CITIZENS ADDRESSING COUNCIL a) Travis Mickel, a Lincoln resident, stated he wanted to speak regarding the City's unbilled water use and thanked Mayor Nader and Jennifer Hanson, Public Services Director, for bringing awareness but was disappointed ini the leadership in the rest of City Council and Staff. Mr. Mickel read from the Meyers and Nave investigative report and questioned what else the b) Ted Jones, a Lincoln resident and a LIFT member (LIFT is a group unified to lifting Lincoln to new heights through Integrity, Financial responsibility and total Transparency), also referenced the Meyers Nave report and stated he had one word for it racketeering' and questioned when the games would end and City Manager Matt Brower would give the Council accurate c) Dan Catania, a Lincoln resident, thanked the City Council for their opposition to Senate Bill 54, Sanctuary State, and urged the Council toj join in the federal lawsuit against California. d) Phyllis Wing, a Lincoln resident, requested the Council to join in the federal lawsuit against residents weren't aware of. information. Mayor Nader asked Staff to respond to public comments. Matt Brower, City Manager, stated he would meet with Mr. Mickel and Mr. Jones. Kristine Mollenkopf, City Attorney, gave a brief verbal report based on her review of the Public. Access to Court Electronic Records (PACER) website. Ms. Mollenkopf stated the Council has two options: intervention (joining the case as a party, which is usually reserved for agencies who suffered damages) or filing an amicus brief (not joining the case but filing related to discrete issues the against California. City of Lincoln Police Officers face). 8. COUNCIL INITIATED BUSINESS Mayor Nader asked if there was Council consensus to bring the SB54 Lawsuit back on the next Council agenda and encouraged all in attendance for this issue to also go to the Placer County Board of Supervisors as they have a detention facility and may have more cause toj join the lawsuit. Councilman Karleskint suggested the issue not be brought back until the Court indicates it will entertain briefs and received Council consensus. 9. PRESENTATIONS 9.A. Proclamation 2018-04 declaring May 13-19, 2018 as Police Week and May 15, 2018 as Peace 9.B. Proclamation 2018-05 recognizing May 3, 2018, as Big Day of Giving in the City of Lincoln. Councilman Gilbert motioned and Councilman Karleskint seconded the motion to approve Proclamations Mayor Nader read Proclamation 2018-04 and Retired Police Chief Richard Moore and Police Chief Doug Lee presented the Council with 2018 California Peace Officer Memorial pins and gave a few brief comments. Mayor Nader read Proclamation 2018-05 and Priscilla Enriquez, Sacramento Region Community Foundation, Janet Voris, Placer Land Trust, and Joy Smith, Field Haven Feline Center, gave at few brief Officers' Memorial Dayi in the City of Lincoln. 2018-04 and 2018-05, Unanimously. Approved by Council. comments and encouraged everyone to participate in the Big Day of Giving. 10. CONSENT Mayor Nader asked Council and public if they would like to remove any items from the Consent Agenda for discussion and Items 10B and 10C were removed. Execute Contract for Construction for Nicolaus Road Street Lighting Project Adopt RESOLUTION 2018-82 authorizing the City Manager to execute a contract for construction with Crosspoint General Engineering int the amount of $155,685 funded from the Foskett Ranch Assessment District, and authorizing the City Engineer to approve change orders not to exceed $16,000 fori the Long Range Property Management Plan. Nicolaus Road Street Lighting Project. ITEMS PULLED FROM CONSENT 10.B. Warrants. Byron Chapman, al Lincoln resident, stated he pulled this item from the consent agenda because he had three questions. Mr. Chapman questioned check #99770 (Pez Enterprises Inc. plumbing services at McBean Park), check #99836 (Placer County Executive Office capital facility fees) and check #99852 (Salaber Associates Inc. Ridgecrest Drive Improvements). Jennifer Hanson, Public Services Director, stated the City did not employ a plumber and the Pez services were related to the installation of restrooms at McBean Park Stadium. Steve Ambrose, Support Services Director, stated the Placer County Facility fees are pass-thru fees collected at building permit issuance. Ray Leftwich, City Engineer, stated the Salaber Associates check was for construction inspection services related to Ridgecrest, Village 11 Motion to Approve this item moved by Councilman Gilbert and the motion was seconded by Councilman Joiner. Agreement to Assume Medelect, Inc.'s Liability. Ted Jones, a Lincoln resident and a LIFT member (LIFT is a group unified to lifting Lincoln to new heights through Integrity, Financial responsibility and total Transparency), stated he pulled this item from the consent agenda because LIFT was concerned with the games being played by Staff. Mr. Jones continued Mr. Sisneroz had spoken out in favor of Matt Brower, City Manager, and LIFT's concern was that the liability was set aside by Mr. Brower. Mr. Leftwich continued that Council could approve the second reading and adopt the ordinance or could reintroduce Ordinance 965B with the reduction in speed on Sorrento Parkway.
