May 9, 2023 The City Council of the City of Clyde, Texas, met in a Regular Meeting at Clyde City! Hall, 222 Oak Street, Texas on May 9, 2023, at 6:00 p.m. with Mayor Rodger Brown presiding. Councilmembers present: Rodger Clyde, Brown, Paul McGuire, Thomas Martin, Tammie Coffman, Jim Rector, and Danny A. White. Staff present: City Administrator Chris McGuire, City Secretary Connie Thornton, Public Information Specialist Nancy' Woods, Librarian Linda Cavanaugh, Director of Community Services Terry Davis, Chief of Police Robert Dalton, Public Works Director. Jerry Perkins, and Code Enforcement Officer. James Bollmann. An open meeting was held concerning the following subjects: 1.0 CALLTOORDER, AND ANNOUNCE A QUORUM IS PRESENT At 6:00 p.m., Mayor Brown called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Brown. 3.0 PLEDGES TOU.S. AND TEXAS FLAGS All-le led by Mayor Brown. 4.0 COUNCIL COMMENTS Councilwoman Coffman wanted to acknowledge and bring forth the awareness of our community concerning the shootings happening around the nation. She asked that all citizens be aware and alert to protect themselves and our community. 5.0 PUBLIC COMMENTS Mayor Brown opened public comments at 6:02 p.m. Camilla White, 525 South First Street West, Clyde, Texas addressed the council saying she was curious about when the pipeline from Ft. Phantom would be here especially since the drought contingency. She was wonderingi if there was a completion date for the pipeline. Also, still concerned As there were no other comments, Mayor Brown closed the public comments at 6:03 p.m. about not being able to check her own meter. 6.0 CONSENT AGENDA 6.1 Rector moved and McGuire seconded to approve the minutes from the regular meeting of April 11, 2023, as printed. Motion carried unanimously. 7.0 REGULAR AGENDA 7.1 Michael Cooley, 210 California St., Clyde Texas addressed the council concerning the sewer back up in his house from December of 2022. He stated he was a lifelong resident of the city of Clyde and bought his current home in 2014. Since his purchase oft this home, he states there has been at least 101 times he has had sewer back up issues. The Sunday before Christmas his house completely flooded with wastewater. The city put him and his family up in an Airbnb for a few weeks while the workers and insurance company evaluated the damage. The insurance company stated it would pay $100,000.00 peri incident and it had to be split between alli individuals involved. The insurance company allotted him $77,450.00of the $100,000.00. That left him personally owing $92,119.42. He would like the city to authorize the overage so he can get his home fixed. Mayor Brown stated the city has not refused to meet our responsibility; we turned it over toi the insurance company. Mr. Cooley said he has paid at least that much in the years to the city of Clyde in water rates. He is not able to live in his house ors sell it the way it is. Councilmember Rector asked Mr. Cooley about his personal homeowners' insurance. Mr. Cooley responded het filed with his insurance company, but they refused to pay due to it being wastewater. Chris stated the city has done everything they possibly can, and the rest is up to the insurance company and TML states due to state laws there is no more they can do. Mayor Brown expressed his concern for Mr. Cooley and his family. He said the council would take it underadvisement and get back with 7.2 Chris reminded council the attorney's who represent multiple cities, Lloyd Gosselink, in the negotiation process with AEP concerning rates has asked the city to deny the rate increase McGuire moved and Coffman secondedi to adopt AF RESOLUTION OF THE CITY OF CLYDE, TEXAS FINDING THAT AEP Texas inc.'s application TO AMEND ITS distribution cost recovery factors to increase distribution rates' WITHIN THE CITY SHOULD BE DENIED; authorizing participation with the cities served by aep texas; authorizing hiring of legal counsel; FINDING THAT THE CITY'S REASONABLE RATE CASE EXPENSES SHALL BE REIMBURSED BY THE COMPANY; FINDING THAT THE MEETING AT WHICH THIS RESOLUTION IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; REQUIRING NOTICE OF THIS RESOLUTION TO THE COMPANY AND LEGAL COUNSEL. Motion him. and let them research andi try to get a better rate for the city. carried unanimously. 7.3 Chris stated originally councilmember White was appointed to the Keep Clyde Beautiful Board, however since his appointment several people have stepped forward saying they would be interested ins sitting on that board. Councilman White feels like it would be good to McGuire moved and Martin seconded to remove. Danny White from the Keep Clyde Beautiful Board and add Donna Castro and Shelley Watson. Motion carried unanimously. 7.4 Chris said under the regulatory requirements of the Keep Clyde Beautiful Board they must have as many people involved as possible. have By Laws. Rector moved and Coffman seconded to approve the By Laws of the Keep Clyde Beautiful Board. Motion carried unanimously. 8.0 EXECUTIVE SESSION/The Council may enter into Closed or Executive Session to discuss the following:) The council entered into executive session at 6:35 p.m. The council returned to open session at 7:42 p.m. No action taken. 9.0 ADIOURNMENT unanimously.
