II. Conflict of Interest/Cell Phone Statement Wheatly Chairman Farrington called the meeting to order at 6pm. Commissioner Quinn led the Pledge Chairman Farrington read the Conflict of Interest Statement. He stated he would recuse himself from Item VII ont the agenda. Chairman Farrington also asked that all in attendance silence Commissioner Mansfield made a motion to recuse Chairman Farrington from Item VII. Seconded by Commissioner Chadwick. CARTERET: is responsible for all property damage to the Leased Arca that is a direct result from their operations and or the operations of any agent, contract employee, or invitee entering the premise. All damage will be promptly reported to the NCSPA and CARTERET will be responsible for repairs to the Lease deliver up, the Leased Area to NCSPA in as good condition and order as when CARTERET took possession thereof, reasonable wear and tear excepted. Upon termination of the Lease, CARTERET shall: (a) pay all utility bills or other bills due for services to the Leased. Utilities. CARTERET shall be responsible for all utilities used on the 14. Hazardous Materials Spills. CARTERET shall furnish the NCSPA with a written report detailing all releases, as defined in Subsection 101 (22) of the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (Superfund Act), P. L. 96-5 10, on or from the Leased Arca whenever such releases are: required to be reported to any federal, State or local authority in accordance with any federal, State or local laws, rules, regulations, and ordinances, and any regulations issued thereunder. Such written report shall identify the substance released, the amount released, and the measures undertaken to clean up and remove the released material and any contaminated soil or water and shall further certify that no contamination remains or will remain after the cleanup measures have been completed. Such reports shall be supplemented by providing the NCSPA with copies of any written reports required to be submitted by CARTERET to any governmental agency in accordance with any federal, State or local law, rule, regulation, or ordinance, or by the Council on Environmental Quality's National Oil and Hazardous Substances Pollution Contingency Plan as it now exists or as it may hereafter be amended. The foregoing reports to NCSPA and copies of reports to governmental agencies be sent to Chief Engineer, North Carolina State Ports Authority, Post Office Box 9002, Wilmington, North Carolina 28402, at the same time notifications or reports, whether written or otherwise, are required to be given by CARTERET to any such governmental agency. 15. Environmentall Regulations. CARTERET agrees to conduct its operation in compliance with all applicable environmental laws and regulations. CARTERET will be responsible for getting and maintaining all local, state and federal environmental, permits needed for its operation, including but not limited to, an air quality permit. NCSPALiabiIiy. The NCSPA shall not be liable for any damage or injury to any property brought upon the Leased Area or to any person upon the Premises as the agent, servant, employee. invitee or licensee OFCARTERET. except claims for damages resulting from the gross negligence of NCSPA or its employees or agents. Further, the NCSPA shall not be liable for any property stolen or taken firom the Leased. Area, CARTERET agreeing to protect and safeguard the Leased Area to its own satisfaction and reasonable attorney's fees, arising fiom any and to the risk of loss by theft. 18. Subletting. shall not assign or sublet any rights or interests under this Lease without the express written of the NCSPA. 19. Maintenancs. Maintenance of the Leased Area will be the responsibility of CARTERET. CARTERET will make needed repairs promptly and without notice by NCSPA; provided, however, any failure to make repairs in accordance with this section 16 shall not constitute a breach or default hereunder unless and until such failure continues for thirty (30) days after written notice firom NCSPA of the need for such repairs. 