RESOLUTION #013-23  A RESOLUTION OF THE CITY OF DE LEON, TEXAS CANVASSING THE RESULTS OF THE MAY 6, 2023 SPECIAL ELECTION ON THE REAUTHORIZATION OF THE LOCAL SALES AND USE TAXI IN THE CITY OF DE LEON AT THE RATE OF ONE-FOURTH OF ONE PERCENT TO CONTINUE PROVIDING REVENUE FOR MAINTENANCE AND REPAIR MUNICIPALSTREETS WHEREAS, an election was held at the City of De Leon, Texas, on May 6, 2017 for the purpose of a Special Election on the reauthorization of the local sales and use tax in the City of De Leon at the rate of one-fourth of one percent to continue providing revenue for maintenance and  repair of municipal streets;  WHEREAS, the City Council of the City ofDe Leon (the "City Council") has reviewed and investigated all matters pertaining to this election, including the ordering of the election, notices,  election officials, conducting the election and returns thereof;  WHEREAS, the City Council, hereby, canvasses the returns of this election, at which there was submitted to all resident qualified electors of the City ofDeLeon for their action thereupon, the reauthorization of the local sales and use tax in the City ofI Del Leon at the rate of one-fourth of one percent to continue providing revenue for maintenance and repair of municipal streets;  WHEREAS, the City of De Leon has diligently inquired into the poll lists and the official election returns which were duly and lawfully made to the City Council by the judges and clerks holding and conducting the election; the poll list and the official election returns showing separately the resident, qualified voters casting votes in the election and the number of votes cast in the election;  and  WHEREAS, from these returns, this City Council hereby finds that the following votes were  casti in the election by voters who were resident, qualified electors oft the City:  PROPOSITION NO.1  "The reauthorization of thelocal sales and use tax in the City ofDeLeon at the rate of one-fourth of one percent to continue providing revenue for maintenance and repair of municipal streets. The tax expires on the fourth anniversary of the date of this  election unless the imposition of this tax is reauthorized  For Against  88 10  Resolution #( 013-23; Canvassing May 6, 2023 Special Election Sales and Use Tax  Page 1  City ofDel Leon 05/2023    NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OFTHE CITY OF  DE LEON, TEXAS, THAT  Section 1.  The City Council officially finds, determines, and declares that the election was duly and properly ordered; that proper legal notice of such election was duly given in the English language and the Spanish language; that proper election officials were duly appointed prior to the election; that the election was duly and legally held; that all resident, qualified electors of the City of De Leon were permitted to vote at the election; that returns of the results of the election have been made and delivered; and that the City of De Leon has duly canvassed such returns, all in accordance with the laws of the State ofTexas and of the United States of America and the resolution All of the reauthorization of the local and use tax in the City ofDeLeon, Texas have  calling the election.  Section 2.  been approved by a majority vote as follows:  Proposition No. 1: 88  PASSED, APPROVED AND ADOPTED on this the 16h day of May, 2023.
