August 8, 2023 The City Council of the City of Clyde, Texas, met in a Regular Meeting at Clyde City Hall, 222 Oak Street, Clyde, Texas on August 8, 2023, at 6:00 p.m. with Mayor Rodger Brown presiding. Councilmembers present: Rodger Brown, Paul McGuire, Tammie Coffman, Jim Rector, Thomas Martin, and Danny A. White. Staff present: City Administrator Chris McGuire, City Secretary Connie Thornton, Librarian Linda Cavanaugh, Director of Community Services Terry Davis, Public' Works Director. Jerry Perkins, Parks and Recreation Director Chris Chorn, and Chief of Police Robert Dalton. An open meeting was held concerning the following subjects: 1.0 CALLTO ORDER AND ANNOUNCE A QUORUM IS PRESENT At 6:00 p.m., Mayor Brown called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Brown. 3.0 PLEDGES TO U.S. AND TEXAS FLAGS All- -i led by Mayor Brown. 4.0 COUNCIL COMMENTS Councilmember Rector wanted to acknowledge alli the employees who are working out in this 100 plus heat and wanted them to know how much they are appreciated. 5.0 PUBLIC COMMENTS Mayor Brown opened public comments at 6:02 p.m. As there were no comments, Mayor Brown closed the public comments at 6:03 p.m. 6.0 RECESS TO1 TIRZI BOARD #1 AND TIRZI BOARD #2 The council recessed and the TIRZI Board #1 came into session at 6:03 p.m. Natalie Moore with the David Petit Group presented the TIRZ Board #1 with Project and McGuire moved and White: seconded to recommend approval of the Project and Financing Financing Plani for1 the area that will be covered under the TIRZ#1. Plan for TIRZ #1 to the city council. Motion carried unanimously. TIRZ Board #1 recessed at 6:12 p.m. TIRZI Board #2 came into session at 6:12 p.m. Natalie Moore with the David Petit Group presented the TIRZ Board #2 with Project and Rector moved and Coffman. seconded to recommend approval of the Project and Financing Financing Plan for the area that will be covered under the TIRZ#2. The property is currently zoned as COMMERCIAL1. As there were no comments Mayor Brown closed the public hearing at 6:19 p.m. 8.3 Mayor Brown opened the public hearing for the property located at Being Lots 6 ofW.J. Dugan Subdivision, Clyde, Callahan County Texas at 6:20 p.m. Request is for a PRELIMINARY REPLAT OF PROPERTY into 3 lots, sO a Duplex can be constructed Bryan Connor, 207 Forrest, Clyde, Texas stated this is a lower placed property and has a significant amount of water retention. He was wondering where the water is going to go after these residences are built. Davis stated that has been addressed in the engineering plans for this property. Mayor Brown stated the city is working on a flood plan to keep the city safe and As there were no other comments Mayor Brown closed the public hearing at 6:23 p.m. on each lot. The property is currently zoned as 2 Family Duplex. clean. 9.0 REGULAR. AGENDA 9.1 Chris said this is the same property as last month's preliminary replat off South 4th. This is the last step for the final replat. White moved and Rector seconded to approve the final replat of property located at 609 NORTH SECOND OR BEING LOTS 16,17& 18 BLOCK. 14 RAILROAD ADDITION CLYDE, 9.2 Chris stated this is the same property as the previous agenda item. They are wanting to CALLAHAN COUNTY1 TEXAS. Motion carried unanimously. rezone this property so it can be used for residential housing. Motion carried unanimously. 9.3 Chris informed council this property is across from the elementary school and North oft the Boy Scout's Hur. They are wanting to build duplexes for residential use. Rector moved and Coffman secondedi to approve the prelimhayrphatefpopery. located at Being Lots 6 ofw.J J. Dugan Subdivision, Clyde, Callahan County Texas. Motion carried unanimously. 9.4 Chris said this is the final action that needs to be approved by city council. It has aiready been approved by the TIRZ Board #1. Rector moved and McGuire seconded to adopt AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLYDE, TEXAS, APPROVING A PROJECT AND FINANCING PLAN FOR TAX INCREMENT REINVESTMENT ZONE NUMBER ONE, CITY OF CLYDE, TEXAS, ESTABLISHED PURSUANTTOC CHAPTER 311 OF THE TEXASTAX CODE. Motion carried unanimously. 