AGENDA 8.1 Mayor Brown explained Mr. Cooley had requested to be on the agenda to address the council, however he had a death in his family and is unable to attend. Mayor Brown At this time Mayor Brown asked the council to move to 8.101 for time constraint reasons. 8.10 Paul. Jasin with Specialized Public Finance spoke to council about the three bonds that are being issued to the City of Clyde. He stated the city! had an A- rating and the first bond for 4 million dollars will be paid back over 30 years. It will be callable August 1st, 2033. On the refinancing oft the bond, they willl be refinanced into two bonds, one being taxable and one being nontaxable. Motion expressed his condolences to the Cooley family. save approximately $22,000.00ay year. carried unanimously with Martin being absent. 8.11 Coffman asked for clarification as to why one bond was taxable, and one was nontaxable. Chris stated we were over the cap of 35% for water sales to Eula and Callahan County Water Services. For ust to be able to sell at the rate we are, part oft that bond had to be taxable. Coffman asked if any oft that taxable refinancing is passed on to our citizens for them to ina additional taxes. Chris stated the citizens would not see at tax increase from the refinanced pay taxable bond. McGuire stated this is not new debt, it is existing debt that we are refinancing McGuire moved and Coffman seconded to adopt AN ORDINANCE AUTHORIZING ISSUANCE AND SALE OF CITY OF CLYDE, TEXAS GENERAL OBLIGATION REFUNDING BONDS, THE TAXABLE SERIES 2023B; LEVYING AN ANNUAL AD VALOREM TAX AND PROVIDING FOR" SECURITY FOR AND PAYMENT OF SAID BONDS; APPROVING THE OFFICIAL STATEMENT; THE PROVIDING AN EFFECTIVE DATE; AND ENACTING OTHER PROVISIONS RELATING TO atasavings. The paving machines will be purchased out of this money and over the next several years the roads will all be done. Council returned to agenda item 8.2. 8.2 Adeline Moore with the David Pettit Group addressed the council concerning the 2 Tax Increment Reinvestment Zone (TIRZ). This program is governed by Tax Code, Chapter 311. Hundreds ofTIRZ have been created in the state of Texas by both large and small cities. This tool can be used to pay for improvements in a zone sO it will attract new development and facilitate investment. It redirects a portion oft tax generated from new development within the TIRZ. A TIRZ can pay for infrastructure, public improvements, economic development programs such as 380 agreements and it can take on other projects that would benefit the zone. This ordinance establishes 5 key elements: 1. Boundary 2. Term 3. TIRZ Board (which will be the council) 4. City Participation 5. Preliminary Project and Financing Plan. The first TIRZ is approximately 295 acres along I-20. Motion 8.3 There arei two areas int this' TIRZ, the firsti is Downtown which will include aj pharmacy, medical offices, etc. The second is North ofI-20 where there is interest in doing an apartment complex and shopping area. White moved and Rector seconded to rezone the property located at Being 13.14 Acres ABST 86 SECTON 65 BBB&C OR 1300 ROSS ROAD, Clyde Callahan County, Texas from agriculture to. Single-Family Estate. Motion carried unanimously with Martin being absent. 8.5 Chris stated this serves a need for rental properties. White moved and McGuire. seconded to rezone the property located at. 204, 206, 208, 210 and 212 Marlin Street, Clyde Callahan County, Texas from Single-Family Estate to Multi-Family so a triplex can be placed on each property. Motion carried unanimously with Martin being absent. 8.6 Chris said this was the remaining parcel of land on Pleasant Lane that was annexed months before. McGuire moved and Rectorseconded to rezone the property locatedo at Being 16.51 acres ABST 86. Section 65 BBB&C or. 1300 Ross Road Clyde, Callahan County, Texas from Agriculture to Single Family Estate. Motion carried unanimously with Martin being absent. will allow for more housing. 8.7 Chris informed council this area is off Bowie and South 5th and by replating it White moved and Coffman seconded to approve a Preliminary Replat of property located at Being lots 5 & 6 Block 50 Original Town Site Clyde, Callahan County, Texas. The request is to replat into 3 lots so houses can be constructed on each lot. Motion carried unanimously with Martin being absent. 8.8 Chris said this rezoning isi inarea surrounded by manufactured housing. McGuire moved and Rector seconded to approve the REZONE. for property located at LOTS3& 4 BLOCK E ROLLING ACRES (408 ORIOLE) Clyde Callahan County, Texas to Manufactured Home Dist. Motion cariedumamimousywith Martin being absent. 8.9 Chris stated this home is under contract to be purchased. The home is probably 50-60 years old. It is now encroaching on our easement. By giving Coffman moved and' White seconded to adopt AN ORDINANCE OF THE CITY OF CLYDE, TEXAS CLOSING A: 2,796 SQUARE FOOT PORTION OF SOUTH FIFTH STREET; FINDING THAT THE PORTION TO BE CLOSED IS NOT NECESSARY FOR USE AS A PUBLIC THOROUGHFARE; AUTHORIZING CONVEYANCE OF SAID this to them it will do no harm to the city. PROPERTY; PROVIDING SAVINGS AND SEVERABILITY CLAUSES; AND PROVIDING AN EFFECTIVE DATE. Motion carried unanimously with Martin being absent. 8.13 Chris informed council this is for the Texas Department of Agriculture Community Development Block Grant #CDV21-0076. There was one bid submitted for replacement of approximately 1820 linear feet of PVC gravity White moved and McGuire seconded to award the bid for the Texas Department of Agriculture Community Development Block Grant #CDV21- 0076 to Bontke Brothers construction from Abilene for a base bid amount of $346,653.00. Motion carried unanimously with Martin being absent. 8.14 Chris stated for audit purposes the easiest way to take care of the new bond money was to set up 2 new banking accounts. One will be for the proceeds and the other one willl bei fort the wire payments that willl be made ont this bond. White moved and Coffman seconded to approve setting up two new accounts at First Financial Bankj fort the 2023 CO. Motion carried unanimously sewer line replacement. with Martin being absent. 9.0 EXECUTIVE SESSION No executive session. 10.0 FINANCIAL: STATEMENT White inquired what the Clearing account was used for, Thornton explained there are items that need to be paid out of the General Fund and Enterprise Fund and instead of having to write two checks one can be written out of the Clearing Fund. It saves on number of checks written as well as an audit tool to simplify entries.
