ROLL CALL Councilmembers present: Holly Andreatta Peter Gilbert Dan Karleskint Alyssa Silhi Paul Joiner Mayor: Roll Call: 5 members present, 0 members absent, 0 members excused. Staff members present: Jennifer Hanson, City Manager Kristine Mollenkopf, City Attorney Doug Lee, Police Chief Susan May, Finance Director Gwen Scanlon, City Clerk Steve Prosser, Community Development Director Various City employees, consultants and members oft the public were also present. 2. STAFF REPORT Staff seeks direction from the City Council regarding (1) whether or how it wishes to regulate tobacco retailers, including vape shops, and (2) whether Council supports an ordinance Kristine Mollenkopf, City Attorney, gave a brief staff report on vaping regulations and youth purchase, use, or possession (PUP) laws. A lengthy City Council discussion ensued regarding: grandfathered uses; definition and value of tobacco licenses; nanny government and whether PUP regulations are effective; possible enforcement of PUP regulations could be ai fine or mandatory education and that it wouldn't be part of the public record forj juveniles; how this would provide another tool for Police to use; distance of downtown vaping business to Lincoln High School; recent health problems and Federal Drug Administration rulings associated with vaping; modeling the proposed ordinance after the recent social hosting ordinance and having additional levers in the municipal code to give City. Jennifer Hanson, City Manager, asked for direction from City Council and Councilmembers Andreatta, Gilbert and Silhi requested Staff bring the item back for action. Additional discussion ensued regarding proposed ordinance going through Planning Commission as az zoning item or back to ai future City Council meeting as an administrative citation and Council consensus was to bring the proposed action back to a City Council work session for additional discussion. Mayor Joiner opened the discussion to the public at 4:45PM with the following a) Stan Nader, al Lincoln resident, stated his concern with underage vaping and making possession of tobacco products by under-age individuals a crime. comment: encouraged the City Council toi take action. Brown Act Presentation. Kristine Mollenkopf, City Attorney, gave a brief staff report and powerpoint presentation. A brief City Council ensued regarding social media and the need for a policy and whether the discussion at a recent City Council meeting regarding Pioneer Energy was a Brown Act Violation. Ms. Mollenkopf stated she would review the meeting video to determine if there was a violation. Mayor Joiner opened and closed the discussion to the public at 5:42PM with no comments. 5.
