Direction from City Council Regarding Negotiations for Airport Fixed Base Operator and Ray Leftwich, Public Works Director, introduced the Fixed Base Operator applicants Alan Ada, Pointe West Development, and Richard Sax, Distinctive Projects, who gave an overview of their proposal in response to the City's Request for Proposal (RFP). A lengthy City Council discussion ensued regarding: the applicant providing financials for the Council to review; what was included in the City's RFP; whether the Airport Committee reviewed the proposal and if they recommended approval; whether the proposal was in line with the Airport Master Plan, the environmental review needed for the proposal; the proposal being more of a development project than just airport management; and a possible conflict of interest in having the Airport Committee providing a recommendation. Life Lincoln Page 2of2 City Council, Public Finance Authority and Redevelopment Successor Agency Work Session Meeting Minutes June 2, 2020 c) d) Bob Butera, a Lincoln resident and Airport Committee member, stated his concern for Scott Thompson, a Lincoln resident, stated his concern that the nature of the airport hangar owners in phase 2 as they could lose significant equity and requested additional details would change and the emphasis would be on development rather than general aviation. Mr. Thompson also asked for a status on the Planes of Fame (POF)negotiations and stated POF Messrs. Ada and Sax briefly responded to concerns voiced by the public. Mayor Karleskint closed the public discussion at 5:56PM. Another brief City Council discussion ensued regarding: the need for City Council to review the financials of the project proponents and to communicate with the Planes of Fame. City Council consensus was to move forward and identify a City negotiator to determine whether City Council is interested in moving forward with the Pointe West Development should be given the right of first refusal. proposal. 4.B. Direction from City Council regarding the implementation of AB 571 which limits campaign contributions to City Council candidates to $3,000 per donor per election, or whether the Council wishes to adopt a different limit. If the latter, staff also requests direction regarding Kristine Mollenkopf, City Attorney, gave a brief staff report. A brief City Council discussion ensued regarding lack of staff needed to enforce limits to campaign contributions. City Council consensus was to take no action and allow AB571 to go into effect on January 1, 2021 limiting candidates to enforcement provisions. $3,000 per donor per election. 4.C. Direction from City Council on City Council Code of Conduct. Kristine Mollenkopf, City Attorney, gave a brief staff report. Councimember Andreatta stated she had requested this item be brought forward after ai fellow Councimember attended a recent Emergency Counsel meeting. She continued when the Emergency Counsel was formed it was with the understanding that City Council would not attend these meetings. Councimember Gilbert responded that he attended, not in his capacity as a Councilmember, as an alternate for the President of a Service Organization he belongs to and stated he would not be attending future meetings. Al brief City Council discussion ensued regarding Brown Act requirements; difficulty for public to perceive City Councilmembers in any other role; the need to revise the City Council Code of Conduct; and timing to revise the Code of Conduct. Mayor Karleskint opened and closed the public discussion at 7:01PM with no comments. City Council consensus was to bring an updated Code of Conduct based on the League of California Cities to a future work session meeting. 5. COUNCIL INITIATED BUSINESS = none. 6. Idid not bring up my question about working around the FAA restrictions that the granted property be only used for aeronautical purposes based on your answer (whichIthinki isi incorrect and incomplete) and Jennifer's knowledge about the subject. It would be nice to see it actually addressed, though, with a citing the appropriate FAA regulations lalso question the drawing on page 26 oft the document provided in the agenda for design of airports and runway. The basic guidance for airport design (AC150/5300-13A): for parallel VFR runways is 700' from centerline to centerline, and 400' parallel taxiway to runway centerline distance. The submitted drawing shows 75' distance between runway and taxiway, and what appears to be 125' separation between two parallel runways.Iquestion the basic competence oft this company to do airport design if such simple FAA guidance is not considered. The design presents corporate jets parked on a ramp with as little as 150' lateral separation from landing aircraft. Think Scottsdale, AZ airport and thei issues raised by such tight (out of guidance) design. Likel Isaid in my comment, the appearance is that this shoehorns the aviation into a small part of the development to maximize the land that can be developed for other non-aviation purposes. And, for what iti is worth, would not expect Planes of Fame and this proposal to be compatible. The airport environment would be completely changed and would not lend itself to warbird operations and airshows. lacknowledge the airport needs a plan and a change of course. There are numerous examples available where any non-aviation use of granted airport property is prohibited by the FAA as per the terms of the original transfer agreement. Obviously, this will all be sorted out before the proposal would be allowed to move forward. But I would suggest that the city contact the FAA Airports District Office before moving too far down the road for the FAA'sread on such non-aviation use of a surplus airport transferred from the federal government.
