December 13, 2022 The City Council oft the City of Clyde, Texas, meti in a Regular Meeting at Clyde City Hall, 222 Oak Street, Clyde, Texas on December 13, 2022, at 6:00 p.m. with Mayor Rodger Brown presiding. Councilmembers present: Rodger Brown, Paul McGuire, Thomas Martin, James Rector, Tammie Coffman, and Danny A. White. Staff present: City Administrator Chris McGuire, City Secretary Connie Thornton, Public Information Specialist Nancy Woods, Librarian Linda Cavanaugh, Director of Community Services Terry Davis, Public Works Director Jerry Perkins, and Chief of Police Robert Dalton. An open meeting was held concerning the following subjects: 1.0 CALL TO ORDER AND. ANNOUNCE A QUORUM IS PRESENT At 6:03 p.m., Mayor Brown called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Brown. 3.0 PLEDGES TO U.S. AND' TEXAS FLAGS All-I led by Mayor Brown. 4.0 COUNCIL COMMENTS Councilmember Rector thanked Jerry Perkins, Public Works Director, for taking him on a tour of the new Public' Works building. Rector: said it was an asset to our community. 5.0 PUBLIC COMMENTS Mayor Brown opened public comments at 6:06 p.m. Camilla White, 525 South First Street West, Clyde, Texas addressed the council concerning the new smart meters that are being installed throughout the city. She voiced concerns with not being able to access the meter as they are now locked. She: stated her daughter was double billed, and she wants to make sure citizens are not being overcharged. She said she felt the citizens were being held hostage by not being able to get to their meters and to see the water usage. She does not want to As there were no other comments, Mayor Brown closed the public comments at 6:09 p.m. rely ont the city to be there to turn off her meter in case of an emergency. 6.0 CONSENT AGENDA 6.1 McGuire moved and White seconded to approve the minutes from the regular meeting of November 8, 2022, as printed. Motion carried unanimously. 7.0 PUBLIC HEARINGS 7.1 Mayor Brown opened the Public Hearing at 6:09 p.m. for the property located at Being 6.237 Acres ABST 1494, Sec 66 H. C. Merchant East, Callahan County, Texas for a REZONE OF PROPERTY TO MULTI-FAMILY. As there were no comments Mayor Brown closed the public hearing at 6:10 p.m. Mayor Brown opened the public hearing at 6:10 p.m. on the property located at Being 11.94 Acres of land out of the N % of the NW: % of Section 65, Abstract 96, BBB & CRR. Co. Survey, As there were no comments Mayor Brown closed the public hearing at 6:11 p.m. 7.2 Clyde Callahan, Texas for a REPLAT OF PROPERTY into 40 lots. 8.0 REGULAR AGENDA 8.1 Chris informed council this had gone before the P&Z Board the night before and was approved. This rezoning is for a gated 200-unit apartment complex with 4 stories, covered parking and amenities. This will support need for housing in the city. The apartments would not be for low-income housing. Martin asked if the existing exits would remain the same. Chris said TXDOT controls the exits but at this time no information on moving any exits. White moved and Martin seconded to adopt AN ORDINANCE OF THE CITY OF CLYDE, TEXAS, CHANGING THE ZONING USE DESIGNATION OF 6.237 ACRES ABSTRACT 1494, SECTION 66, H.C. MERCHANT EAST, CALLAHAN COUNTY, TEXAS FROM AGRICULTURAL DISTRICT (A) AND COMMERCIAL DISTRICT - GENERAL (C-2) TO MULTIFAMILY DISTRICT (MF); AMENDING THE ZONING DISTRICT MAP FOR THE CITY TO REFLECT SUCH CHANGE; AND ADOPTING THE ZONING DISTRICT MAP SO AMENDED. Motion carried unanimously. 8.2 Chris informed council this had also gone before the P&Z Board the night before and was approved. This replat will allow 40 homes to be built to also help with housing in the city. Rector asked where the property was located, and White said it was off Sunset. Martin asked if the housing addition would be on a cul-de-sac. Chris stated it would. White moved and Martin seconded to approve a preliminary replat of property located. at Being 11.94 Acres of land out of the NK of the NW % of Section 65, Abstract 96 BBB & CRR. Co. Survey, Clyde Callahan, Texas into 40 lots. Motion 8.3 John Bayer, 429 Fairmont, Clyde, Texas addressed council concerning erecting a 25- foot flagpole at the headstone of Joseph J. Bayer. Joseph Bayer is a 21 year air force veteran and retired postal worker. John would like to fly the American and Air Force flag. The pole would be put in according to regulations. It would be lighted and concreted at least 3 feet into the ground. Brown asked if there were any issues from Public Works and Jerry said there would not be any issues for them. Brown stated if this request comes in again the council may want to look at setting guidelines. McGuire wanted to make sure no other political flags would be flown and Mr. Bayer said only the American and Air Force flags. Joseph Bayer thanked the council for Rector moved and McGuire seconded to allow John Bayer to place a 25-foot flagpole at the cemetery for Joseph J. Bayer. Motion carried unanimously. carried unanimously. allowing the pole to be placed. 8.4 Chris told council one member, Debbie Bowman, has already been approved to sit on the Library Board. The second one that is being needed should be appointed by the end of next week. Linda Cavanaugh explained to council two members had recently resigned, Joanne Kniffen, who went to work for the library and Rose Kniffen. The Board consist ofal President, Vice President, Secretary, Treasurer: and three others. Martin moved and Coffman seconded to appoint two new members to the Clyde Library Board. Motion carried unanimously. 9.0 CITYA ADMINISTRATOR REPORTS Chris gave the council a year-end wrap up. There were a 171 building permits issued last year with a construction value of 30r million dollars. That is a! 58% increase over last year. The Police Department will be completed in the next few weeks and a. January move-in date is expected. All but 50 new smart meters have been installed. We are waiting for the correct sizes to finish, The meters have been ordered and we are looking at. January for a completion date on thei installation. Trash service being run by the city expected tol begin mid to late. January. Starbucks has filed for their building After reviewing an unmet demand analysis the city lost out on 1.98 million dollars last year in sales tax fort thet following reasons; Grocery stores, general merchandise suppliers, full-service restaurants, sporting goods stores, liquor stores, and clothing stores. With the growth Clyde is experiencing we look forward to obtaining some of this sales taxi money. After all, sales tax monies is what operates permit. cities. 10.0 EXECUTIVE SESSION/The Council may enter into Closed or Executive Session to discuss the following:) The council entered into executive session at 6:30 p.m. The council returned to open session at 7:53 p.m. No action taken. 11.0 FIMANCALSTATEMENT The November 30, 2022, Financial Statement Summary was available to Council for review.
