Mayor Nader opened the a) Jessica Armistead, a Sheridan resident and Lincoln High School agriculture instructor and Advisor for Future Farmers of America (FFA)/4H (Head, Heart, Hands & Health Youth Organization), stated she was speaking on behalf of her students and thanked the Mayor for allowing her more than three minutes to make her comments. Ms. Armistead stated the requirements that her students must follow to have a project animal and that she was concerned about students needing to gain neighbors' permission prior to raising an animal, the 20' setback and noise restrictions and concluded by urging the Council to adopt a more effective code enforcement process in regards to b) Russ Snyder, a Lincoln resident, encouraged the Council to review state government code as well as surrounding jurisdictions in regards to small animals and encouraged a greater consideration to allow small animals in newly annexed areas. Bruce Cline, Interim City Attorney, stated the public hearing had been opened and closed at the December 5, 2017 Special Meeting when the item had been noticed as a public hearing. Mr. Cline continued the item was agendized on the December 12, 2017 meeting as a continuation of a public hearing item' and staff and consultants may not bei in attendance that were at the prior meeting as well as members of the public who may not have come back which could be a due process concern. Mr. Cline concluded by stating the Brown Act allows the public to comment on any item before Council but there is no obligation to allow public comment as the public already had that opportunity and if the Mayor did allow at this meeting it may create confusion as to whether comments were public hearing comments or just additional comments. Al brief Council discussion ensued regarding whether to allow public to comment at this meeting and Council consensus to allow public comment. Mayor Nader opened the discussion to the public at 7:48PM with the following comments: a) Trudi Nielson, a Lincoln resident, stated her concern with proper public safety and referenced a June Fox 40 news article. Ms. Nielson stated her family has owned their property for five generations and expressed concern with eminent domain and encouraged Council to delay the b) Gene Thorpe, a Lincoln resident, stated he is a neighbor of the Scheibers and shares their concern c) Gina Rockwell Morse, al Lincoln resident, stated her concern with water ingresslegress and d) Greg Rizzi, a Lincoln resident, stated his concern with the Village 5 agricultural overlay and whether it was inj perpetuity or a specific time and asked if those property owners whose land was designated Village 5 Open Space would be compensated and requested the east side of Nelson e) Susan Weckter, a Placer County resident, stated her concern that the Placer County Conservation Plan had not been issued yet for public review and this document would define the uses of Village 5. Item 4- Compensation for Open Space The Village 5 Specific Plan includes a requirement that any property owner or developer looking to develop a portion of the project area must enter into a Development Agreement (D.A.) with the City of Lincoln. The proposed D.A. with Richland Communities (current applicant) contains a provision related to a parks, trails, and open space fee program to address reimbursement for projects where the specific portion of land does not provide sufficient parks, trails, and open space through improvements and land dedication or some other form of reservation acceptable to the City. The DA provides that an in-lieu fee that may be used to reimburse those projects within the plan area that provide land in excess of their development requirement. The specific language of the parks, trails, and open space may be found on Page 34 of the Development Agreement as Section 4.7 (e) and as follows: 4.7(e): Excess Dedication of Parks, Trails and Open Space Areas. City agrees that to the extent Richland's Project is providing more than its required share of Parks, Trails and Open Space areas in the Village 5 Specific Plan Area, and the Parks, Trails and Open Space areas provide a benefit to other landowners within the Village 5 Specific Plan Area, City shall create, adopt and implement a reimbursement mechanism for such excess dedication of Parks, Trails and Open Space areas as part of the Village 5 Plan Area Fee and require Third Party Landowners in the V5 Specific Plan Area to participate in such reimbursement mechanism by way of a fee district and payment of a fee as set forth below in Article 6ofti this Agreement. Therefore, any property owner, and/or developer bringing forward a project within the Village 5 Specific Plan area will be required to enter into a Development Agreement, and said agreement could also include the Parks, Trails, and Open Space Fee Program requirement. Item 5- Open Space Maintenance Funding Public Open Space in the Village 5 Specific Plan Area may be dedicated in several forms, including: conservatonMingation land dedicated to the City Active or passive park lands (and trails) dedicated to the City Land granted to a Conservator (such as Wildlife Heritage Foundation) Land granted to the Placer County Conservation Plan (PCCP) Privately held land with a Public Access Easement recorded on the property For lands dedicated to the City (ownership or easement), maintenance and monitoring of those lands will be funded by a Community Facilities District (CFD). The City requires establishment of the funding mechanism (CFD) prior to acceptance of the property and/or improvements. While timing or phasing of the Village 5 Specific Plan Area annexation is an option to delay annexation of this property, ultimately this property will need to be annexed into the City in order for the City to grow as projected in the City's General Plan. Recommendations Based on the information provided in this memorandum, staff is confident that the remaining questions and discussion items have been adequately addressed for the Village 5 Specific Plan, EIR, and associated documents. Staff, consultants and the development team are ready to present this additional information for your consideration at the December 12th, 2017 City Council Meeting and answer questions of the Councilmembers. Staff continues to recommend Council take the remaining six recommended actions listed on the Continued Item Staff Report necessary to approve the Village 5 Specific Plan project.
