MINUTES OF MEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, May 21, 2024, at 5:00 p.m., in Council Chambers. City Council Meeting May 21,2024 SPECIAL AGENDA for Volunteer Service (Exhibit I) Proclamation Recognizing Dr. William and Cindy Hall for Receiving the Governor's Medallion Award Mayor Salmon read a proclamation to Dr. William and Cindy Hall recognizing them for their selfless dedication to this community and the residents who live in it. Dr. William and Cindy Hall expressed appreciation for the declaration of honor and added that their ministry would not have been possible without the help ofall the awesome volunteers. A picture was taken in the lobby of Dr. William and Cindy Hall, along with volunteers and Council Members. REGULAR AGENDA NEW BUSINESS There were no items on the regular agenda. Appointment to Board of Adjustment (alsoserves as the Housing Board of Appeals) (Exhibit.) Council Member Akinosho made the motion to move Timothy Lockard from an alternate position toai full-time position (Term expires June 30, 2024) and appoint Garrison Ogdenski, Jr., to the alternate position (Term expires June 30, 2026) and waive the requirement that members can serve on only one board. Both applicants can reapply for the new Fiscal Year 2024-2025. Seconded by Council Member First Amendment to the Interlocal Agreement to Merge the Water, Reclaimed Water, and Sewer Systems Assistant City Manager Beth Kelly explained that the Council approved the merger with the Town of Pittsboro for utility systems. The effective date of the original agreement was June 30, 2024, and this amendment simply changes the date to July 1, 2024, in order for the Town of Pittsboro to be able to finalize their audit through June 30, 2024, which will create a cleaner transition. Mrs. Kelly noted that Rhodes, the motion carried unanimously. ofthe Town of Pittsboro and the City of Sanford (Exhibit K) the Town of Pittsboro has already approved this amendment. Council Member Rhodes made the motion to approve the First Amendment to the Interlocal Agreement to Merge the Water, Reclaimed Water, and Sewer Systems of the Town of Pittsboro and the City of Sanford. Seconded by Council Member Dabbs, the motion carried unanimously. Settlement Agreement and Release of Claims for Damage to Underground Utilities in Sanford, North City Attorney Susan Patterson informed Council that the North Carolina League ofMunicipalities, on behalf of the City of Sanford, has entered into a settlement arrangement with North Carolina Department of Transportation (NCDOT) regarding some underground utilities that were damaged when a line was cut between Horner Boulevard and Fields Drive. The settlement is to pay Fulcher Electric Service $9,565 for repairing this damage to the utilities. NCDOT has agreed to fully release any and all claims against the League ofMunicipalities as described in Exhibit L. The agreement requests that the Carolina (ExhibitL) City Manager be authorized to sign this settlement agreement. Council Member Buckels made the motion to approve the Settlement Agreement and Release of Claims for Damage to Underground Utilities in Sanford, North Carolina. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. 2 City Council Meeting May 21,2024 DECISIONS ON PUBLIC HEARINGS There were no cases for decisions on public hearings. Mayor Salmon recessed the meeting at 5:21 p.m. and reconvened it at 6:00 p.m. for the scheduled public hearings. CASES FOR PUBLIC HEARING: Consider to Take From the Table Public Hearingon the Application by TMTLA Associates to rezone two (2)parcels totaling 8.59 +- acres owned by Jeffrey T.Myles located at 3310 & 3314 Keller Andrews Road (SR 1154)identified as Lee County Tax Parcels 9632-82-979-00and 9632-82-6535-00: as depicted on Tax Map 9632.04 from Residential-Mixed (R-12)to the Keller Andrews Towns Conditional Zoning District to allow the site to be developed as a 69-unit townhome community. (Exhibits M, N) Mayor Salmon noted that thej joint public hearing for this rezoning request was tabled on April 16, 2024, to allow the developer time to meet with area residents regarding traffic concerns, and therefore, entertained a motion to take the case: from the table. Council Member Rhodes made the motion; seconded by Council Member Ferguson, the motion carried unanimously. Mayor Salmon asked Zoning Administrator Amy McNeill ift there was a quorum for the Planning Board. Ms. McNeill replied there was a quorum present. Mayor Salmon opened the public hearing. Zoning Administrator Amy McNeill presented details of the rezoning request as described in Exhibit M, and noted a correction from the prior public hearing, which indicated that the