Dalton, and' Water Plant Operator Chad Sheffield. An open meeting was held concerning the following subjects: 1.0 CALL TO ORDER AND ANNOUNCE A QUORUM IS PRESENT At 6:00 p.m., Mayor Brown called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Brown. 3.0 PLEDGES TO U.S. AND TEXAS FLAGS All -I led by Mayor Brown. 4.0 COUNCIL COMMENTS Mayor Brown: said City Administrator Chris McGuire was not at the meeting due to having a procedure done and would like to wish him a speedy recovery. Please keep Chris and his family in your prayers. 5.0 PUBLIC COMMENTS Mayor Brown opened public comments at 6:01 p.m. As there were no comments, Mayor Brown closed the public comments at 6:02 p.m. 6.0 CONSENT AGENDA 6.1 Rector moved and Coffman seconded to approve the minutes from the regular meeting of August 9, 2022, and the special meeting of August 25, 2022, as printed. Motion carried unanimously. 7.0 PROCLAMATION 7.1 Mayor Brown read the proclamation acknowledging World Teacher's Day and presented the proclamation to Melinda McGuire, a teacher at CCISD. 8.0 PRESENTATION 8.1 Mayor Brown acknowledged Chad Sheffield for 15 years of service to the City of Clyde. 9.0 PUBLICHEARINGS 9.1 Mayor Brown opened the public hearing for the proposed tax rate at 6:08 p.m. As there were no comments Mayor Brown closed the public hearing at 6:09 p.m. 9.2 Mayor Brown opened the public hearing for 2022-2023 proposed budget at 6:09 p.m. As there were no comments Mayor Brown closed the public hearing at 6:10 p.m. 9.3 Mayor Brown opened the public hearing for the preliminary replat for the property located at 317 Cherry Street at 6:10 p.m. As there were no comments Mayor Brown closed the public hearing at 6:11 p.m. 10.0 REGUALR AGENDA 10.1 Councilman Rector thanked Chris and all city staff who worked on the budget for the coming year. McGuire moved and Martin seconded to adopt AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR BEGINNING OCTOBER 1, 2022, AND ENDING SEPTEMBER 30, 2023. IN ACCORDANCE WITH STATE LAW, APPROPRIATING THE VARIOUS AMOUNTS THEREOF, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. Rector-aye McGuire-aye Martin-aye Coffman-aye White-aye Motion carried unanimously. 10.2 Rector moved and' White seconded to adopt AN ORDINANCE OF1 THE CITY OF CLYDE, TEXAS, RATIFYING THE PROPERTY TAX INCREASE REFLECTED IN THE ADOPTED BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2022, AND ENDING SEPTEMBER 30, 2023, IN ACCORDANCE WITH TEXAS LOCAL GOVERNMENT CODE 102; AND PROVIDING ANI EFFECTIVE DATE. Rector-aye McGuire -aye Martin-aye Coffman-aye White-aye Motion carried unanimously. 10.3 Rector moved and Coffman seconded to adopt AN ORDINANCE OF THE CITY OF CLYDE, TEXAS, LEVYING AD VALOREM TAXES FOR TAX YEAR 2022 AT $.007250 PER ONE HUNDRED DOLLARS ($100) ASSESSED VALUATION OF ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS TO PROVIDE REVENUES FOR THE CURRENT EXPENSES ANDINTEREST AND: SINKINGFUND REQUIREMENTSTHISYEARSTAXIEWI TO FUND MAINTENANCE AND OPERATIONS EXPENDITURES EXCEEDS LAST YEAR'S MAINTENANCE, AND OPERATIONS TAXL LEVY BY2.57 PERCENT. PROVIDING DUE AND DELIQUENT DATES; PENALITIES AND INTEREST; AND SETTING AN EFFECTIVE DATE. Rector-aye McGuire-aye Martin-aye Coffman-aye White-a aye Motion carried unanimously. preliminary replat. 10.4 Terry Davis informed council the P&Z Board met the night before and approved the White moved and McGuire seconded to approve the Preliminary Replat of property located at Being 317 CHERRY STREET, Clyde Callahan County Texas. Request is fora REPLAT OF PROPERTY into 2 lots, so a house can be constructed on lot 2. Motion carried unanimously. 10.5 Mayor Brown said the two members who are currently on the EMS Board have been there for a while. He would like to see a councilmember sit on that board. McGuire stated he would be happy to sit on the EMS Board and represent the City of Clyde. White moved and Martin seconded to appoint Connie Thornton and Paul McGuire to the EMS Board. Motion carried unanimously with McGuire abstaining. 10.6 Thornton informed council that three candidates running for city council were unopposed. Mayor Brown thanked the three councilmembers for running for re- White moved and McGuire seconded to accept the CERTIFICATION FROM CITY SECRETARY THAT THE CANDIDATES FOR OFFICE OF COUNCILMEMBER IS election and what an excellent job they do for our community. UNOPPOSED. Motion carried unanimously. 10.7 Martin moved and White seconded to adopt AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLYDE, TEXAS, CANCELLING THE ELECTION SCHEDULED TO BEI HELD ON NOVEMBER 8, 2022, IN ACCORDANCE WITH SECTION 2.053(a) OF THE TEXAS ELECTION CODE. Motion carried unanimously. 10.8 Thornton explained the two changes to the Personnel Policies and Procedures. The first being salaried employees would be able to accumulate comp time when earned and would not be limited to only being able to carry 32 hours of comp time. Coffman stated she thought the salaried employees should be able to accumulate the comp time as earned and not be limited to 32. The second change would be for new employees who can still start taking their vacation after: six months would not be eligible for reimbursement of vacation leave unless they completed ay year's employment with the city. Brown said he thought that was a good Martin moved and Coffman seconded to approve A RESOLUTION OF THE CITY OF CLYDE, TEXAS, REVISING THE PERSONNEL POLICY MANUAL, SECTIONS 4.2.4 TO INCREASE COMPSENTATION HOURS FOR SALARIED EMPLOYEES AND 5.14.2, VACATION LEAVE, CONCERNING REIMBURSEMENT UPON SEPARATION FROM idea and it would be an incentive for employees to stay. EMPLOYMENT. Motion carried unanimously. 10.9 Brown stated the council had recommended for Connie Thornton to run for a place on the Board of Trustees-Texas Municipal League Health Benefits Pool Region 6 and would like to see the council cast their vote for her on the official ballot. White moved and Martin seconded to cast the city of Clyde's vote for Connie Thornton on the official ballot for the Board of Trustees-Texas Municipal League Health Benefits Pool Region 6. Motion carried unanimously. 11.0 FINANCIAL STATEMENT The August 31, 2022, Financial Statement Summary was available to Council for review. There were no questions or comments. 12.0 ADIJOURNMENT McGuire moved and Rector: seconded to adjourn the meeting at 6:31 p.m. Motion carried unanimously.
