Both are to transfer in total $100,000 to our Other Posl-Employment Benefits (OPEB) accounts. These are normal end of year actions. You will see in the General fund $60,000 to Retiree Fringe Benefits. In the Water and Sewer Funds (also jointly referred to as the Enterprise Fund) the transfers are to Retiree Group Insurance. All three oft these accounts hold the amount we have available to pay OPEB. OPEB was stopped in 2011 due tot the ever growing expênse of this benefit. However, we get an Actuary Study done each year to determine total unfunded benefit. The transfers make the OPEB better funded. We will continuei to make these transfers until our Actuary Study shows that this benefit is properly funded. Recommendation: Leave in the consent agenda and approve as presented. EXHIBIT A CHAPTER 117: MOBILE FOOD VENDORS SECTION 117.01 INTENT 117.02 DEFINITIONS 117.03 REQUIREMENIS FOR: MOBILE FOOD VENDORS 117.04 APPLICATION FOR: PERMIT 117.05 PERMITI REVIEW 117.06 PERMIT FEES AND LIMITATIONS ON NUMBER OFI MOBILE FOOD VENDORS 117.07 SUSPENSION OR REVOCATION $117.01 INTENT The Town of Williamston recognizes that the diversity of prepared food options can be enhanced by allowing mobile food vendors to serve prepared food within the city limits. The Town further recognizes that mobile food vendors have the same responsibilities to their customers and the community as do food service establishments with fixed locations and should be required to abide by local permit requirements in the same manner as facilities with fixed locations. $117.02 DEFINITIONS The following terms, as used in this Chapter of the Town Code, shall have the following Mobile Food Vendor. A vehicle-mounted food: service establishment designed to be Street Vending Unit (Food Truck or Concession Trailer). A mobile food vendor business in which food that is prepared and made ready for consumption at the point of sale is sold from or out ofai motor vehicle that does not exceed eight feet in width or twenty-five feet in length and that is removed each day from the location where the food is sold. meaning: readily moved. Sidewalk Vending Unit (Pushcart). A mobile food vendor business in which food that prepared elsewhere and ready for consumption at the point ofs sale is sold from or out of a non- motorized piece of equipment or vehicle that is removed each day from the location where the food is sold. Only hot dogs, taços, ice cream, snow cones and popcorn may bej prepared for consumption in a pushcart. $117.03 REQUIREMENTS FOR MOBILE FOOD VENDORS (A) Vendors must have a current permit from Martin County Health Department (Except ice and ice cream vendors which are not regulated by the Health Department). (B) Vendors may operate only on private property with written permission from the property owners. The parcel must be zoned fori non-residential users. (C) Vendors must be self-contained and not use outside water, sewer, or electrical at (D) Must have Sales and Use Tax registration number from Department ofRevenue. (E) Mobile vending units shall be located at least ten feet away from the nearest building provided that ai mobile vending unit may be located closer than ten feet to al building if the location has been approved by the Williamston Fire Marshall. Unless subject to division the proposed event site; planning, quality, public safety and payment ofinvoices; and (C)(16) above, nothing in this section shall authorize the Permit Official to deny a permit based upon political, social or religious grounds or reasons, or based upon the content of the views expressed. The Permit Official may attach reasonable conditions to any permit approval. Violation ofthese conditions (D) Costs and fees. The applicant shall be responsible for hiring and paying off-duty law enforcement officers, or reimbursing the town for the costs of providing on-duty law enforcement officers, to appropriately police street closures. For festivals, the applicant shall be additionally responsible for hiring and paying off-duty law enforcement offiçers, or reimbursing the town for the costs of providing on-duty law enforcement officers, to provide internal festival security and for hiring and paying necessary emergency medical technicians. The Permit Official shall determine the number ofofficers needed to appropriately police street closures and for internal security, and the number of emergency medical technicians needed, and the time when the services shall commence and end, shall be reason for immediate revocation oft the permit. taking into consideration the following: (1) Thej proposed location of the special event or route oft the parade; (2) The time of day that the public assembly or parade is to take place; (3) The date and day ofthe week proposed; (4) The general traffic conditions in the area requested, both vehicular and pedestrian. Special attention is given to the rerouting of the vehicles or pedestrians normally using the requested area; (5) The: number of marked and unmarked intersections along the route requested together (6) Iftraffic must be completely rerouted from the area, then the number ofi marked and with traffic control devices present; unmarked intersections and the traffic control devices are to be taken into consideration; (7) The estimated number of participants; (8) The estimated number of viewers; (9) Ther nature, composition, format and configuration of the special event or parade; (10) The anticipated weather conditions; Public Assemblies 37 (11) The estimated time for the special event or parade; and (12) For festivals, whether alcohol will be served, live music offered or retail sales stations provided and the number and location of alcohol service stands, music stages and retail stands. In addition, the applicant shall reimburse the town for the costs of providing street and sidewalk cleaning, trash receptacle plaçement, trash removal and trash disposal. Notwithstanding the foregoing, the town may provide the services required by this section at no cost, or at a reduced cost, to the applicant should the town desire to provide the support to the public assembly or parade. The action is not a waiver ofa regulatory requirement based upon political, social or religious grounds or reasons, or based upon the content of the views expressed, but instead is an affirmative act oft town association or speech. (E) Time and notice ofo decision. The Permit Official shall approve or deny an application within 20 days ofreceipt. A notice of denial shall clearly set forth the grounds upon which the permit was denied and, where feasible, shall contain a proposal fori measures by which the applicant may cure any defects in the application or otherwise procure aj permit. Where an application is denied because the proposed event would conflict with another event that has or will be approved, the Permit Official shall propose an alternative place, ifavailable for the same time, or an alternative time, ifavailable for the same place. (F) Appeals. An applicant may appeal the denial of an application in writing within ten days after notice of the denial has been received. As soon as practicable, the Appeals Board shall hold a quasi- judicial hearing on whether to issue the permit or uphold the denial. The applicant shall have the right to present evidence at the hearing. The decision to issue or uphold the denial shall be based solely on the approval criteria set forth in this section. The Appeals Board shall render a decision on the appeal within five business days after the date of the hearing.
