PUBLIC COMMENT ON NON-AGENDAITEMS a) Albert Scheiber, a Placer County resident, stated his concern with number of lawsuits on closed session meetings scheduled today and tomorrow. He stated his appreciation with actions taken at past few Council meetings including the hiring of additional staff. Mr. Scheiber gave kudos to Mayor Andreatta and b) Matthew Oliver, Lincoln business owner, stated his concern with actions directed towards him taken by Councimember Lauritsen at the 3rd Congressional District Debate held the night before at William Jessup University. He continued he is disappointed Councimember Lauritsen continues to act on City Council after his physical aggression and verbal altercation with he and his son at the debate. Mr. Oliver stated the City needs to adopt a Code of Conduct and requested Councimember Lauritsen be removed c) Adam, who resides outside of Lincoln and didn't state his last name, spoke in support of Matthew new City Manager, Sean Scully, for listening to public comments. from office and go toj jail. Authority and Redevelopment Successor Agency Regular Meeting Minutes April 26, 2022 d) Michael Maldonado, a Lincoln resident, also spoke in support of Matthew Oliver after viewing Mr. Oliver's Facebook Live video. He continued that Councimember Lauritsen has displayed antagonizing actions in a previous Western Placer Unified School District Board meeting when he spoke about mask mandates. Mr. Maldonado concluded that something needs to be done and requested Councimember e) Keela Ruiz Marquez, a Placer County resident and previous City of Lincoln Planning Commissioner, stated she has served this community and was very dismayed when she viewed the video. She continued that Councimember Lauritsen's actions taint the current City Council and she is ashamed to f) Siobhan Oliver, a Lincoln business owner and wife of Matthew Oliver, stated she was watching video as her husband filmed last night and she could tell he was shaken by Councilmember Lauritsen's actions. She stated her husband isn't against vaccinations but he fights for choice because of her; her father has a blood mutation which caused a stroke immediately following his vaccine and she and her daughter also have that mutation and have been recommended not to get vaccinated by medical g) Byron Chapman, a Lincoln resident, stated iti is not required under the Brown Act to fill out a speaker card and stated his concern from previous meetings that hei is unable toi find the ADA information Jennifer Brown, Chief Innovation and Technology Officer, stated staff is actively working on getting the h) Lena Labosky, al Lincoln resident, stated Councilmember Lauritsen is her district representative i) Teri Hern, stated her concern with the video she viewed and it has to be a liability for him to Lauritsen step down from City Council. have her name associated with his. professionals. on the City's new website. ADA information on the website but delay was due to staff shortages. and she would rather have no one than have him represent her. represent the City and encouraged him to quit now. Mayor Andreatta stated she would respond during Council Initiated Business. 8. CONSENT Mayor Andreatta asked if any members of the City Council or public would like to pull any items from the Consent Agenda. Councilmember Joiner pulled Item 8F, Committee Appointments, and Item 8H, Aitken Park Phase 3. Councilmember Karleskint motioned approval of the balance of the consent agenda and the motion was seconded by Councimember Joiner. Adopt RESOLUTION 2022-91 appointing Sean Scully, City Manager (or designee), as the City of Lincoln's real property negotiator relative to the disposition of approximately 162 acres of a larger 420.2- acre parcel identified by Assessor's Parcel number 021-283-003. The property is located at the southeast by the City Manager and filed int the Office of the City Clerk by April 8, 2022. with Senate Bill 296, which became effective January 1, 2022. quadrant of Fiddyment Road and Moore Road within the City of Lincoln ITEMS PULLED FROM THE CONSENT AGENDA: 8.F. Committee Appointments. Councimember Joiner stated he pulled this item to recognize the appointees who were in attendance. a)Whitney Eklund, a Lincoln resident and Economic Development Committee member, thanked Mayor Andreatta closed the discussion with no further public comments and called for a motion. Councimember Joiner stated he pulled this item because he had received a number of requests from the public and various other Councilmembers stated they too had similar requests. Sean Scully, City Manager, gave a brief staff report and a brief City Council discussion ensued regarding parking options and Mayor Andreatta gained Council consensus to get additional input from residents closest to the park. RESOLUTION 2022-90 allowing the City Manager to execute a contract for construction with PBM Construction, Inc. int the amount of $1,149,031.00 for the Aitken Park Phase 3 Project (CIP) 461, authorize the City Engineer to approve change orders not to exceed $172,355, and authorize the City Manager to execute a task order with Coastland Civil Engineering in the amount not to exceed $220,000 for construction management and inspection services - NO ACTION TAKEN. 9. PUBLIC HEARINGS - none. 10. GENERAL BUSINESS 10.A. Adopt RESOLUTION 2022-92 authorizing the approval of five positions in CDD and augment the FY 21/22 approved budget in Fund 248 and 100 in the amount of $100,426. Enterprise Resource Planning Adopt RESOLUTION 2022-93 authorizing the City Manager to execute a Contract for Services with Tyler Technologies Inc. for city-wide enterprise financial (ERP) Software Implementation, Migration, Training, Maintenance and Hosting in an amount not-to-exceed $1,773,969 which includes a 10 percent contingency for implementation. The City's Financial ERP Software Implementation, Migration and Training will be funded by the CIP and associated Saas maintenance/rene/renewal/nosting, fees for the duration of the 5-year contract will be budgeted annually. Jennifer Brown, Chief Innovation and' Technology Officer, gave a brief staff report and powerpoint presentation, made a part of these minutes by mention thereof. Mayor Andreatta opened the discussion to a) Richard Pearl, City Treasurer and a Lincoln resident, stated this action is long overdue and b) Byron Chapman, a Lincoln resident, stated his concern the project may go off track and suggested the City notify its residents of the top three projects they are working on. the public with the following comments: necessary to guide Lincoln into the future and he was very much ini favor. Adopt RESOLUTION 2022-94 authorizing a temporary skate park located at Chief Jimenez Park Sean Scully, City Manager, gave a brief staff report and powerpoint presentation, made a part of these minutes by mention thereof, and stated Staff and the Park & Recreation Committee are recommending the Chief Jimenez Park as a temporary location. A brief City Council discussion ensued regarding returning the temporary site to al basketball court safely, installing a camera at a nearby restroom to improve security and where a permanent skate park could be located. COUNCIL INITIATED BUSINESS Mayor Andreatta gave a brief statement responding to public comments earlier in the meeting about Councimember Lauritsen. She stated he is an elected official and that she and City Council are bound by the legal process and Brown Act and cannot discuss at this meeting but Council has a closed session meeting scheduled tomorrow. Mayor Andreatta concluded by asking Councimember Lauritsen for his resignation. Councilmember Lauritsen stated he would like to respond but Kristine Mollenkopf, City Attorney, stated any discussion at this meeting is inappropriate. Councilmember Joiner stated he is sure this issue will be on a future meeting agenda to allow discussion at that time. 12. INFORMATION ITEMS - none. 13.
