Simpson) unanimously by a vote of11-0. c) Discussion, consideration, and possible action regarding Home Rule Charter (HRC) Motion: Motion by Karlyn Keller, seconded by Cathy Enderle to approve, as presented, the meeting minutes from the Home Rule Charter Commission meeting of April 3, 2024. (E. Simpson) Motion: Motion by Ron Rhea, seconded by Danny Barringer, to approve the PowerPoint Presentation for use at the upcoming Joint meeting with City Council. This presentation will assist the Council to get up-to-speed with the activities and achievements of the Commission, at upcoming Special Joint Meeting(s) between HRC and City Council. Motion carried unanimously by a vote of11-0. e) Review, discussion and consideration and possible action regarding the proposed draft City Charter/ Working Document. (Joseph Crawford, Bryan Rivera) The Introduction, Preamble and. Articles Iand II have been reviewed and approved by the HRC Commissioners. Draft Articles III and IV with modifications) from the Commission meeting February 12, 2024, are included. The Commission will discuss, consider; and possibly take action upon Articles III and The Commissioners briefly reviewed the already 'approved' Introduction, Preamble and Articles Iand II. City Attorney Crawford and Chair Rivera noted that the Commissioners will come back and review these again before approval of the version to send forward to City Council. The original Article III was City Manager. This Article has been moved to Article V. The articles for review tonight are. Article III-Mayor and City Council. IV. Article IV Administration and Personnel. City Secretary Simpson disseminated a version of the draft of Articles III and IV with all lines numbered. The Commissioners used this version for review. (See Exhibit 'A' to these meeting There was a brief discussion of the roles oft the Mayor and the City Manager in a Home Rule minutes.) City. Changes made to version of draft 5.13.2024: Article III, page 3 of11 Line 6 -1 number of Article V was filled in next to word Elections. Lines 8-9 3.02 Mayor. This section was moved down to the enumerated powers of the Mayor. Motion #1: Motion by Karlyn Keller, seconded by Jessica Solis, to modify lines 8-9 (Section 3.02) to relocated them in the list of enumerated powers oft the Mayor. Also, they asked to add the first two lines from the applicable section of the Leander Charter to this section. The lines from the Leander Charter are: 1.) The mayor. shall serve as the ceremonial head of the city government, preside at all meetings oft the council, and provide the leadership necessary to ensure, good government. 2.). He or she. shall work closely with the council to obtain legislation in the public interest and with the city manager to ensure that the same is enforced and participate in the discussion on all legislative and other matters coming before the council. This change will modify the list ofi items sO that old #1 becomes new #3. Motion Carries unanimously 11-0. Motion #2: Motion made by Bill Brannon, seconded by Luke. Jernejcic, To modify Section 3.03- - : the Mayor and Council may (line 30 pg. 3) after 'effective' before 'until' insert 'for any position' then strike terms of Council Members elected at. and replace with 'term ofs such position after' : (this will create staggered increases in pay to begin only when # is up for regular election). The Commissioners discussed page 5 of11. Clarify Filling of Vacancies section to conform with State Law, as explained by City Attorney Crawford. Because the City of] Liberty Hill Charter will contain 3 year terms of office for Mayor and Council, there are prohibitions on filling vacancies by appointment. Unfortunately, there cannot be Vacancies filled by appointment unless there are 12 months or fewer left in the Council term. When Mayor and Council terms are extended beyond two years, the elections for these seats must be achieved by majority vote. This will necessitate more frequent run-offelections, especially when there are more than two City Attorney Crawford clarified that when a vacancy does exist, this vacant position is not Onj page 70 of11, the Commissioners were in agreement that the reference in section 3.14 Rules ofProcedure, could include, ifCouncil desired, the. Agenda setting procedures to be included in The Commissioners briefly discussed Ordinances from page 7 of11 but no motions were made. There seemed to be general agreement that one: reading of aj proposed Ordinance was sufficient, allowed under State Law. candidates. counted when determining a quorum. the Rules ofl Procedure. and two would not be needed.
