The Town ofNew Market 1793 Town Council Minutes General Session March 19, 2024 - 7:00 p.m. 40 South Alley, New Market, MD. 21774 The Mayor and Council of the Town of New Market met in person and virtually via Zoom on Thursday, March 19, 2024, with Mayor Winslow Burhans presiding. Council members present were Dennis Kimble, Matt Chance, Chris Weatherly, and Michael Wright. Councilman Rossman was absent. Pat Faux, Zoning Administrator/Town Planner; Shawn Burnett, Town Engineer; Erica Adamski, WTB; and Steve Pippin, President, NMCP, were also in attendance. CALLTOORDER: The meeting was called to order at 7:00 p.m. CONTINUED BUSINESS Speed Camera Disbursement Policy Councilmen Chance and Weatherly presented a Draft Speed Camera Disbursement Policy. Discussion ensued, and comments were suggested. The matter continued to the agenda on April 11,2024. Public Comment: Phil Gamble Appraisal Results Councilman Chance presented a Comparative Market Analysis completed on 39 West Main Street by Val Vinson, Century 21. A more in-depth discussion is needed. Staff will research portable restroom costs to place behind Old Town Hall. Mr. Donahue reported a recent incident, which Mr. Donahue claimed involved a purported burglary at a local business and residence. He was concerned about photos posted on social media by the owner. These photos showed suspects which Mr. Donahue claimed were juveniles insidea competing business where the name and logo were visible. Councilman Wright suggested tor recognize the complaint in town records and inquired whether that would be acceptable as formal to Mr. Donahue. Public Comment: Walter Olson, Brooke Donahue NEW BUSINESS Request for Town Project - Book Exchange/Library - NMES Girl Scout Troop Subject matter was removed from the agenda at the request oft the presenters. Leaders on Loan - Frederick County Board ofTourism Councilman Wright introduced Dave Ziedelis from Visit Frederick. Mr. Ziedelis explained the Leadership on Loan program and how it could help the Town of] New Market. Shentel POP Site Request for Zoning Text Amendment Staff received a request from the internet provider, Shentel, for permits to build an unoccupied public utility facility on the New Market District Volunteer Fire and Rescue Company property on the current station training area site next to Town Hall. The Shentel team has been notified that a zoning text amendment would be required to allow this land use in the Residential Merchant District. Currently, the Town code only permits this use in the Mixed Commercial/Indugfial Zoning category. Nol land in Town is presently in the MCI zoning category. A public hearing will be set before the Planning and Zoning Commission and Town Council. There was unanimous consent to move forward on a principal permitted use for this type of project, given that we could put some parameters on: it SO that it didn't have unintended consequences ofending up in a place where they might not want it. Future Updates to FCO Erica Adamski and Shawn Burnett provided an update on the Forest Conservation Ordinance. (FCO). The General Assembly updated Maryland's Forest Conservation Act (FCA) and the Governor's action last year, and new provisions are expected to take effect July 1, 2024. Town Staffi is working with DNR to determine the extent of these changes and what they will mean for the Town of New Market's FCO. Messannelle Park Recommendations Pat Faux and Chris Goettge recommended improving Messanelle Park and establishing a water source. Council, by unanimous consent, authorized staff 1) to take the necessary steps to prepare an easement for Council approval for the neighboring property's water service, obtain public water service, and have improvements installed at the park, and 2) amend the Town's current landscape maintenance contract to include additional ongoing and one-time tasks needed at the park, including watering until aj new water source is established. Town Staffing Space Planning Today, the Town has aj population of about 1,650 people. Based on current development approvals, there will be about 2,378 people in five years, 3,900 in ten years, and 5,000 in sixteen years. This growth is consistent with the Town's comprehensive plan vision and is part ofthe community plan toe ensure the Town's financial viability and Main Street districtseconomic vitality. In preparation, staff will ask that the Council approve plans for Town facility improvements and staff capacity increases SO that we are ready to serve changing community needs when they occur. Staffadvises An additional clerk to assist the Town Clerk was approved int thel FY241 budget. Int thel FY25 budget, we are also proposing the addition of a handyperson to meet the growing need for maintenance and public works support. These tasks are becoming too heavy a burden for council members and other volunteers. The staffhas been working together on newj job descriptions for new and current staff to ensure that tasks are shared efficiently as we grow. Based on this overall review and the growing workload, we are requesting an increase in thel hours for our current part-time staffand to offer benefits to full-time staff. We are also proposing that the next Main Street Program Manager be full-time. Our recommended scope of work for the next program manager is intended to fit within our review of the overall tasks that need tol be done. Should the Council wish to change the proposed role, we will also ask that other staffing for those duties be considered. Regarding space planning, we will request funds for new file cabinets, furniture, and a partial partition wall upstairs. This wall will convert the open meeting space upstairs into two office P&Z Questions about Pavilion re: handrails at steps, parking, traffic impact of Pavilion Councilman Chance reported that at the March 7, 2024, Planning and Zoning meeting, staff presented final Improvement Plans for the Open-Air Pavilion at the Community Park. After the staff presentation, the Commission voted to table the matter to get answers to their questions. Staff prepared a response to the questions raised by the Commission by way ofa Staff Report that we are already understaffed compared to other the Towns our size. spaces. dated March 12, 2024 (copy attached).
