The meeting was called to order at 9:10 a.m. APPROVAL OF MINUTES Commissioner Bailey moved, seconded by Commissioner Thompson, to approve the minutes of the Commissioners* meeting of Tuesday, January 23, 1990. Motion carried. The Planning and Zoning portion will be approved at next week's meeting. APPROVAL OF BILLS Commissioner Bailey moved, seconded by Commissioner Thompson, to approve payment of the bills as presented. Motion carried. COUNTY ADMINISTRATOR ITEMS 1) PUBLIC MEETING ECONOMIC PROFILE The County Administrator suggested that the Commissioners conduct a public meeting on the County's economic profile and economic condition relative to preparation of the FY '91 Budget. The suggested meeting date is February 27, 7:30 p.m., at Leonardtown Middle School. The Commissioners gave their concurrence. 2) ST. MARY'S COLLEGE 150TH ANNIVERSARY The County Administrator advised that the Chamber of Commerce has proposed that the Chamber and Board of County Commissioners co-sponsor a reception in honor of St. Mary's College's 150th Anniversary on the evening of April 25. The Commissioners gave their concurrence. 3) BOARDS, COMMITTEES, COMMISSIONS Community College Advisory Board William R. Motion carried. 4) BUDGET AMENDMENTS The County Administrator presented the following budget amendments recommended for approval by the Director of Finance: 90-32 County Administrator Justification: To provide funds for the continuation of contract services for Public Information Specialist through June 30, 1990. 90-33 Office of Planning and Zoning Justification: To purchase BOCA Code books due to adoption of Building Code. 90-34 Office of Planning and Zoning Justification: To provide funding because of extensive advertising for public hearings for rezonings, building code, critical areas, etc. 90-35 County Commissioners Justification: To pay for upgrading of PA system in Commissioners' Conference Room. 90-36 Public Works/Board of Education Justification: To provide funding to match 50% of grant for detention center using funds not used for relocatable classrooms. Commissioner Bailey. moved, seconded by Commissioner Thompson, to approve and authorize Commissioner Loffler to sign the Budget Amendments as presented. Motion carried. January 30, 1990 Page 35 5) FOOD COMMODITIES DISTRIBUTION The County Administrator presented correspondence dated January 22 from the Department of Human Resources amending the October 1, 1989 Agreement for the distribution of food commodities and funds to pay for food storage, handling and distribution. The amendment authorizes quarterly advance to pay approve. and authorize Commissioner Loffler to sign the Amendment to the for allowable expenses under the Agreement. Agreement as presented. Commissioner Thompson moved, seconded by Commissioner Bailey, to 6) EASTERN BYPASS The County Administrator advised that correspondence was received from the Chairman of the Eastern Bypass Task Force requesting St. Mary's County's comments on the Eastern Bypass for the Washington D. C. Beltway. He, therefore, presented a response indicating that the County has not taken a position 0 this matter and further stating that the outer beltway represents as much a future Tand issue as it. does a transportation issue. The Commissioners agreed to sign and forward the letter. 7) PUBLIC MEETING MARINA ON-SITE SEWAGE DISPOSAL The County Administrator presented correspondence which will be forwarded to marina operators throughout the County informing them of a public meeting to beheld on February 20 at Leonardtown Middle School to discuss requirements for pump-out facilities at marina on-site sewage disposal and state funding to assist in establishing an on-site system. The Commissioners agreed to sign and distribute the letter. 8) ETHICS ORDINANCE PRESENTATIONS The County Administrator advised that since 1982 St. Mary's County has had an Ethics Ordinance patterned after the State's Ordinance. He stated that county employees may not be familiar with the Ordinance, and therefore, recommended that he and County Attorney Joseph Densford conduct a series of presentations to each department. The Commissioners gave their concurrence. 9) LIONS CLUB - ANNUAL CRAB FEAST The County Administrator presented correspondence from the Leonardtown Commissioner Bailey moved, seconded by Commissioner Thompson, to grant Lions Club requesting use of the Governmental Center grounds on June 9 and 10 for the Fifth Annual Crab Festival to be held Sunday, June 10. this request. Motion carried. 