The Placer County Conservation Program contains many potential positive contributions for Placer County. There are Placer County Community Development Resources Agency (CDRA) has put this and many other highly controversial programs forward during the pandemic. While individuals and small businesses are suffering medical and financial hardships, the County has burdened residents with thousands of pages of environmental documents and the introduction of numerous and significant programs. Placer has changed the entire building code, introduced the massive Zoning Text Amendment, introduced a Winery & Brewery Ordinance, updated the Placer Housing Code, and is considering an extension to a Regional Park. The Placer County Conservation Program has been under consideration for approximately 2 decades. There are already conservation protections in place. I respectfully ask that you postpone your decision and work towards a solution with public workshops that considers all of the cumulative impacts of the programs recently introduced and the PCCP. lask that you postpone your decision for thei following reasons. We are in a pandemic and close to a presidential election. Resident focus is obviously not focused on the PCCP. Recent California wildfires have devastated California. The assessment of fire damage in California and specifically what it means in the near future for air quality, water quality, homelessness, and conservation efforts Irecently attended the Placer Board of Supervisor hearing on October 6, 2020 where the Placer CEO brought forth a proposal for a loan for Lincoln protection services from Placer County. It was quite troubling that Supervisor Uhler raised the suggestion that not only did he want a 2 year review (reasonable) but that he also wanted to know how Lincoln was spending their budget (ifi it was being properly spent) and suggested that the Board may help the Lincoln Council look at best practices and long term efficiencies. This suggestion could have the appearance of Placer oversight/contro" for monies being received by Lincoln. This appearance should be avoided at all costs. Kirk Uhler was voted out of office in March 2020. He has been rapidly pushing his agenda through the board prior to his end ofi term in December 2020. The City of Lincoln is now a member of the Joint Power Authority, the Placer Conservation Authority. The Sunset Area Plan/Placer Ranch would likely use the PCCP (if approved) to mitigate associated projects. The landfill is part of that lawsuit. The Statement of overriding consideration was that the jobs produced by a university would provide benefit. The State of California commissioned a study that did not even include the Sac State/Placer Ranch satellite. however many challenges and negative impacts not being considered. is unclear. 1 The Chancellor also stated there would be no additional universities. Lincoln's involvement seems to be growing in one of Placer County's major challenges. Respectfully, Cheryl Berkema lam including my comments to the Placer County Board of Supervisors PCCP hearing below: Placer County Conservation Program (PCCP) Feedback Board of Supervisors Hearing 9/1/2020 Board of Supervisors, 1. Community Development Resources Agency (CDRA) has again taken advantage of the pandemic by jamming non-essential projects through the project pipeline with insufficient public review. The Placer County Conservation Plan (PCCP) is an example of a non-essential project, a plani in the making for 20 years, hardly time sensitive. Other examples of CDRA abusing the public's trust and lacking transparency with the introduction of highly controversial projects during the pandemic are Hidden Falls Expansion and the Winery and Brewery ordinance. Similar programs already exist, iti is therefore inexcusable to introduce non-essential programs during the pandemic that benefit special interests and have significant & unavoidable impacts with significant cost to 2. The PCCP wasi failed to be properly socialized. Placer residents are largely unaware oft the PCCP program a. Where was the media splash in the Sacramento Bee and other local papers educating the public on b. The program documentation was: so large that it needed permission to be divided into 3 sections on state & federal registries. Yet the documentation was not made available to the public in County offices C. The Placer County Code and a General Plan Amendment are being proposed by the PCCP. These d. There was significant public participation on the PCCP over the past decades, yet the Planning Commission hearing had extremally limited participation. The impact ofj job losses, business losses, health concerns over the virus, concerns over children returning to schools and an uncertain future shows the insensitivity of Placer management to the residents of Placer with the introduction oft the e. The Board of Supervisors is actually changing the remote communications tool for participation in the hearing on the day of the hearing September1.: 2020, making it difficult for those not able to 3. PCCP in concept could be a great program. The Western Placer County Habitat Conservation Plan and Natural Community Conservation Plan (HCP/NCCP); Western Placer County Aquatic Resources Program (CARP), and Western Placer County in-lieu Fee Program (ILF) should provide al long term strategy for conservation with consistency, however, the current CDRA management team's practices and suggested program implementation falls short of meeting the purported program goals. The proposed PCCP program implementation has several taxpayers. the programs proposed benefits, impacts, costs and sources ofi funding? and libraries. changes were not brought to the Municipal Advisory Councils for feedback. PCCP at this time. manage the new technology. significant issues: 2 a. The program is supposed to be self-funded. At the Planning Commission, there was a very brief overview of funding describing how development fees covered only 70% of the program funding. The remaining 309 % was said to be covered by state, federal and other grants. It was verbally stated that "loans" will likely be needed to sustain the program. The plan falls short in identifying the contingencies. Are more ballot measures going to be needed? With the current pandemic and recession where trillions of dollars of state and federal bailouts, iti is unreasonable to make such assumptions on grants sustaining the program. CDRA needs to go back to the