MINUTES OF MEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, March 5, 2024, at 5:00 p.m., in Council Chambers. City Manager Beth Kelly Mayor Salmon called the meeting to order. Council Member Taylor led the invocation and the Hannia Benitez, Deputy Director of the Hispanic Liaison, 1225 N. Horner Boulevard, Sanford, North Carolina, invited everyone to a screening oft the documentary film "Bulls & Saints" at 5:30 p.m. on Thursday, March 14, 2024, at the Wicker Civic Center. David Smoak, 96 Northridge Trail, Sanford, North Carolina, requested that a group be formed to work with the water and sewage needs ofLee County, without citizens having to request City annexations. He stated that he has served as Carolina Trace President, and hei is a Republican candidate for Lee County Board of Commissioners. Hei thanked Council for their efforts in making Sanford an attractive and vibrant place for growth. He supports policies that promote Lee County and the City of Sanford working together tos support smart growth strategies. APPROVALOF. AGENDA Mayor Salmon requested that a closed session be added under Item 12, "Other Business." Council Member Rhodes made a motion to approve the agenda as amended. Seconded by Council Member Ferguson, the motion carried unanimously. CONSENT AGENDA SPECIAL AGENDA There were: no items on the consent agenda. ProglamationCelehmating SouthernLeel Men's Bowling Team Winning the State Championship (ExhibitE B) Mayor Salmon invited members ofthe Southern Lee Men's Bowling team toj join her on the podium as she read and presented the proclamation to the coaching staff and team members. Coach Vicki Wilkins complimented the team members' and coaching staff for their commitment, noting that this team had to travel out oftown to practice since they are the only team in the conference without a hometown bowling alley. City Council Meeting March5 5,2024 REGULARAGENDA NEW BUSINESS 2024(Exhibit C) There were no items on the regular agenda. Resolution in Support oft the Temporary Closure oft the Southern Halfofti the Buggy Building ParkingLot for the Purpose of the Sanford Farmers' Market on Saturdays Starting April 20. 2024 Until November 9. Parks Administrator Nick Fortune reviewed the resolution to temporarily close the southern halfo of Council Member Dabbs asked to be recused from deliberation and vote on this item and on the Decision on Public Hearing for the development of the proposed Sanford Agricultural Marketplace. Council Member Tayor made the motion to reçuse Council Member Dabbs; seconded by Council Member the Buggy Building parking lot as described in Exhibit C. Akinosho, the motion carried unanimously. Council Member Rhodes made a motion to approve the Resolution in Support of the Temporary Closure of the Southern Half of the Buggy Building Parking Lot for the Sanford Farmers' Market on Saturdays starting April 20, 2024, until November 9, 2024. Seconded by Council Member Taylor, the Resolution Declaring the Intention of the City Council to Consider the Closing of an Unopened Street Long-Range Planning Administrator David Montgomery reviewed information from the attached Exhibit D and explained that the Martin Family also owns property on both sides of the subject property. He noted that this resolution only sets the date oft the public hearing for April 2, 2024, in the City Council Chambers. He explained that if adopted, this resolution will be advertised in the Sanford Herald for four weeks, as well as advertised tot the adjoining property owners, prior to the public hearing. Mr. Montgomery confirmed that if Council chooses to approve this resolution, the same process will be followed as in the historic districts; to divide the street in half from the center line of the street and each adjoining property motion carried unanimously. Between Parcels 9643-75-1765-00 and 9643-75-1395-001 (Exhibit D) owner would be assessed property taxes. Council Member Buckels made a motion to approve the Resolution Declaring the Intention oft the City Council to Consider the Closing of an Unopened Street between Parcels 9643-75-1765-00 and 9643- 75-1395. Seconded by Council Member Ferguson, the motion carried unanimously. Adoption of Community Development Block Grant Program Plans (Exhibit E) Civil Engineer II Mary Depina reviewed the proposed re-adoption of the two CDBG infrastructure program plans for the East Sanford cured-in-place sewer line project. She explained that the Department ofWater Infrastructure has revised two plans, which are the Procurement Plan and the Section Three. Action Plan, and they are requiring that the City of Sanford re-adopt the plans again in order to remain compliant. She reviewed the Procurement Plan and Action Plan Resolution, and changes to each as described in the exhibits. Resolution to Adopt CDBG Plans Council Member Rhodes made a motion to approve the Resolution to Adopt the CDBG Plans. Seconded by Council Member Dabbs, the motion carried unanimously. Procurement Policyand Plan for CDBG-I Grantees (Exhibit F) Council Member Ferguson made a motion to approve the Procurement Policy and Plan for CDBG-I Grantees. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. 2 City Council Meeting March 5,2024 Section 3Action Plan Résolution (ExhibitG) Council Member Buckels made a motion to approve the Section 3 Action Plan Resolution. Seconded by Council Member Ferguson, the motion carried unanimously. Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2023-2024 - Cleanup Assistant City Manager Beth Kelly explained that this is a midyear cleanup ordinance and funds Council Member Rhodes made ai motion to approve the Ordinance Amending the. Seconded by Council Member Dabbs, the motion Ordinance Amending the Annual Operating Budget ofthe CityofSanford) FY 2023-2024-Police (Exhibit I) Assistant City Manager Beth Kelly explained that this ordinance addresses the provision of funds for the computer. Aided Dispatch System, including the automatic vehicle location and Freedom (a mobile app) for 911 dispatch, which is a request from First Health. First Health will pay the City for this cost and the City will pay the vendor. Mr. Hegwer noted it will allow them to provide better service and explained that the funds must go through the City since the company will not contract with an outside vendor. Council Member Buckels made a motion to approve the Ordinance Amending the. Annual Operating Budget ofthe City of Sanford FY 2023-2024 - Police. Grant Project Ordinance - Siler City Wastewater Improvements (ExhibitJ) Assistant City Manager Beth Kelly explained that this item relates to proceeds from a direct state appropriation, for Siler City Wastewater Improvements, which will be overseen by and being passed- through the City. Mayor Pro Tem Akinosho made a motion to approve the Grant Project Ordinance - Siler City Wastewater improvements. Seconded by Council Member Dabbs, the motion carried unanimously. CapialPpigtOdinanse: -C GraceChrisian'choolandTramway Firel Department: Sewer) Project(Exhibit K) Assistant City Manager Beth Kelly explained that thisi item appropriates state funding for the project as shown on ExhibitJ. Council Member Taylor commented that the City is not planning to expand sewer immediately into the Extraterritorial Jurisdiction (ETJ) and questioned how an action to provide sewer to two individual entities would benefit the City. Utilities and Engineering Director Paul Weeks confirmed that the City was not planning to extend services to this area; however, the money was provided to the City to service these two entities. The City will install a hybrid system that will only serve these two entities. Mr. Weeks explained that the Marketplace at Tramway has a privately owned lift station and gravity sewer system. The City plans to extend sewer to this private system, upgrade the Marketplace system and lift station and to assume control oft the system. There are discussions of taking over the roads as well. Council Member Taylor commented that his concern is that the Marketplace has not requested voluntary annexation and he is concerned about future infrastructure. Mr. Weeks explained that in order to extend sewer service past this location, staff would have to reevaluate the entire downstream system and upgrade it in order to supply sewer service from 3 City Council Meeting March 5,2 2024 Gastor's Creek. Council Member Taylor noted that he would like to see more specific details on this issue for Council consideration. Council Member Taylor made a motion to table the consideration oft the Capital Project Ordinance for Grace Christian School and Tramway Fire Department Sewer Project, as well as the consideration ofa Professional Services Agreement with Freese and Nichols, Inc., until the next City Council workshop for further discussions. Seconded by Council Member Buckels, the motion carried unanimously. Professional Services Agreement with Freese and Nichols, Inc. (ExhibitL) This item was tabled as shown in motion on prior item. DECISIONS ON PUBLIC HEARINGS The Cityof Sanford is requesting that 1.67+1- acres of vacant land, composed of five parcels located at the northwest intersection of Charlotte Avenue and First Street (further identified as Lee County Tax Parcels 9643-70-6685-00. 9643-70-7727-00. 9643-70-7673-00. 9643-70-7596-00. and 9643-70-8501-00) be rezoned from Residential Single Family(R-6and Light Industrial (LI)to Central Business District (CBD). The applicant is applying for the rezoning request in order to allow for the development of the proposed Sanford Agricultural Marketplace. (Exhibit M) Long-Range Planning Administrator David Montgomery informed Council that the Planning Board met on February 20, 2024, after the public hearing was held and voted unanimously to recommend that City Council approve the proposed zoning map amendment. The Planning Board acknowledged that the proposed zoning map amendment was consistent with the long-range plan designation of Downtown because the Central Business District (CBD) is conducive to pedestrian oriented mixed-use development and the area is already located in a dense grade of urban streets. Council Member Dabbs was previously recused from deliberation and vote on this item. Vote to Approve a Statement on Long-Range Plan Consistency as it Relates to this Zoning Map Council Member Buckels made ai motion that the proposed zoning map amendment is consistent with the Plan SanLee long-range plan designation ofthel Downtown Place' Type because the CBD zoning districti is conducive to pedestrian oriented mixed-use development and the area is already located on a dense grid of urban streets. Seconded by Council Member Rhodes, the motion Ordinance. Amendingthe Official Zoning Map ofthe City ofs Sanford, North Carolina (Exhibit) N) Council Member Rhodes made a motion to approve the proposed zoning map amendment for Residential Single-family (R-6) and Light Industrial (LI) to Central Business District (CBD) because the proposed zoning will allow for civic facilities, such as the Sanford Marketplace. Amendment carried unanimously. Seconded by Council Member Ferguson, the motion carried unanimously. OTHER BUSINESS Council Members extended condolences to Council Member Buckels on the loss of his sister congratulated the Southern Lee Bowling team on their state championship. Council Member Buckels thanked everyone for their support during his recent loss. 4 City Council Meeting March5,2024 CLOSED SESSION Council Member Dabbs made a motion to go into closed session in accordance with N.C.G.S. 143.318(11)(a), (3)to consult with an attorney employed ort retained by the public body in order to preserve the attorney-client privilege; and (5) for the acquisition of real estate. Seconded by Council Member Ferguson, the motion carried unanimously.
