Life Upcoln MINUTES CITY OF LINCOLN CITY COUNCIL & LINCOLN REDEVELOPMENT SUCCESSOR AGENCY SPECIAL MEETING MINUTES Council Work Session March7,2017 4:00PM - 6:00PM -First Floor Conference Room Mayor Gilbert called the meeting to order at 4:05PM. 1. ROLL CALL Councilmen present: Mayor: Councilmen absent: Staff members present: Gabriel Hydrick Dan Karleskint Peter Gilbert Paul Joiner Stan Nader Matt Brower, City Manager Leslie Walker, City Attorney Steve Ambrose, Support Services Director Doug Lee, Police Chief Ray Leftwich, City Engineer Gwen Scanlon, City Clerk Matt Wheeler, Community Development Director Various City employees, consultants and members of the public were also present. 2. PLEDGE OF ALLEGIANCE led by Support Services Director Steve Ambrose. 3. PUBLIC COMMENT a) Bruce Castle, al Lincoln resident, requested the City connect the bike trails underneath the Bypass and distributed a document entitled "Connect Lincoln Again" to Council, made a part of these minutes by mention thereof. 4. STAFF REPORT 4.A. TIME CERTAIN END TIME FOR CLOSED SESSIONS Gwen Scanlon, City Clerk, requested Council consensus on having a time certain end time of 5:50PM when open session immediately follows closed session. Al brief discussion ensued regarding noticing requirements and Council imposing end time on themselves with Council Leslie Walker, City Attorney, gave a brief staff report regarding options before the City to ban, allow or regulate outdoor growth of marijuana and marijuana dispensaries. Mayor Gilbert opened the discussion to the public at 4:12PM with the following comments: a) Casey Brown, Board Chair of Placer County Growers Association, requested the City have a special tax on medical marijuana and allow safe access for Lincoln residents. Matt Brower, City Manager, requested speaker's name as he did noti initially provide. b) Rich Miller, Director of Education and Outreach at a Therapeutic Alternative, also requested safe affordable access to marijuana for Lincoln residents and stated if banned it would promote c) Byron Chapman, a Lincoln resident, stated speakers are not required to give their names under the Brown Act. He also questioned how the City would be able to inspect residences to ensure they are only growing six plants and raised question of detached garages and whether d) Sam Burns, Board member of Placer County Growers Association and Auburn Attorney, urged the Council to consider special taxes or operating fees to allow safe, reasonable access unanimous consensus to impose time certain end time. 4.B. Mayor Gilbert reopened the public discussion at 4:54PM with the following a) Don Morris, a Lincoln resident and Veteran, questioned how many Lincoln residents had b) Casey Brown, Board Chair of Placer County Growers Association, argued in favor of allowing marijuana and stated there are more supporters in the audience today than opposers and asked c) Rich Miller, Director of Education and Outreach at a Therapeutic Alternative, stated no one applied for a permit to grow marijuana because the permit was processed in the Police Department rather than a zoning permit obtained from the Planning Department and urged the d) Sam Burns, Board member of Placer County Growers Association and Auburn Attorney, encouraged the Council to consider a special tax or permitting fee on marijuana as a way to e) Robert Banka, did not state his residence or affiliation, stated there was no one in attendance Mayor Gilbert closed the public discussion and Leslie Walker, City Attorney, stated she would include prior ordinances when this item was brought forward to a future Council meeting for action and she had received direction from Council to move forward with ban on marijuanal Doug Lee, Police Chief, gave a brief staff report and a Council discussion ensued on the difference between current law and this ordinance. Councilman Hydrick stated he was not in favor because this is using public policy as a preventative measure. Councilman Karleskint also requested a survey be done to see how much support there was fori this item and include the survey methodology. Mayor Gilbert opened the discussion to the public at 5:22PM with the a) Robert Banka, did not state his residence or affiliation, compared the social hosting ordinance to military action toward young airman being held accountable for their actions. b) Byron Chapman, al Lincoln resident, stated there is no substitute for good parenting and Mayor Gilbert closed the public discussion and requested staff gather additional information to prove/disprove the ordinance and bring back when all Council was present. Councilman Hydrick responded to Bruce Castle's remarks regarding bikeway connectivity and said that the Moore Road connection is in the Master Bikeway Plan. This construction resulted in Moore Road no longer being connected in this This meant that the residential areas on both sides of the future Bypass were no longer directly connected by car, by walking, or by bicycling. One had to go south toward Ferrari Ranch Road This change resulted in some interference with the relationships that the residents had built up over time. In addition, to get to the downtown part of Lincoln, a much longer route had to be lam recommending that the Lincoln City Council and the Planning Department seriously consider modifying the Master Plan for Pedestrian/Bircycling (this is my name for this document) to include a pathway for pedestrians and bicyclists to connect both ends of Moore Road by lwould further recommend that a specific timeline be determined for implementing this pedestrian/bicycle route (path) - -t to be implemented sooner rather than later - - to make ita a Ihave included several photos of this area to put my recommendation into perspective and Your serious consideration of my recommendation is requested.