townhome lots are 2,000 square. feet in size; however, they are actually 1,900 square feet because the right-of-way was widened from 501 feet to 55 feeti in ordertor meet City standards. Ms. McNeill read an email that she received from the property owner, Mr. Jeff Myles, requesting approval oft the project as described in Exhibit N. Mr. Rob Bailey, residing 1611 Jones Franklin Road, Raleigh, North Carolina, reminded Council that at the last meeting, he committed to meeting with Lee Christian School representatives in an effort to find solutions to the issues that were presented at the public hearing. Mr. Bailey met with Lee Christian School Headmaster Andrew Rickaball on April 30, 2024. Mr. Bailey explained that this meeting was cordial and they discussed the details of the proposed six-foot tall fencing along the property line, which would address trespassing safety concerns, as well as installing cameras outside. He offered aj possible solution to the traffic issues, which included the concept of"double stacking" pickup lines. He noted that his engineer wowed the school representatives with thei idea ofusing the current facility and double stacking vehicles entering the drop-off area, and he offered to help Mr. Rickaball within reason. Mr. Bailey noted that Mr. Rickaball tried the double-stacking method during a regular child pickup period and was persuaded this method would work. Mr. Bailey indicated that he feels the school is considering implementing the double stacking in the next school year, which will help mitigate the problem of getting cars off Keller Andrews Road. Mr. Bailey mentioned that he met with North Carolina Department of Transportation (NCDOT) and discussed the double stacking concept at Lee Christian School. He added that NCDOTwill meet May 30, 2024, and the double stacking concept will be a topic of discussion. He noted that there are going tol be additional improvements occurring at critical areas on US Highway #1 by NCDOT and he will continue to work with the school in resolving issues. Counçil Members Rhodes and Mayor Pro Tem Akinosho commented on the excellent quality of communications Developer Rob Bailey has had with Lee Christian School in resolving issues. With no one else requesting to speak, Mayor Salmon closed the public hearing. 3 City Council Meeting May 21,2024 Application by Harrington Propertieso ofNC.LLCtor rezone 3.54 +- acres with frontage on Cooper Street and Bragg Street, identified as Lee County Tax Parcels 9652-39-2131-00.9652-38-1960-00. and a 1.76 acre portion of 9652-38-1810-00 (developed with a house addressed as 802/804 Bragg Street) as illustrated on Tax Map 9652.06. from General Commercial (C-2)and Residential-Mixed (R-12)to the Townhomes at Palmer Court Conditional Zoning District to allow the development of a townhome community. (Exhibit 0) Mayor Salmon opened the public hearing. Zoning Administrator Amy McNeill reviewed the proposed conditional zoning map amendment request as described in Exhibit O. She explained that this] proposal was reviewed by the Technical Review Committee (TRC) and they were amenable to moving forward with this project. Jeremy Thomas, with J. Thomas Engineering, 143 Charlotte Avenue, Sanford, North Carolina, noted that Brandon Harrington is the property owner and will be the developer for this project. He added that this will be the third townhome project his company has done in the Bragg Street area. Mr. Thomas noted that homes in this project will face the proposed roadway, with typical city curb, gutter and sidewalk requirements. With noo one else requesting to speak, Mayor Salmon closed the public hearing. The Planning Board retired to the West End Conference Room. OTHER BUSINESS Council MemberTaylor: mentioned it wasa an honor to participate in awarding 30: scholarships from the ABC Board. He mentioned that several local people were honored at the recent CMA Awards, including Taylorl Phillips, Cody Johnson and Lainey Wilson. In addition, Scott Forbes was named as ACC coach of the year. Council Member Ferguson acknowledged his wife Charlene's birthday today and wished her a happy birthday. He mentioned that former East Lee School Principal Robert Newby was aj participant on "The Price Is Right" show, and won the showcase showdown. He also noted that it was an honor to attend the Bragg Street Academy graduation. Council Member Rhodes echoed Ferguson's comment concerning Bragg Street Academy Mayor Salmon mentioned that this is Public Works Week and thanked Public Works employees for always serving our citizens. She reminded everyone that the Kiwanis Park splash pad is now open. graduation and wished Charlene Ferguson al happy birthday.
