APPROVAL OF MINUTES AND DECISIONS Mr. Smith made the motion to approve the January 23, 2024, minutes. Ms. Asbury seconded Mr. Jeff Brown made a motion to approve the Board Decision: SUP-2023-00016. VARIANCE APPLICATION VAR-2024-00001 - Evolve at North Shore LLC requested a Variance of1.78' from the 30' required front setback for an accessory structure know as garage building 4 on a 27.3-acre parcel at 1108 Red Tide Road, Stump Sound, NC known as Tax Parcel 767-9.16. Applicant/Owner: Evolve at North Shore LLC Summary of proposal: A Variance of 1.78" from the 30' required front setback for Accessory Structure known as Garage Building 4 at 1108 Red Tide Road. Mr. Carter Metcalf provided an overview oft the application. Amy Shaffer, 3414 Wrightsville Ave, spoke on behalf of the application. She presented the argument for a variance to be granted. Ms. Asbury asked ift the site plan shows both buildings being parallel. Ms. Shafer said that was correct. Mr. Smith asked when the encroachment was discovered. Mr. Michael Buckland said it was discovered during a foundation survey. Frank Green, 501 Seascape Drive. He spoke about the letter sent notifying the public about this hearing. He said the letter lacked any information and using an aerial from 2022 is not helpful. He is thankful for the Evolve project and thinks it is very beautiful. He did say the traffic congestion was bad and at times, it is at a standstill. He is chairman of an Architectural Committee, and they George Wooten, 109 Sea Turtle Cove. He is the HOA President for the Northshore County Club. He spoke about drainage issues coming into his neighborhood and wanted to know who to speak are in favor of the variance. to. It shall not be necessary to demonstrate that, in the absence of the variance, no reasonable use can be made ofthe property. Mr.. JeffBrown made an motion to approve the finding. Second General Conclusion: The hardship results from conditions that are peculiar to the property such as location, size, or topography. Hardships, resulting from personal circumstances, as well as hardships resulting from conditions that are common to the neighborhood or public, may not be the basis for granting a variance. Mr. Smith made a motion to approve the finding. Mr. Third General Conclusion: That the hardship did not result from actions taken by the applicant or the property owner. The act of purchasing property with knowledge that circumstances exist that mayjustify the granting ofa variance shall not be regarded as aself-created hardship. Mr.. Jeff Brown made ai motion to approve the finding. Mr. Roger Brown seconded the motion. The motion Fourth General Conclusion: That the requested variance is consistent with the spirit, purpose, and intent of the Ordinance, such that the public safety is secured, and substantial. justice is achieved.