9.5 Chris said this is the final action that needs to be approved by city council. It has already been approved by the TIRZI Board #2. White moved and Rector seconded to adopt AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLYDE, TEXAS, APPROVING A PROJECT AND FINANCING PLAN FOR TAX INCREMENT REINVESTMENT ZONE NUMBER TWO, CITY OF CLYDE, TEXAS, ESTABLISHED PURSUANT TO CHAPTER 311 OF THE TEXASTAX CODE. Motion carried unanimously. 9.6 Coffman moved and Martin seconded to order an election for the General Election to be 9.7 Chris said iti isa requirement for the council to set thet tax rate and public hearings. held on November: 7, 2023. Motion carried unanimously. McGuire moved and Martin seconded to adopt the proposed tax rate of $0.68000 which will be a 6.21% decrease in the property tax rate with a Public Hearing to be held on september12-/2023, and direct the city secretary' to post notifications and postings. Councilmember McGuire- -aye Councilmember White - aye Councilmember Coffman-aye Councilmember Martin - aye Councilmember Rector-aye 9.8 Chris stated by having local businesses displayed with a sign at the sports complex that will be an incentive for our small businesses. Martin asked if all the signs would be uniform? Chris said they would all be made of the same material and all the same size. The signs will also be put on the fields with the most local usage. Rector asked if any business would be able to put up the signage? Chris stated this is only for our local small businesses. McGuire asked how much each sign would cost? Chris said each sign will be #375.00. Rector asked if the local businesses would be reaching out to the city for this advertisement? Chris stated there has already been a meeting with some of the local businesses. Coffman asked what the signs would be made of because the" "flapping" of signs on the fences was not very eye catching. Chris said all signs will be made of hard aluminum. Martin asked about the booster club's signs that are already on the school's baseball fields. Chris said those signs will stay on the school's fields and not transfer to the city'ssports complex. Martin moved and Rector seconded: to approve the local business signage to put up at the 9.9 Chris informed counçil the new state law changed the mandated curfew of minors. Our city attorney recommends we repeal the current ordinance we have in place regarding Martin moved and Coffman seconded to adopt AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLYDE, TEXAS, REPEALING DIVISION 2 "CURFEW" OF ARTICLE 8.02 "MINORS" OF CHAPTER 8 "OFFENSES AND NUISANCES" OF1 THE CODE OF ORDINANCES OF THE CITY OF CLYDE, TEXASTO REPEAL REGULATIONS IMPOSING. A CURFEW ON PERSONS UNDER THE AGE OF EIGHTEEN AND THE ASSOCIATED CRIMINAL PENALTY; PROVIDING FOR THE INCORPORATION OF PREMISES; PROVIDING SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. new sports complex. She stated she wanted to thank the council for the new building they have moved into to support our seniors. There has been a huge outpouring of support from the: senior community. She said they are even playing chair volleyball. She wanted to personally invite all of council and the community to come to the Open House that willl be held this Saturday at the new: Seniors Citizen's Building. 9.11 Chris said this an annual rate setting from Atmos and our attorneys who handle these rate increases fors several small cities have negotiated down to what they feel Rector moved and Martin seconded to approve A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLYDE, TEXAS, APPROVING A NEGOTIATED SETTLEMENT BETWEEN THE ATOMS CITIES STEERING COMMITTEE ("ACSC')AND/ ATMOS ENERGY CORP., MID-TEX DIVISION REGARDING THE COMPANY'S 2023 RATE REVIEW MECHANISM FILING; DECLARING EXISTING RATES TO BE UNREASONABLE; ADOPTING TARIFFS THAT REFLECT RATE ADJUSTMENTS CONSISTENT WITH THE NEGOTIATED SETTLEMENT; FINDING THE RATES TO BE SET BY THE ATTACHED SETTLEMENT TARIFFS TOBE. JUST AND REASONABLE. AND IN THE PUBLIC INTEREST; APPROVING AN ATTACHMENT ESTABLISHING A BENCHMARK FOR PENSIONS AND RETIREE MEDICAL BENEFITS; REQUIRING THE COMPANY TO REIMBURSE ACSC'S EASOMABIERATEMAKING EXPENSES; DETERMINING THAT1 THIS RESOLUTION WAS PASSED IN ACCORDANCE WITHTHE REQUIREMENTS OF THE TEXAS OPEN MEETINGS ACT; ADOPTING A SAVINGS CLAUSE; DECLARING AN EFFECTIVE DATE; AND REQUIRING DELIVERY OF THIS RESOLUTION TO THE COMPANY AND THE ACSC'S like is an acceptable increase.
