MADISON COUNTY BOARD OF ZONING APPEALS MADISON VIRGINIA 22727 The Madison County Board of Zoning Appeals met on Tuesday, May 21, 2024, at 7:00 p.m., ini the Madison County Administrative Auditorium, 414 N. Main Street in the Town of Madison, Virginia. The board members present were Chairman Coppedge, members Clatterbuck, Lillard, Lohr, and Wills, and Zoning Administrator Tracy Clatterbuck. Chairman Coppedge asked members if there were any additions or corrections to be made to the minutes from the previous meeting of February 20, 2024. Member Lillard moved to approve the minutes as submitted and Member Lohr seconded the motion. The minutes were approved by unanimous voice vote. Chairman Coppedge asked Administrator Clatterbuck to read the first item on the agenda under public hearings. a) Hugh Daniel Yowell has filed a variance application for property located at 3255 Meander Run Road, Culpeper, VA: 22701, located in Madison County in the Daniel Farm Subdivision, and further identified by taxi map number 42A-21. The property contains 0.571 acres and is zoned as Agricultural (A-1). Pursuant to Appendix 1 (Zoning), Article 4-6-1 of the Madison County Zoning Ordinance, the required minimum side setback is 251 feet. The applicant is requesting that a variance be granted to allow for an 11-foot side setback. If granted, the applicant plans on constructing an 18'x2 24'a addition onto the existing single-family dwelling. Chairman Coppedge asked the applicant to come forward to the podium. Member Lillard asked when the house was constructed, and Mr. Yowell responded in 1972. Mr. Lillard asked when the subdivision was created, and Mr. Yowell replied that het thought it was maybe the 1960's but wasn't sure. Mr. Yowell explained that there was already a patio int the existing location where he would like to add the addition. Mr. Lohr asked if the neighbors closest to the addition were aware of his plans andi if theyl had any objections. Mr. Yowell noted that it was rental property, and he was not aware if they had any concerns with his proposal. Administrator Clatterbuck stated that all adjoining property owners were notified as required by state code, and that she further noted that she had not received any comments from any of the adjoining Chairman Coppedge asked if there were anyone from the public that wanted to speak on this request, and there were none. Chairman Coppedge asked if there were any further questions from the board, andi if not, landowners. they could proceed with a vote. Ballots were completed. Administrator Clatterbuck read the ballots as follows: Lillard- Yay; Lohr- Yay; Coppedge- Yay; Wills- Yay; and Clatterbuck- Yay Variance request approved as requested 5-0. Chairman Coppedge asked Administrator Clatterbuck to read the second item on the agenda under public b) Muhammad. Abed has filed a variance application for property located at the intersection of Ford's Shop Road (Rt. 618) and Meander Run Road (Rt. 631), Culpeper, VA, located in Madison County, and further identified by tax map number 42-13C. The property contains 17,535 square feet or 0.40256 acres and is zoned as Agricultural (A-1). The property in question was established in 1958. Pursuant to Appendix 1 (Zoning), Article 4-4-1 of the Madison County Zoning Ordinance, the required minimum front setback is 501 feet. The applicant is requesting that a variance be granted to allow for a 20-foot front setback. Also, pursuant to Appendix 1 (Zoning), Article 4-6-2 of the Madison County Zoning Ordinance, the required minimum rear setback is 501 feet. The applicant is requesting that a variance be granted to allow for a 20-foot rear setback. If granted, the applicant hearings: plans on constructing a new single-family dwelling. Chairman Coppedge asked the applicant to come forward to the podium. Member Lillard asked the applicant to explain his plans for the lot. Mr. Abed detailed that he would like to build a house oni the lot. After construction, he may potentially sell the property. Member Lohr asked him if he owned the lot currently. He confirmed that he did and noted that he had paid $12,000.00 for the lot. Member Lillard and others replied and agreed that he may have paid too muchi for a non-buildable loti if the minimum setbacks, well, septic, etc. requirements cannot be met. Mr. Abed noted that he was realizing that potential now; however, he had spoken to Administrator Ligon Webb prior to submitting the variance application, and he told him that all he needed to do was submit the application and go through the process and it would be approved. Member Lillard replied that Administrator Webb was no longer employed with Madison County. Chairman Coppedge stated that he felt the proposal was too close to the roads. Member Lillard expressed his concerns that it was a very small lot. Not a part of the subdivision-likely because they knew it was an unbuildable lot. He felt that the board granting the variance request would be an extensive reduction in Chaiman Coppedge asked if there were anyone from the public that wanted to speak on this request. Mrs. Mary Banks explained that she owned the property directly beside the subject property. She is very concerned about the safety of building on this lot related to traffic and pedestrian safety. She is also concerned about the proposed well location. She explained that her husband, who has passed away now, hand dug her well, and she is afraid that Mr. Abed's well location will take away from her water supply. She doesn't understand why he must put the well right up next to the property line as proposed. She simply Member Lillard recommended that the applicant go back and review his proposed plans to see if he could be more conforming with the code requirements. He could look at relocating the well, drainfield, and/or downsizing the house. Chairman and all other members agreed. Member Lohr asked if they were to table the application, if he would be required to pay another application fee. Administrator Clatterbuck noted that ifthe application was tabled, he would not need to pay again. He would only pay again if the application was denied, and he chose to reapply with a new request. Mr. Abed requested that the board table his application to allow him time to go back to review and possibly re-design his plans. Member Lohr made that motion. The motion was seconded by Member Lillard. The motion was unanimously approved. For new business, Administrator Clatterbuck noted that she had provided al board meeting schedule for the remainder of the 2024 calendar year. All meetings will be held at 7 p.m. She stated that she would notify the board members in advance ift there was not an application for a particular month. She also welcomed Chairman Coppedge asked if there was any further business for the board. There being none, Member Lillard made a motion to adjourn the meeting. The motion was seconded by Member Lohr.