drawing board and come up with a plan to fund the program. i. In Placer County, during a time of great uncertainty where many people have lost their jobs, homes, and businesses, budgets are being cut to provide only the most basic services, yet Placeri isi introducing yet another business development program that is costly tot taxpayers. Placer has a $3 Billion-dollar short fall for roads, insufficient funds for sewer infrastructure, fire service ballot measures, increases to landfill costs, recent education ballot measures, and increased property taxes. Additional taxes are too great a burden. fire resources, yet the PCCP which has been evolving for approximately 20 yearsi is being introduced which will add to fire control costs. The current state ofe emergency: should be the ii. The largest fires in California history are ravaging the state depleting all priority. ii. Placer parks do not have sufficient funding for maintenance or improvements, yet another public funding is being requested. shifting responsibility via the Implementing Agreement. b. The oversight of the program is problematic: The responsibility for management of the program has been diluted by 1. It would appear to be a conflict ofi interest for an organization that is measured on transportation to be responsible for wildlife protection in any way. 2. Placer County has some oft the highest paid employeesi ini the state enjoying significant raises and bonuses and they additionally hire highly paid consultants to produce environmental studies & reports. CDRA: should be able to manage their own responsibilities. CDRA did the same with the Housing program deferring their housing responsibilities to the Private Trust. This dilution ofr responsibilities introduces al lack of accountability, costs tax payers, and creates an unnecessary complexity into the system. 3. The public should not have to "watch" the activities of multiple agencies to follow PCCP permitting activities for public and private developments. This further dilutes 4. Yearly program reports are not sufficient. Too much damage can be done over the course of a year to the environment without transparency and oversight. In ordert to accountability. monitor program trends, quarterly reports should be required. ii. The citizens oversight committee whose composition, empowerment, and responsibilities have not been documented or vetted. Placer typically uses this asa mechanism to say the public oversight is there to ensure transparency and accountability. As large as the documentation fort the PCCP is and how important the committee is for accountability and transparency iti is being treated as an afterthought, merely included to repeatedly' bring back projects to the Board of Supervisors to offer additional entitlements and fee reductions to the developers. This practice is highly abused with the developers ofl large projects and specific plans. These consistent modifications are not predictable for a program. placate the public. iii. Placer Planning consistently produces project agreements only to 3 Total losses to publici funds is unknown. The PCCP as a new program should not follow down the same problematic path, rather should utilize best practices in oversight, accounting and its authority. The PCCP program created a "pilot program" executing on the PCCP program without appropriate state andi federal agency signoff. They also engaged in PCCP activities without completing the required CEQA process first. An interim fee agreement was conveniently set up to run business prior toi the PCCP Program being approved. What other oversteps and infractions can we expect from the PCCP program in the future with top level management abuses setting the bari for poor behavior? Will these overstep activities not only! be executed on amuch larger scale but also trickle down to all oft the permit applicants approving permits? No one is above the law; appropriate safeguards need to be inj place to protect public resources. reporting. iv. The PCCP Pilot Program is an example of CDRA management abusing 4. Stop approving poorly designed programs with significant impacts- they are avoidable! i. The PCCP is largely a "Killi in Place and mitigate elsewhere" program. ii. Thisi is a distinct benefit to developers and encourages decimation of environmental resources. Tax payers are being cheated out of1 the value of the resources and pay the price inl loss of precious environmental resources. This has been pointed out to CDRA as thousands of protected trees and acres of wetlands were targeted for removal in CDRA proposed projects. Other Counties have significantly more robust plans in place with multiple also consistently ignores public feedback on project requests to save species, wetlands, vernal pools and other resources. The public is owed the current status of lost resources, in lieui funds usage, and the restoration progress. Why would Placer County introduce a significant program when the current programs fail to preserve resources and lack transparency and accountability? simultaneously which will allow developers to destroy vernal pools and endangered species in the Sunset Area Plan/Placer Ranch. Those vernal pools and endangered species should have been included int the PCCP for protection. Placer County allowed special developer interests to win out over the environmental protections but now want to claim the PCCP as a best practice program. Rather disingenuous. Sunset Area Plan/Placer Ranch is currently in litigation. The times the in-lieu fees. ii. CDRA fails to report on Tree Preservation and Restoration today. CDRA The foxi is guarding the hen house. iii. CDRA designed a strategy for the Sunset Area Plan and the PCCP 4 PCCP should be delayed until resolution of the Sunset Area Plan/Placer Ranch lawsuit, iti is the largest dependency on the environment in West Placer County. 6. CDRA currently' fails to enforce the conditions it provides in projects for mitigation and monitoring. Thisi is evidenced by multiple Grand Jury Reports. As an example, the Director of CDRA was specifically chartered by the Grand. Jury with creating a winery ordinance with specific actions, het failed to do sO with the recent introduction oft the new ordinance. CDRA management and the Board of Supervisors should take Grand. Jury recommendations seriously. CDRA: should assess the current issues that are not being resolved in monitoring and mitigation enforcement prior toi introducing new programs.
