Tom Cosgrove, presented awards to the following: Equestrian Award to Charros Guadalupanos, Best Float to Beach Hut Deli, Best Vehicle was a tie between San Francisco Bay Gourmet Coffee and Sierra Pacific Industries, Best' Walking / Marching to Nash Twirl Academy, Best Novelty to California International Llama Association and the Chuck Wing Award to Lincoln High School Band. All but the Lincoln High School Band and San Francisco Bay Gourmet Coffee were in attendance to receive their awards. 9. CONSENT AGENDA Mayor Short announced Item 91, CalPERS Contract Amendment, had been pulled from the Consent Agenda and moved to General Business. Lincoln Resident, Byron Chapman, requested Item 9K, Medical Marijuana, also be pulled from the Consent Agenda for discussion. Councilman Gilbert motioned and Councilman Nader seconded to approve the balance of the Consent Agenda - Unanimously Approved. Those items approved were: A. McBean Park Drive Bridge Project Contract Amendment for Engineering Design Services Adopt Resolution 2016-149 authorizing the City Manager to execute Amendment No. 2 to the Professional Services Agreement with Quincy Engineering, Inc. for engineering design services to extend the term of service to August 31,2018. Items pulled from the Consent Agenda for discussion: K. Medical Marijuana - Second reading and adoption of Ordinance 914B repealing and reenacting Article IV, Section 18.34.120, et. seq. of Title 18 of the Lincoln Municipal Code to prohibit medical marijuana dispensaries and the delivery of medical marijuana within City limits and finding the project is exempt from the California Environmental Quality Act (CEQA) under Sections Byron Chapman, a Lincoln resident, stated he pulled this item from consent to make everyone aware that federal law trumps state and local law and thanked the Council for following the federal law. Mr. Chapman continued he is an advocate for Americans with Disabilities Act and hopes the Council is consistent and follows this federal law as they are with the marijuana issue. Councilman Gilbert motioned and Councilman Joiner seconded to adopt Ordinance 914B repealing and reenacting Article IV, Section 18.34.120, et. seq. of Title 18 of the Lincoln Municipal Code to prohibit 15060(c)2)(3); 15061(b)(3); 15064(d)(3); and, 15378(a). 600 Sisth Strect I Lincoln. PUBLIC HEARINGS A. Utility Billing Adjustment Ordinance - Staff recommends City Council conduct a public hearing, accept public testimony and Introduce and waive first reading of Ordinance 917B amending Chapter 13.04 of the Lincoln Municipal Code relating to utility billing adjustments. Steve Ambrose, Support Services Director, gave a brief powerpoint presentation and stated the Council could adopt Ordinance 917B with one of the following three options: an adjustment of 50%, only Tier 5 charges would be adjusted or an adjustment of 25% with a brief Council discussion ensued. Mayor Short asked for a clarification of how many full-time employees were currently working on water conservation and whether the water loss from a leak could be considered a system loss. Mayor Short opened the public hearing at 6:55PM with the following comment: Byron Chapman, a Lincoln resident, questioned whether a water leak would be considered a non-beneficial use and urged the City to educate the public to contact the City as soon as possible to Mayor Short closed the public hearing at 6:59PM with another brief Council discussion. Mayor Short directed staff to survey other utility companies besides Placer County Water Agency (PCWA) and research further if this adjustment could be charged to another fund rather than the General Fund and include this research in the staff report for the second read of the ordinance. Councilman Gilbert motioned to adopt Ordinance 917B, Councilman Nader asked for clarification on which option and Councilman Gilbert stated the 50% adjustment option but asked staff to bring additional research back for second reading. GENERAL BUSINESS A. Sustainable Ground Water Act (SGA) Governance Councilman Nader stated he had requested this item be on the agenda to discuss three issues in relation to the May 3, 2016 Council work session discussion on sustainable groundwater act (SGA) governance: (1) whether the Council directed staff to proceed with a Memorandum of Agreement (MOA) or a. Joint Power Agreement (JPA); (2) governance; and (3) how Council gives direction to staff. Councilman Nader continued he was concerned and suggested a JPA, a governance body be established and that any direction given at a Council work session be brought to Council at the following regularly scheduled meeting for formal action. A lengthy Council discussion ensued on these three issues and whether the City could start with a MOA and transition into a JPA with Council consensus for Leslie Walker, City Attorney, to do further research on this question as well 600 Sith Strcet - Lincoln. A brief discussion ensued on governance with Mayor Short stating he would send a letter to surrounding jurisdictions and water districts to try to set up meetings to discuss governance. The last issue of Council direction to staff was raised when Leslie Walker, City Attorney, stated this issue was not agendized and suggested it be brought to the August 9, 2016 meeting for further discussion. INFORMATION ITEMS Bridge Replacement Project. A. McBean Park Bridge Presentation - Following a short presentation, staff is requesting that City Council provide feedback on three aesthetic design alternatives for the McBean Bridge Drive Roland Neufeld, Associate Civil Engineer, presented a powerpoint presentation with three design options art deco, local heritage and naturalistic with a brief Council discussion on golf carts in Downtown area and aspects of each design option. 13. COUNCIL INITIATED BUSINESS Councilman Gilbert suggested the November 8, 2016 be rescheduled as it was a presidential election day with a brief discussion on only having one meeting in November with Council consensus to have the November 1, 2016 work session meeting, cancel the November 8, 2016 Councilman Nader stated Affordable Housing was discussed back in February, 2016 at the work session meeting and requested staff bring this topic back to Council at a future work session. regular meeting and hold a special meeting on November 15, 2016. 600 Sisth Strect * Lincoln. Brent Craft, Interim Police Chief, stated he would be attending as well as two volunteer officers but the department is extremely short staffed and couldn't guarantee an officer at all events. Abrief Council discussion ensued with Council consensus approving overtime to ensure an officer attending with Brent Craft stating there were only four officers available and if someone was sick he would be limited even further. 14. COUNCIL COMMITTEE REPORTS Councilman Nader reported he had attended an Airport Committee meeting where lease options were discussed and requested the minutes from this meeting be posted on the City's website. Councilman Nader continued he also attended Operation Make a Difference regarding the homeless issue and another meeting with Matt Brower, the City Manager, Scott Leaman, Western Placer Unified School District (WPUSD) Superintendent, and Roger Ueltzen in relation toj joint use agreements between the City and WPUSD to create a shared vision statement. Councilman Gilbert reported he attended the Economic Development Committee where Mike Miller was appointed as Chairman and they received a presentation from Printrbot, Inc and that he had also attended the Placer Mosquito and Vector Control District meeting where assessment and Councilman Joiner reported he had attended a Western Placer' Waste Management Association meeting where subsurface oxidation and landfill gas collection system were discussed and that he had also attended the Placer County Economic Development Committee where food & agricultural Mayor Short stated he had attended the Regional Water Authority (RWA) board meeting where other post-employment benefits and investments were discussed as well as the RWA 15-year spraying were discussed. clusters were discussed. anniversary event. 15.
