PUBLIC COMMENT ON NON-AGENDAITEMS a) Stan Nader, a Lincoln resident, stated his concern with Council's lack of communication regarding needed increases to the Lighting & Landscaping assessments, under-staffing at the Fire Department and b) Albert Scheiber, a Placer County resident, thanked the Fire Department for their quick response to a fire near his property on July 4, 2021. Mr. Scheiber also stated his concern that his questions remain unanswered from the July 6, 2021 work session meeting Sustainable Groundwater Management Act c) John Fett, a Lincoln resident and Economic Development Committee (EDC) Chair, stated his concern that the EDC has not met in quite a while and requested the next regularly scheduled quarterly meeting on August 11 occur and that they have monthly meetings thereafter and quarterly presentations to the City Council. Mark Scott, Interim City Manager, gave a brief explanation of the SCIP program and Steve Prosser, Community Development Director, stated the City had entered into five since 2019. A brief City Council discussion ensued regarding the proposed park timeline; City's policy changes to developers constructing parks; requirements and age of the Twelve Bridges Development Agreement; home type will be single family homes; and market rate for similar nearby homes. a) Ken Topper, Planning Manager from Morton & Pitalo and representing the developer, thanked staff b) Bob Holmes, representing the project applicant, stated the market price for nearby homes are in the low $600,000 range and the applicants had not yet decided on dimensions of project lot/homes but that c) Mike Herrick, a Lincoln resident and attended the meeting via Zoom, stated his opposition to the project citing the number of times the Twelve Bridges General Plan had been amended as well as lower d) Dan Catania, a Lincoln resident and attended the meeting via Zoom, stated his opposition to the project and questioned whether the Police Department or Sheriff had been contacted in regards to planning Village 27 into three (3) parcels; and, Bridges Village 27 into 184 single-family residential parcels. Determining that the Oak Tree Maintenance Project is exempt from the California Environmental Quality 2. Authorizing the City Manager to execute a contract for construction with A&E Arborist Tree Care, Inc. in the amount of $362,880 for the Oak Tree Maintenance Project, Capital Improvement Project (CIP) 468; 3. Authorizing the Community Development Director to approve change orders not to exceed $72,576. The project is funded by $700,000 from Fund 290 as part of CIP 468 Oak Tree Maintenance in the FY Steve Prosser, Community Development Director, gave a brief staff report and stated this is the third time it has been brought to City Council who requested additional information. The staff report contains a letter from the contractor stating the project schedule and an opinion letter from a professional, unbiased certified arborist, not associated with the project, on the appropriateness of the project schedule and scope. Ab brief City Council discussion ensued regarding: project schedule, fire mitigation measures and oak tree pruning. a) Mike Garabedian, a Lincoln resident and attended the meeting via Zoom, asked if the project only applied to public lands and if there was a map: showing the location of the oak trees to be pruned. He also stated is concern that the canopy arbitrarily be cut and that fire mitigation measures be coordinated. b) Stan Nader, a Lincoln resident, stated his concern with the City Attorney's interpretation of the City's Municipal Code Section 18.69.030 particularly the meaning of restoration and replacement of trees. Mr. Nader stated restoration means to rebuild and replacement means to replant and maintenance of trees is not mentioned sO this action could be construed as a misuse of public funds and the City has already lost one c) Albert Scheiber, a Placer County resident, stated his concern that the Council would not answer questions and asked why now when trees have been down for past ten years and fire concerns is a bogus reason. Mr. Scheiber also asked if the City paid for the opinion letter from the certified arborist because you get what you pay for. Mr. Scheiber concluded by stating his concerns regarding the City Attorney. A brief City Council discussion ensued regarding: the definitions of restore, replace and maintenance and how the City's Municipal Code reads; the arborist who prepared the opinion letter was paid by the City and her reputation; past severe wildfire seasons contributing to why the project is being done; oak conservation; Councilmember Joiner motioned approval of the item and the motion was seconded by Councimember Karleskint.
