The Tax Office is also looking to ask the Board to adopt the schedules on December 5, 2022. Chairman Smith opened the public hearing at 6:25/ p.m. No one spoke in favor or in opposition. VI.A Approve the attached agreement with Outreach Mission to appropriate $315,000 County Attorney Whitney Parrish noted that the Board voted to appropriate $315,000 at its March 7, 2022 meeting. It was determinedi that the best way to provide the funds to OMI is through an agreement whereby the County will pay OMI in quarterly installments over an 18-month period for their services of providing help to homeless individuals, housing, and emergency: shelters. The agreement is to uset for homeless services available within the agenda packet. NEW BUSINESS VI.AI Life Springs Dream Center Request for Funding Pastor Dale Sauls and Pastor Daniel Owens presented the Board with a request for funding for the Life Springs Dream Center. Pastor Sauls noted that Life Springs Church has served the community for 42 years now and has multiple campuses. With all of the growth, Life Springs feltt the church needed to develop a 501c3 called the Life Springs Action Team to starta a Dream Center to help with homelessness and mental illness and that Lee County could benefit from a center. The Life Springs center willi focus on preventing human trafficking, education and therapeutic activities, and community building. Pastor Owens will lead the initiative. Commissioner Sharpe asked how clients would be referred out. Pastor Owens said that with their case management process, they identify the issues and work with individuals to assess their needs and refer them out tot the appropriate resources. Life Springs is looking for a building for the center. Commissioner Smith asked ift the County could use ARPA funding for the project, $500,000 over three years, andi ift the County also gets opioid settlement funding, how much of the settlement can we earmark for this project as well? County Attorney Whitney Parrish said we'd have to look at the specific services Life Springs is offering under the Memorandum of Understanding related to the Opioid settlement funds; however, there is no limit to how much oft the funding can be allocated. County Manager Dr. Crumpton said the Board has set aside $ 1.51 million in ARPA funding for mental health and we could use $500,000 ofitf for this request. Commissioner Reives said this is quick turnaround. and we' ve had other requests from non-profits that could not be funded because oft the cap. He said there has also been no discussion about this request previously and itis a three-year commitment. The cap is in reference to requests from our general fund. Dr. Crumpton said that we've treated the ARPA funding differently, and gave $315,000 oft thet funds to OMI. We have had requests from other non-profits that were not funded, such as the Salvation Army Day Center, because of the amounts. Commissioner Carver asked for a point of order on the motion to table = can you discuss the motion to table? He recommended to vote no on tabling the motion to approve and to proceed with voting on the motion. Commissioner Lovick is concerned that there have been other non-profits that were capped and would like a little more time to review the request. Commissioner Sharpe supports the project, but supports tabling it to discuss iti further. Joyce McGehee asked for the Board to consider: a classification and pay study. In late 2019 ande early 2020, a pay study of all Lee County positions was conducted. Changes were made; however, the pay study was not completely funded in the 20-21 budget, the 21-22 budget or the 22-23 budget due to the costs of completely funding the pay plan. The goal is to have the pay study completed by March for the budget. Mrs. McGehee recommends approving the pay study. Commissioner Sharpe askedi is there any difference between this pay study and the last? The lasts study was in 2019 and since then, another county close to us has given raises for the past twoy years. Mrs. McGehee said private sector jobs would also be looked at. The pays study is necessary to retain our employees. Mr. Bhavik Patel of Comfort Suites requested to appear before the Board. County Attorney Whitney Parrish provided background to request. House Bill 753 governs this request, which relates to the act that authorized Lee County to levy a room occupancy tax. Mr. Patel's request is regarding his occupancy tax payment in August of 2022 that was late. He has paid the tax amount and he is now requesting the Board to waive the 5% County penalties. According to Session Law 1987-538, he is also charged $10/day and pursuant to Section 1(d), the Board may, for good cause shown, compromise or forgive the penalties imposed by this subsection, meaning, it's upt to the Board to determine ifMr. Patel has provided good cause shown