Quorum was established Commissioner Bryan Rivera led the invocation. Chair Messana led the pledges of allegiance to US and all members were present, except Commissioner Bryan Rivera. and Texas flags, respectively. 2) PUBLIC COMMENTS Public Comments are welcome. You may submit Public Comments in person, or you may. submit to the City Secretary at cimponglberphilacgon before 3:00 PM the day ofthe meeting. There were no citizen comments. City Secretary Elaine Simpson advised the Commission that citizens had signed up to speak under Agenda Items for Valero (Agenda Item 3 (c)) and Goodwill (Agenda Item 5 (a)). Interim Director Hicks advised that were seventeen (17) letters sent out, twice, with no responses; and there were citizens who spoke at the previous Staffrecommends approval ofthe Comprehensive Plan Amendment with the following considerations 1. The product should reflect the character of the surrounding context, including appropriate 2. Infrastructure should be adequate for the scale and density of the proposed development Interim Director Hicks added that there is an existing development that they will need to bring up to meeting. Interim Director Hicks advised that Step 1 was to amend the Comp Plan. for future development: buffers to adjacent single-family development. including water, wastewater, and roadway connectivity. code. ii) Hold a Public Hearing. Chair Messana opened the Public Hearing at 6:39E PM. Ms. Kathy Barber, 105 Howard Lane, stated she lives directly behind this property and enjoys her sunsets, sO she asked that what goes in keep the skies dark, and noise levels low, because it is a neighborhood; and like she mentioned in the previous meeting before, she would ask that they be good neighbors. Chair Messana closed the Public Hearing at 6:40 PM. iii) Recommendation regarding requested variance Chair Messana inquired as to what the current building on the property is operating as. Project Engineer John Teague of Eckermann Engineering advised that it is warehousing and distribution, with construction type products. Interim Director Hicks advised that this agenda item was the associated zoning for the item under Agenda Item 2 (a), and the amendment was from AG and C3 to light industrial. Interim Director Hicks presented the staff report, advising that there were: no responses to the seventeen (17) letters that Staff recommends approval. Interim Director Hicks noted that the request with the recommendation of the Commission would go to the City Council on February 14th. Chair Messana stated that there had been sent out. would also be another Public Hearing on February 14th. ii) Hold a Public Hearing. Chair Messana opened the Public Hearing at 6:461 PM. Vice-Chair Cormack asked Mr. Teague if the owner had any immediate plans for building on the property. Mr. Teague said yes, the owner does have plans for an expansion ofthe existing facility that is on the property on the 2.3-acre tract. Parcels R021680 and R634291, Georgetown (City of Liberty Hill Extraterritorial Jurisdiction), Williamson County, Texas. (M. Hicks) 1) Introduction and staff report. Interim Director Hicks presented the staff report and made aj presentation, highlighting the aspects of aTIA versus TxDOT (Texas Department ofTransportation) Driveway Permit, noting that the scale is different. Interim Director Hicks also reviewed the relationship with the Comprehensive Plan's Thoroughfare Plan and the WILCO (Williamson County) Throughfare Plan, highlighting that Highway 29 is controlled access. Interim Director Hicks reviewed the LHTX2040 mobility and connectivity requirements. Interim Director Hicks went over the required findings for a variance per Staffrecommends denial ofthe subdivision variance request. Interim Director Hicks added that, in the application, one (1) of the reasons stated was financial, and advised the Commission that financial UDC3.08.06(B), elaborating on the staff's finding for each one. hardship is not an applicable reason under state law. ii) Hold al Public Hearing. Chair Messana opened the Public Hearing at 6:571 PM. Mr. Lance Kivell, 105 Stones Throw Cove, stated he was speaking on behalf of him and his wife asking that the variance be denied. Mr. Kivell said that they live in the lot behind the property and there was lots of traffic issues already, making it hard to get out. Mr. Kivell shared other concerns regarding the right-in/right-out solution, stating that no one pays any attention to it based on others that tried this as a deterrent. Mr. Kivell expressed concerns with the 605-foot deceleration lane, and provided examples. Mr. Kivell also mentioned