10) PERSONNEL STATE OFFICE BUILDING The County Administrator presented a memorandum dated January 24, 1990 from the Personnel Office advising that the Director of Finance has requested two new positions to support the new state office building. Positions will be fully funded by revenues received from the State. Positions are Driver Clerk, authorize the filling of the positions as requested. Motion carried. Commissioner Thompson moved, seconded by Commissioner Bailey, to January 30, 1990 Page 36 11) TEMPORARY PROMOTION REQUESTS The County Administrator presented the following requests for temporary promotions: Office on Aging Transportation Manager Memorandum dated January 23, 1990 from Director of Office on Aging requesting temporary promotion of Fran Hammett to serve as Acting Transportation Manager during the absence of Farrar Lucas because of serious illness. ProcuremĂȘnt Office Buyer Memorandum dated January 29, 1990 from Personnel Office requesting the temporary promotion of Maureen G. McFadden from Procurement Clerk, Grade 13, to Buyer, Grade 17, until a replacement for the current buyer who resigned is hired. Commissioner Jarboe moved, seconded by Commissioner Bailey, to approve The County Administrator advised that there will be a Cycle Across the temporary promotions as requested. Motion carried. 12) CYCLE ACROSS MARYLAND Maryland August 4 - 11, and the Leonardtown Rotary is coordinating St. Mary's County's portion of this non-competitive bike tour. The terminus for the event will be St. Mary's County, and a summer fesitval is being planned in St. Mary's City. Civic organizations will be involved. Mr. Cox, therefore, requested the the Cycle Across Maryland project for St. Mary's County. Motion carried. Commissioners' endorsement of this project. SOUTHERN MARYLAND WOOD TREATING PLANT Commissioner Bailey moved, seconded by Commissioner Jarboe, to endorse Present: Tom Oliver, Director, Emergency Management Agency Mr. 0liver appeared before the Commissioners to advise that the Army Corps of Engineers has awarded a contract to Weston Services, Inc. for Phase I of the containment of contamination at the Southern Maryland Wood Treating Plant. He stated that the containment is scheduled to begin the first week of February and will last about four to six months. Phase II will be the actual clean up; which will be a separate contract through the Environmental Protection requested that the issue be thoroughly discussed prior to it actually taking fire departments and rescue squads to brief them on the project and to allow them to be prepared if necessary. He further stated that he will keep the Agency and' will include an on-site incinerator. Commissioner Loffler raised concerns regarding an incinerator and In conclusion Mr. 0liver advised that there will be a meeting of Tocal place. Commissioners informed as to what is occurring at the site. EXECUTIVE SESSION Present: Edward V. January 30, 1990 Page 37 OFFICE OF PLANNING & ZONING Present: Deputy Director Vivian Marsh Peggy Childs, Recording Secretary. STSP #86-1053 - LOFFLER INDUSTRIAL TWO Requesting site plan approval for an industrial storage building of 7,000 sq. ft. in Phase I and 1,750 sq. ft. in Phase II on 1.38 acres, zoned I-1, located on Airport View Drive in St. Mary's Industrial Park; shown on Tax Map 34, Block 2, Parcel 550, Lot 2, Section 2. Owner/Applicant: Loffler Industrial One - Partnership Present: Mark Kanowicz for Loffler Construction Mr. Marsh stated this site plan has been before the Planning Commission, who recommended approval pending final approval of all TEC agencies. The only approval outstanding is DPW's, who have indicated verbally that it meets their requirements. There are no sanitary facilities in the building; if they are required in the future Health Department approval will have to be have septic systems. Mr. Kanowicz replied that the building is only for storage of building material for construction projects. Commissioner Jarboe asked what would happen if in the future the building were converted to a different use? Mr. Marsh stated if they were going to have people in the building they would have to have approval and would have to install a septic system - the building and Mr. Marsh said the applicant is supposed to come in and get a Use and Occupancy Permit. Commissioner Bailey pointed out MetComm's statement that central sewerage will be available in approximately two years and the applicant recommended by staff and the Planning Commission. Commissioner Jarboe seconded providing everyone understands that if the use should change sewerage will be required, as he said that condition applies to everything in the County. Motion obtained. Staff recommends approval. Commissioner Jarboe asked how many others in the County don't have to could not be used for anything that had people in it. Commissioner Jarboe asked how we would know whether it had changed, will be required to hook up at that time. Commissioner Bailey moved to approve the site plan as presented and as carried. CAPITAL BUDGET REVIEW FISCAL YEAR 1991 Present: Charles Wade, Director of Finance Relative to the FY '91 Capital Budget, Mr. Wade appeared before the Commissioners to present information including Capital Budget Requests for Public Works, Board of Education, Recreation and Parks, and Wicomico Shores; Decisions Required by the Board, capital Budget Recommendations, and Funding Recommendations. Mr. Wade noted that if the State does not provide funding assistance for Dynard School, funds will have to come from the transfer tax and from bond sale proceeds. Mr. Cox pointed out that if the County does not get the authority for a transfer tax from the General Assembly, the Commissioners will have to revisit the impact. fee.
