TOWN OF NEW WINDSOR RESOLUTION NO. 07-/7-/7 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF NEW WINDSOR (the "Town") TO AUTHORIZE THE CONSUMPTION AND POSSESSION IN OPEN CONTAINERS OF ALCOHOLIC BEVERAGES ON PUBLIC PROPERTY DURING THE FOLLOWING EVENT (the "Event"): "MUSIC ON THE MAIN" October 7, 2017 SUBJECT TO THE ISSUANCE OF A SPECIAL OR TEMPORARY LIQUOR LICENSE BY THE LIQUOR BOARD OF CARROLL COUNTY (the "Liquor Board") AND TO AUTHORIZE THE MAYOR AND/OR TOWN MANAGER TO DELIVER INDEMNIFICATION TO THE STATE WITH REGARD TO THE EVENT AS NECESSARY TO PROCURE STATE APPROVAL FOR THE CLOSING AND USE OF STATE ROADS DURING THE EVENT. WHEREAS, the Town is a municipal corporation of the State of Maryland; and WHEREAS, pursuant to their authority under Article 2B (Alcoholic Beverages), Sections 19-104(b) and 19-202(a)(1) of the Annotated Code of Maryland, it is within the powers of the Mayor and Town Council to adopt a Resolution authorizing the consumption and possession in open containers of alcoholic beverages on public property within the boundaries of the Town, subject to the issuance of a special or temporary liquor license by the Liquor Board. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN consumption and possession in open containers of alcoholic beverages during the Event is hereby approved on public property within the Town in such locations as may be identified in the Town's application for a special or temporary liquor license, subject to the issuance of a special or temporary liquor license by the Liquor Board; and COUNCIL OF THE TOWN, this 17th day of Joly 2017, that the BE IT FURTHER RESOLVED that the Mayor and/or the Town Manager are hereby authorized to execute and deliver an indemnity from the Town to the State, its agencies and personnel, including but not limited to the Maryland State Highway Administration, and its employees, from and against any claim or lawsuit, arising out of or in connection with the Event as may be required to obtain State authorization for closing of any State roads during the Event and the use of such closed State roads for and during the Event, including permission for the consumption and possession in open containers of alcoholic beverages within the area of such closed State roads.