an article int the Community Impact that says fast food will also be in this location, which he said also does not seem to have been taken into consideration. Mr. Kevin Eddington stated that he had read the staff report and thinks they did an excellent job analyzing this, and he wants to add 1) the speed limit in the area is 65 miles per hour and many gravel haulers and contractors take that as ai recommended minimum speed, and 2) there is lots of congestion and lots ofaccidents int the area and this is going to compound the situation. Mr. Eddington highlighted an article int the Georgetown Community Impact that says fast food will also be in this location, which picks up the activity considerably. Mr. Eddington stated that he has similar concerns as Lance (Mr. Planning & Zoning Commission Meeting minutes February 6, 2024 Kivell) for the left-in/left-out, and provided examples. Mr. Eddington highlighted he has concerns regarding the 6660 West (Highway) 29 which is 28 acres property that has been approved for Class A motorhomes, listing the weights, and boat storage, with this added traffic coming out ofthis area and trying to merge. Mr. Eddington stated that this should be included in the study. Mr. Eddington further stressed that Creek Crossing and (Highway)29 has a lotoftraffic at the intersection, and after a Home Owners meeting last year, there was an accident on (Highway) 29 that damaged their sign. Mr. Eddington concluded that he thinks the variance should be denied and the TIA required to ensure safety of the community and those that use the gas station; stressing that saving money is not the answer, saving money will cost lives. Chair Messana closed the Public Hearing at 7:05 PM. iii) Recommendation regarding requested variance Vice-Chair Cormack asked ifthe Applicant had offered to come here tonight. Interim Director Hicks said no. Vice-Chair Cormack said he didn't understand their arguments and inquired as to the legitimate arguments that they made. Interim Director Hicks stated there are two (2) primary reasons why in the application, namely, 1) because the TIA is lengthy and they don't think it would request any additional mitigation than what has been proposed, and 2) based on an Exxon on Highway 291 that did not require any traffic analysis. Interim Director Hicks added that the owner owns other gas Vice-Chair Cormack asked what the process is ifthere is a TIA, and ift the City will review that and look at the recommendations. Ms. Kelly Rees, Kimley-Horn, stated they had identified some intersections that they would need to look at, some not under the City, but the City can collect fees for the intersection and then would need to coordinate with TxDOT. Commissioner Bryan Rivera asked ift the 605 foot for the deceleration lane would be normal. Ms. Rees advised it would be typical. Commissioner Rivera asked about the paper referenced saying there would be more than a gas station Interim Director Hicks advised that it looks like the fast food would be inside the gas station. Mr. Chair Messana asked if the. Applicant's traffic count was just for the gas station. Ms. Rees stated that based on a gas station, with standard conventional store, from the ITE (Institute of Transportation Engineers) group. Chair Messana stated that the Applicant estimated the trip count tol be lower. Interim Director Hicks said the Applicant was estimating that based on what they see, but that isn't what it is Vice-Chair Cormack asked if any of the concerns that residents brought out can be included in the TIA review. Ms. Rees said it was a little tricky because there was an established scope with them (the Applicant) before they decided that they wanted to go for a variance; and that they can ask them to do analysis on right-in/right-out but would come down to some assumptions. Interim Director Hicks added that unless there are extenuating circumstances, it would need to stay the same. Mr. Ethan Harwell, Kimley-Homn, advised that part of the TIA would be collecting real time data and that they have TxDOT data from two (2) years ago on (Highway) 29, adding if the data outlines need, then could do that. Abstentions: 0. 