Public Hearing - Application for a special use permit, pursuant to Section 15-9 Utilization ofthe flood hazard district ofthe Town of Abingdon Zoning Ordinance, proposed construction in the flood hazard district, currently zoned R-1 Residential District, located at 285 Bogey Drive, Tax Map #105A-7-67. - Jason Boswell, Jason Boswell, Director of Community Development, presented that a special use permit was submitted by Kai Tang, 285 Bogey Drive to construct a carport within the AE Floodway Fringe District. Mr. Boswell stated that thel Planning Commission voted 6-1 to approve the special use permit with the contingency that the development was in compliance with the established restrictive covenants. Mr. Boswell stated that the staff informed the Planning Commission that the Town has no purview over private restrictive covenants and thus no enforcement authority. Director ofCommunity. Development (VIDEO 40:56- 46:54) Jason Boswell, Director of Community Development, stated that Council requested that this matter be referred to the Planning Commission for consideration to rezone Tax Map Parcel 020-11-1 from R3, Residential to OI, Office and Institutional District tol be consistent with adjacent property, existing use and character of the property, the Comprehensive Plan, the suitability of property for various uses, and the trends of growth or change.
