FLAG SALUTE led by Mayor Paul Joiner. PUBLIC COMMENT ON NON-AGENDA ITEMS - none. STAFF REPORT 4.A. Placer County Conservation Plan (PCCP) presentation and discussion. Gregg McKenzie, Placer County Conservation Plan Administrator, gave a brief report and powerpoint presentation. A lengthy City Council discussion ensued regarding: Army Corps of Engineers (ACOE) 5-year permit and what happens at expiration; 2020 deadline for PCCP to be used as a mitigation plan for State Water Resources Control Board (SWRCB) new definition of wetlands; PCCP public comment period, meetings and how to submit comments; integrated preserve map and coordinating with the City's General Plan; costs of the PCCP and nexus study for fees; and approval process and formation of a joint powers authority (JPA). Mayor Joiner opened a) Jeff Short, North State Building Industry Association (BIA) Legislative Advocate, stated b) George Kammerer, Land Use Attorney representing City of Lincoln General Plan Village 3 landowners, stated his clients submitted a comment letter to Placer County with their support of the PCCP and distributed a letter, made a part of these minutes by mention thereof. Mayor Joiner closed the public discussion at 5:52PM with no further comments. Another brief City Council discussion ensued regarding PCCP Ad Hoc & Biological Working Group meetings; Protect Rural Placer comments and upcoming meetings including an August 15, 2019 Open House at the discussion to the public at 5:49PM with the following comments: the BIA is supportive of the PCCP asi it is a good step fori future homebuyers. Lincoln's City Hall. 4.B. Lincoln Resource Center presentation and discussion. Kristine Mollenkopf, City Attorney, and Placer County Probation employees, Aaron Johnson and James Corry, all three are members oft the Homeless Task Force who gave a brief report and powerpoint presentation about a proposed Lincoln Resource Center at a City-owned property on First Street. A brief City Council discussion ensued regarding the increase in homeless in the City and possible reasons why. Mona Bass, another member of the Homeless Task Force, detailed the Adopt a Creek' program and detailed the success they had near Auburn Ravine. Nathan Cox, Gathering Inn, also commented on resources needed and his support for a central location for Lincoln Resource Center. Mayor Joiner asked if there was consensus to direct staff to move forward with using the First Street property as a Resource Center and received unanimous approval from City Council. Mayor Joiner suggested Staff contact surrounding homeowners to notify them of planned Resource Center and Ms. Mollenkopf stated she would take care of that as she lives nearby and is supportive of the project. Mayor Joiner opened Mayor Joiner and Councimember Gilbert exited the room at 6:50PM. Mayor Joiner returns at 4.C. Allow for al brief presentation on the Draft Nexus Study for the Water Connection Charge and discussion on alternatives moving forward with regards tot fund balance within the Water Ray Leftwich, Public Works Director/ City Engineer, gave a brief staff report and powerpoint presentation. A brief City Council discussion ensued regarding: lack of water use data prior to 1998; water connection draft nexus study methodology for calculating maximum day demand (MDD) and why Staff recommends a peaking factor of 1.1 to more accurately reflect the amount of actual use of water consumption by each user class on the peak day; charge for unregulated versus regulated capacity; using the reserve capacity charges to offset capital replacement projects such as replacing all meters with Advance Metering Infrastructure (AMI) meters; cost versus benefit of AMI meters such as increased transparency because all customers will have an app which allows them to access complete water usage history; no need to purchase additional capacity because the City Will receive credit when the Placer County Water Agency (PCWA) Phase 3 project is complete. and closed the discussion to the public at 6:48PM with no comments. 6:52PM and Councimember Gilbert returns at 6:53PM. Connection Fund and surplus water capacity. 4.D. Pioneer Rate Increase discussion. Councilmember Andreatta requested this item be on the agenda because she had been contacted by concerned residents and she didn't understand Councimember Gilbert's vote on the Pioneer Board to increase rates. AI lengthy City Council discussion ensued regarding: a draft letter to the Pioneer Board that City Council chose not to send stating the Council's concerns with rate increase; direction given to Councimember Gilbert at the last City Council meeting which he did not attend; information that Councilmember Gilbert used to make his Pioneer Board vote increasing rates; Pioneer's financial viability; validity of information provided to the Pioneer Board regarding debt service of Pioneer Energy and rationale to increase rates; City Council allowing Councimember Gilbert's vote to stand being an endorsement of increased rates; resignation of the Pioneer Energy Executive Director; replacing Councilmember Gilbert with another Councimember on the Pioneer Energy Board; clarifying City Councilmembers' roles on regional committees, boards and joint power authorities; and Councimember Gilbert request a representative from Pioneer come to a City Council meeting to explain their financials and also request a special Pioneer Board meeting before new rates go into effect. Mayor Joiner opened a) Lena Labosky, a Lincoln resident, stated she didn't trust Councilmember Gilbert and requested he be replaced. Mr. Nader also stated his concern that the Pioneer Energy Executive's statement in the newspaper that her position was above her skillset. Mayor Joiner closed the public discussion at 8:38PM with noi further comments. Another brief City Council discussion ensued regarding: clarifying City Council roles on regional bodies; Pioneer Energy employees and whether they were also Placer County employees; tapping the brakes on the rate increase; and resolving the Executive Director resignation. Joiner and Members of the City Council: We represent the Lincoln Village 3 Landowners' Association comprised of the largest landholding entities within the 2,040-acre Village 3 portion of the City of Lincoln General Plan 2050 planning area. We have submitted detailed comments upon select provisions oft the Placer County Conservation Plan (PCCP), the PCCP Draft Environmental Impact Statement/ Draft Environmental Impact Report (DEIS/DEIR), and the PCCP Clean Water Act Section 404 Permit Strategy for Waters of the United States on behalf of the Lincoln Village 3landowners' Association for consideration and, we hope, modification of key provisions we have identified, by the City, Placer County, the U.S. Fish and Wildlife Service and U.S. Army Corps of Engineers. The Lincoln Village 3 Landowners' Association is supportive of the PCCP and provides its comments and suggested changes for the purpose of ensuring the practicable, fiscal and pragmatic viability of the PCCP and its components over the PCCP's proposed 50-year life.