5) REGULAR AGENDA a) Discussion, consideration, and possible action related to traffic requirements as they relate to the Goodwill Site Plan, consisting of approximately 3 acres of land addressed as 110 Bronco Blvd., more particularly described by Williamson Central Appraisal District Parcel R479146, and legally described as Lot1, Sundance Square Section 21 Final Plat, Liberty Hill, Williamson County, Texas. Hicks) Interim Director Hicks presented the staff report and provided the background of the changes in the TIA worksheet and the analysis sofKimley-Hom, the City' Traffic Engineer, and the response provided. Interim Director Hicks further advised that there had been public concerns and in discussions with Council, it was brought to the Planning and Zoning Commission because the Commission can require aT TIA. Interim Director Hicks added that right now, the Commission doesn't see site plans directly Ms. Amanda Swor, Drenner Group as the Property Owners representative, noted shel had with herl Mr. Kevin Hunter, the Property Owner; Mr. Bobak' Tehrany, the Transportation Engineer; and Mr. Tony Prete, Civil Engineer. Ms. Swor indicated that Mr. Tehrany would speak after her and that the others are here in case there are any questions. Ms. Swor stated she wanted to talk about the timeline and provided the Commission the chronology and discussed the discrepancy in the land use split in the Building Permit versus the Site Development. Ms. Swor acknowledged that the team had made some errors, and when they were alerted by staff of the concerns on the TIA, they quickly corrected the issues. Ms. Swor stated that it was determined by the City Engineer and their Consultant, that a TIA would not be required, noting that all intersections would by TxDOT and TxDOT didn'trequire one. Ms. Swor advised that they have tried to talk to neighbors and are still willing to do that. Mr. Tehrany, the Transportation Engineer, advised that they had looked at the split and which type of classification was applicable, and it was determined it should be a variety store. Ms. Tehrany advised Mr. Michael Mayerich, a resident of Sundance Estates, addressed the Commission, and provided handouts with maps of Bronco Lane. Ms. Mayerich acknowledged the Goodwill explanation of the changes in the square footage, and added that he did not see where the four (4) EV (electric vehicle) charging stations were addressed. Mr. Mayerich stated that the driveway to primarily be used by delivery trucks to exit will impact the key pad to get into the neighborhood, as well as the mailboxes. Furthermore, Mr. Mayerich stated that they believe they still own part oft this property and went over Ms. Ann Miller, a resident of Sundance Estates, stated that she was grateful to those here from Goodwill and that she was not opposed to Goodwill in that location, adding that her concern was there is ai major safety issue for kids that walk to get the mail, etc. Ms. Miller stated that she believes that it can be solved and that its should not stand in the way of the development, adding that she was not sure that another TIA would not be appropriate. Ms. Miller stated she would like the issues solved before construction begins, noting that as Michael (Mr. Mayerich) pointed out, the gate pad is directly across and that it why it went to Council first, and then back to the Commission. that the City's Consultant agreed that it falls below the requirements for a TIA. the maps provided. Planning & Zoning Commission Meeting minutes 7 February 6, 2024 from the entrance, and even if only trucks did use that entrance, it could cause issues with the gate. Ms. Miller also mentioned that the mailboxes cannot be moved. Ms. Miller added that the traffic already gets backed up there, elaborating on the location and the road behind the other businesses. Ms. Miller stated shel had not seen any document regarding Goodwill coming to a consensus on who would ber responsible fori improving that road to be used, but believes with the added information from a' TIA, some help from all, and some cooperation, it could be a success. Ms. Miller, however, stated that right City Secretary Elaine Simpson read emails from the following individuals (Refer to Attachment #1 now there are concerns. Ms. Messenger stressed she wanted a safe community and feels Ms. Bobbi Chock, 108 Stallion Lane, said she was not opposed to a Goodwill, and advised that her property's backyard is right behind the location. Ms. Chock stated that she liked what Amanda (Ms. Swor) said, that they want to talk, but no one has talked to her. Ms. Chock said that her son worked for Goodwill before, and that while dumping is not allowed, people still doi ita and she is concerned that a6 6-foot wall will not be enough to stop dumping over it. Ms. Chock reiterated that she is not opposed to Goodwill but that the entrance is an issue, and sometimes she struggles to make the light now due to congestion, and adding trucks in there will make it worse. Ms. Chock stated that she hopes there can be some meetings with Goodwill to help problem