and waive the penalties. Mrs. Parrish did contact the Lee County Board of Education, as these are funds that would be turned over to the school board, and they will leave it to the Board of Commissioners' discretion as to whether the Board finds there is good cause shown. The amount owed for the 5% County penalties is $484.20, plus the $10/day. Mr. Patel explained that his occupancy tax is due on the 15th ofe each month. For August, the Comfort Suites' room and occupancy tax was $9,000. He made a check outt to Lee County on the 14th andi it was taken out of his account on the 16th. He said there were sufficient funds in the account, so there should have been no issue. However, on the 17th, a letter was sent to Mr. Pateli in the mail, but was lost. Comfort Suites received the same letter in October. At this time, Tax Administrator Michael Brown came and personally delivered the letter. Mr. Patel checked his records andi for some reason, the check was returned and the tax office and bank did not contact Comfort Suites about this. The transaction said "refer to maker". As soon as Mr. Pateli found out, he went to the tax office to figure this out. It's now out oft the tax office and in the hands oft the Board and the City Council. He said they've always paid their taxes on time anda asks that the penalties to be waived. Commissioner Carver asked about Comfort Suites' bank. Mr. Patel said Truist is investigating this, but it could take 60-90 days to resolve. Mr. Brown said it's the full discretion oft the Board to do ast they wish. Denette Fitzpatrick in Tax Collections said these were extenuating circumstances. The tax office reached out to the bank and 7 askedi if we wanted the check resubmitted. The local branch said they had not received the check back. Ms. Fitzpatrick said this is unusual andi we reached out tot the School of Government: for guidance. The check said" "refer to maker" and that's all we were provided with. The bank couldn't give additional information and referred us back to the individual, Mr. Patel. Commissioner Sharpe asked ifa any money has been payed. County Manager Dr. Crumpton said Mr. Patell has paid the base amount of $9,000, but there is still $2,000 left ini fines and penalties. It's very odd situation, and Dr. Crumpton has never seen this before. Commissioner Knecht asked if there is a policy for this, butt there is only a policy for property tax. Dr. Crumpton said he hasn't had an issue with occupancy tax before. Mrs. Parrish said the only time she could find one was back in 2007. Work on this new project has begun with the Company beginning the process Training of drilling 4 new wells near the building. In newp phase of work, vacuum additional contaminated materiali from the ground started on November process 3rd. This will take another 15 to 30 days. At the end of this phase, additional conducted to see what material is left and then has to be removed. Incrementally testing will we are be getting close to being at a point where we willj just be monitoring the wells until we can get the letter of no further action from the State. Terraquest has asked for no further action letters on all wells on site except for the ones around the contaminated area. to remove process Multi-Sports Complex - Agenda Item. Horton Pool - This project is back moving after the change order was required permit from our Local Health Department. Demolition work is unsuitable soils underneath the bathhouse building. The contractor is approved for the with renovation of the bath house. Unsuitable soils have been removed pressing and new forward along with the rock base are being put in place. The Pool contractor has obtained soil the contractor has started to work ont the new pool construction. The revised complete and the Hale Center - Bids came in almost twice what was budgeted for the HVAC We are proceeding with the roof upgrade bids and should have this out to upgrades. Staff is concerned about the rising costs and the time it will take to bid very soon. these projects. This funding is allocated to the Area Agencies on Aging for distribution to the centers within the region which provide full time programs or will utilize the funding to develop full time programs. Across the state 170 senior centers or developing senior centers will be The Division of Aging and Adult Services has worked hard to enhance and expand the statewide certification process for senior centers with standards that encourage centers across the state to strive for levels of 'merit' or excellence!. An intent of the certification process has been to increase base funding for those who have successfully completed the process. This ensures that funding is being well spent on readily identifiable programs and services and provides an incentive for centers that make investments to meet certification requirements.
