March 14, 2023 The City Council of the City of Clyde, Texas, meti in a Regular Meeting at Clyde City Hall, 222 Oak Street, Clyde, Texas on March 14, 2023, at 6:00 p.m. with Mayor Pro Tem Paul McGuire presiding. Councilmembers Staff present: City Administrator Chris McGuire, City Secretary Connie Thornton, Public Information Specialist Nancy Woods, Librarian Linda Cavanaugh, Director of Community: Services Terry Davis, Chief of Police Robert present: Paul McGuire, Thomas Martin, Tammie Coffman, and Danny A. White. Dalton, Attorney Eileen Hayman, Code Enforcement Officer. James Bollmann. An open meeting was held concerning the following subjects: 1.0 CALL1 TO ORDER AND ANNOUNCE A QUORUM IS PRESENT At 6:00 p.m., Mayor Pro Tem McGuire called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Pro Tem McGuire. 3.0 PLEDGES TO U.S. AND TEXAS FLAGS All-I led by Mayor Pro Tem McGuire. COUNCIL COMMENTS None 4.0 5.0 PUBLIC COMMENTS Mayor Pro Tem McGuire opened public comments at 6:01 p.m. Camilla White, 525 South First Street West, Clyde, Texas addressed the council. Ms. White stated she was upset that the meeting was cancelled last month on the regular meeting day and then rescheduled for later in the month and she was not aware that it had been rescheduled. She also wanted the council to bet thinking about what the city is going to do when the traffic from the new housing addition on Sunset is going down Southwest Drive, which is already a terrible street. Lastly, she wanted the council to know there has been no communication about the smart meters or the portal. Also, when she called someone out to check her meter because the portal is not up and running, they came oute early because the communication from city hall to public works is not good. As there were no other comments, Mayor Pro Tem McGuire closed the public comments at 6:05 p.m. 6.0 CONSENT AGENDA 6.1 White moved and Coffman seconded to approve the minutes from the special meeting of February27,2023, as printed. Motion carried unanimously with Brown and Rector being absent. 7.0 PRESENTATION 7.1 Presentation from Steve Adams of Specialized Public Finance - cancelled. 8.0 PUBLICI HEARINGS 8.1 Mayor Pro Tem McGuire opened the public hearing at 6:07 p.m. for the on property located at Being 22.10. Acres out oft the South1/2 of the Northeast % of Survey 62, B.B.B. & C.R RR. Camilla White, 525 South First Street West, Clyde, Texas asked where this property was As there were no other comments Mayor Pro Tem McGuire closed the Public Hearing at 6:08 Company Lands, Callahan County, Texas. located. Chris explained it was at 604 and Hunt Street. p.m. 8.2 Mayor Pro Tem McGuire opened the Public Hearing at 6:08 p.m. for annexation on 40.279 acres out of the Southwest One-Quarter of Section No. 76, B.B.B. & C. - RR. Camilla White, 525 South First Street West, Clyde, Texas asked where this property was located. Chris explained this is property bought by the EDC for easement purposes. He stated As there were no comments Mayor Pro Tem McGuire closed the Public Hearing at 6:09 p.m. Company Surveys, Callahan County, Texas. the property is due south of Kevin Hagan's new housing addition. 9.0 REGULAR AGENDA 9.1 Chris informed the council this is the last stepi ini the process to replat the property. Martin moved and White seconded to approve the final plat of property into. 32 lots, so houses can be constructed on each lot. Motion carried unanimously with Brown and Rector 9.2 Chris explained this agreement is required by the city to move the annexation process along. White moved and Coffman seconded to approve the service agreement between the City of Clyde and the Clyde EDC. for annexation. Motion carried unanimously with being absent. Brown and Rector being absent. 9.3 Chris said this is the final action required by Ordinance to bring the property into city limits. Jacob and Martin will update the city! limits map. Martin moved and Coffman seconded to adopt AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF CLYDE, CALLAHAN COUNTY, TEXAS; EXTENDING THE BOUNDARY LIMITS OF SAID CITYTO INCLUDE SAID PROPERTY WITHIN SAID CITY LIMITS; AND GRANTING TO ALL THE INHABITANTS OF SAID PROPERTY. ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID INHABITANTS BY ALL OF1 THE ACTS, ORDINANCES, RESOLUTIONS, AND REGULATIONS OF SAID CITY. Motion carried unanimously with Brown and Rector being absent. 9.4 This item is moved to the end of the agenda as the council needs to meet with the cityattorney. 10.0 EXECUTIVE SESSION/The Council may enter into Closed or Executive Session to discuss the following:) The council entered into executive session at 6:14 p.m. The council returned to open session at 6:42 p.m. No action taken. 9.4 City attorney Eileen Hayman addressed the Little League and Softball League persons in attendance saying fori the city to convey the land out at the ball fields on 604 North the Little League and Softball League must bei incorporated. Holly Copher, 1436 CRE 631, Clyde, Texas, thanked the council for hearing their request. She questioned ift the Clyde Community Parks Board was reinstated could the city convey the land to that board. Council did not think that would be a problem. Ms. Copher asked the council to notr make any decisions on the land for the next 365 days. Chris stated that iti is the council's intention to convey the land toi the Little League and Softball League or the Parks board and the city will permanently be done with Martin moved and White seconded to give the little league and: softball league 90 days to get incorporated. so the city could transfer the land to them and to authorize the city administrator to sign all documentation once this is done. Motion carried unanimously the property. with Brown and Rector being absent. 11.0 FINANCIAL STATEMENT The February 28, 2023, Financial Statement was available to Council for review.