solve to see where those entrances could be placed Secretary Williams stated that she wanted to make sure everyone is aware that when it is coming back tot the Commission from Council today, iti is related to specifically the TIA, because ift there is apublic concern, the Commission can require one, and that is the scope; and that while there was reference to TxDOT per Ms. Swor, that the entrances are on (Highway) 29, one (1) of those entrances is coming Chair. Messana stated that the charge tonight isi ifaTIA is warranted, and while there are some concerns 1. The debate on ownership of the road and Chair Messana directed staff to get final clarity becausel hel has some concerns that at least a section of] Bronco Lane might be part of Sundance. 2. Regarding the revised 50/50 split, with halfofit being warehouse. While we cannot take any action on it tonight, Chair Messana requested that staff review the zoning because he doesn't their voices should be heard as well. to not impact the neighborhood so badly. out onto a local and/or private road depending on how that issue is resolved. that we cannot go into detail on tonight, he wanted to raise the following issues: see it fitting into C3 commercial and would like staff to flush that out. While the requirement for a TIA is a 1000 trips, upon reading the local neighborhood requirement for a TIA, which is 500 trips; and given he believes that Bronco is a residential street, based on that alone, hel believes that a traffic analysis needs to be done. Commissioner Rivera added that the people here drive it, and he can see their concern; elaborating on Vice-Chair Cormack asked if the charging stations are considered in the trip generation. Ms. Rees, Kimley-Horn, said there is not a good way to estimate, as iti is not currently in the ITE guidelines and Commissioner Novo asked if Ms. Rees agreed with the change in the description to a variety store from free standing discount store. Ms. Rees said that both are. loosely defined for a Goodwill, but she iso okay with the change and explained why. Commissioner Novo askedi ifthe trip data for warehousing was captured correctly. Ms. Rees confirmed. Mr. Harwell, Kimley Horn, advised Commissioner Novo that the ITE definition of warehousing is incredibly generic, not like what was discussed on the Vice-Chair Cormack asked what potential mitigation measure that might come out ofa TIA. Ms. Rees stated that the TIA is not the best spot to talk about the driveway placement. Ms. Rees provided examples of what is currently there, like the signal and the driveway out to (Highway) 29, adding that on Bronco, could add lanes but not sure if the City would want that, and elaborated. Vice-Chair Cormack said that it could recommend a deceleration lane on the applicant's property and turn it over Chair Messana inquired as to the light timing, and Ms. Rees said that would require TxDOT coordination. Ms. Rees added that TxDOT is looking at retiming (Highway) 29 lights in general, but Chair Messana noted that Ms. Rees had said that the driveway does not fall under the TIA, but asked ifthe driveway moves somewhere else, where it does not come out on Bronco, does that get captured. Ms. Rees stated that would most likely be a different conversation, and it could identify the problems but not dictate solutions. Chair Messana said there were comments on safety, the key pad, mailboxes, and the divider, and asked if that would be flushed out in a TIA. Ms. Rees said there can be some safety aspects that could addressed by the study based on actual accidents, but not near misses; and it would bei more ofa qualitative discussion versus a studied analysis. ITEMS Interim Director Hicks updated the Commission, and there were brief discussions, as follows: Parks and Recreation Board Signage - still coordinating on it. Sidewalk Fee-in-Lieu Ordinance. The gate can all-ready become crowded with residents trying to get into the gate. The exit would also cause concern, people leaving the neighborhood and goodwill could have blocked visions with our landscaping. This could really become a danger. The map over layl looks asi if the semi truck will also use this to exit goodwill. The median will make it difficult for al large truck to make this turn. The median would have to be torn out. This brings up the concern that we as a neighborhood, own that section of road. Itis private drive. Wel have maintained that section since development. Iwould like to see where the easements arei for bronco. The residents mail boxes also have to bet taken into consideration. At times there are many cars stopped to check mail.
