Councimember Joiner was in the Council Chambers prior to meeting being called to order but because of the difficulties he exited and attended meeting telephonically. Meeting moderated by Jennifer Hanson, City Manager. 1. PUBLIC COMMENT ON NON-AGENDAITEMS - none. 3. EMERGENCY REPORTS 3.A. Adopt RESOLUTION 2020-53 ratifying the Proclamation of a Local Emergency in The City 2. Compensate staff that are sent home with Paid Administrative Leave, as necessary; of Lincoln and specifically grants authority to the City Manager, if needed, to: 1. Reduce staffing levels, as necessary; 3. Suspend water shutoffs, as necessary; 4. Waive all late fees, as necessary; 5. Order the closure of facilities, services, and buildings, as necessary; 6. Enter into contracts for the purchase of supplies, services, and/or equipment needed to assist in preparing for, containing, responding to, mitigating the effects of, and recovering from the spread of COVID-19, including those contracts with an estimated value equal to or greater than the contract and purchasing authority allowed by the Lincoln Municipal Code; 7. Suspend, as necessary, competitive bidding requirements for purchase of supplies, services, and/or equipment needed to assist in preparing for, containing, responding to, mitigating the effects of, and recovering from the spread of COVID-19; 8. Suspend City services and programs, including applicable deadlines, as necessary, 9. Suspend and reschedule public meetings of the City Council, Boards, Commissions, and Committees including applicable deadlines, as necessary; 10. Ms. Hanson invited each Councimember to comment: Councilmember Joiner stated the action was an appropriate and timely step. He asked the 1. What is the duration of the Proclamation of Emergency, will it end when State does or when Ms. Hanson stated it would be the last agency unless directed by City Council to end earlier. Councilmember Andreatta echoed Councimember Joiner's questions and comments. She asked the following questions: 1. How many Staff members are out sick? Ms. Hanson responded some Staff are sick but is unknown if it is the common cold or the COVID-19 virus. 2. Has the City received many complaints from reduced services? Staff may have a difficult time tracking regular sick leave versus time directly attributable to the virus. He asked if Administrative Leave caused by COVID-19 would be tracked in order for the City to get reimbursed? Ms. Hanson responded Staff is working on this issue. Mayor Karleskint suggested the City Council decide when to end the local emergency and suggested that not be done until all potential reimbursement funds have been exhausted. Mayor Karleskint stated the proclamation is flexible enough to allow the City to handle anything that may Ms. Hanson opened the public hearing at 4:37PM and Gwen Scanlon, City Clerk, read the only email comment she had received from Mike Garabedian, made a part oft these minutes by mention thereof. Ms. Hanson closed the public hearing at 4:40PM with no further comments and Staff Ms. Hanson asked the Councilmembers if they had any further comments. Hearing none, Mayor Karleskint requested a motion. Councimember Gilbert motioned approval of Resolution 2020-52 and the motion was seconded by Councimember Andreatta. This does sO without meaningful and necessary opportunity for the public to bet fullyi informed and for the publict to comment, includingi int the context oft the verbal prohibition on the publici from handing out documents to the City Council ati its meetings which is noti thatl Iknow ofa a policy that was proposed and adopted with public input. This part oft the announcement accurately reflect that it is common for Lincoln to seem regularly to only comply with the minimum required by law, and that what the minimum required is can require that the public point out to the Council what the law does require: "The City Manager further proclaims and orders that during the existence of said local emergency, the powers, functions, and duties of the emergency organization of the City shall be as prescribed by federal and state law, and by City ordinances and resolutions of this City." Doing the minimum required byl law as the city does for some exercises of discretion but not others can often not be Most troubling about the announcement overall is that there is no mention in it ofa commitment to inform the public about any of the pending activities and actions described between the announcement and March 24. Iti is also of note that the announcement does not cite your or any authority for making this proclamation. The 1:40 p.m. announcement today does not mention the City Council meeting planned fori today March 17at 4:00.