20. Alterations and Improvements. No alterations, additions, or improvements to the Leased. Area shall be made by CARTERET or its employees or servants without prior approval by the Director of Engineering and Development for the NCSPA, said approval not to be unreasonably withheld. AIl alterations, additions, or improvements made by CARTERET with permission of the NCSPA or by NCSPA upon or to the premises, except for movable fixtures installed at the expense of CARTERET, shall be the property of the NCSPA, and shall remain upon and be surrendered with the premises at the termination oft this Lease. NCSPA has caused ai fence to be constructed: from) Marine Drive to the water's edge on the north and south boundaries of the Premises, and along Marine Drive. NCSPA has also caused a gate to be constructed at the intersection of Marine Drive and the road providing public access into the Premises. Such fencing and gate are: shown on the attached Exhibit A. Maintenance of the fencing and gate will be the responsibility of CARTERET. Should the CARTERET fail to maintain the same in good order and repair, and after ten (10) days notice by NCSPA to CARTERET, NCSPA may maintain or repair the fencing and gate and CARTERET agrees to reimburse promptly the NCSPA for any expenses thereby incurred. CARTERET shall have the right to construct permanent improvements on the premises, consisting of roadway, parking facility and public restroom facilities. In the event that NCSPA determines the need to terminate this lease, NCSPA agrees to reimburse CARTERET for the cost of such permanent improvements in the amount of Carteret's original investment costs for such improvements based upon 20 years straight line depreciation which shall be computed up to the date of the termination. For the purpose of 871 this computation, the original CARTERET costs shall not exceed One Hundred Thousand Dollars ($100,000.00). There shall be no reimbursement for costs not borne by CARTERET. 21. Insurance Requirement. will maintain in force at all times during any term of this Lease, comprehensive public and legal liability or indemnity insurance applicable to the Premises and CARTERET's operations thereon for limits of liability of not less than One Million (51,000,000.00) Dollars per person and One Million ($1,000,000.00) Dollars of not less than Ten Million ($10,000,000.00) Dollars per occurrence with respect to damage to the property of others, including the NCSPA. NCSPA must be listed as an additional insured under all policies and NCSPA will receive notice. of any cancellation. All vehicles parked on or traveling across NCSPA property must have vehicular liability insurance at least the minimum per for injury to persons, including death resulting therefrom, and an aggregate limit coverage allowed by North Carolina Law. 22. Default. IFCARTERET shall neglect to make payment of rent or other documented charges owed to the NCSPA on the date due or neglect to do any other matter or thing herein agreed to be done and performed by it, and shall remain in default thereof fora period of seven (7) days after receipt of written notice from the NCSPA calling attention to such default, the NCSPA may declare this Lease terminated and canceled and take possession ofthe Leased Area without prejudice to any legal remedy it may have on account of such default. 23. Taxes. The NCSPA is exempt from State and Federal excise taxces. Any taxes levied or assessed to CARTERET resulting from leasing the Leased Area pursuant to this Agreement or the actions of CARTERET shall be the sole responsibility of CARTERET. 24. Association. The Lease Agreement shail not be interpreted or construed to create an association, joint venture, fiduciary relationship or partnership between the NCSPA and CARTERET or to impose any partnership obligation or liability or any trust or agency obligation 25. Commissions. CARTERET warrants that it has not paid, and agrees not to pay, any bonus, commission, fee, or gratuity to any employce or official of the NCSPA or the State of North Carolina for the purpose of obtaining this lease. Upon request, Customer will provide records sufficient to verify the accuracy of the annual report. 8.0-ORDERING, ADMINISTRATIVE PROCEDURES, DELIVERY, AND DEPLOYMENT 8.1 Orders, Delivery, and Deployment Upon the Effective Date, Esri will invoice Customer and provide Authorization, Codes to activate the nondestructive copy. protection program that enables Customer to download, 9.0--MERGERS, ACQUISITIONS, OR DIVESTITURES If Customer is a commercial entity, Customer will notify Esri in writing in the event of ()a consolidation. merger, or reorganization of Customer with or into another corporation or entity; (i) Customer's acquisition of another entity; or (ir) a transfer or sale of all or part of Customer's organization (subsections i,, and lt, collectively, referred to as' "Ownership Change"). The email states: my husband and I are both retired Federal Employees. In 38-years of service in the Department of Defense, and a combined 10-years of military service to this great nation in the Marine Corp. Ineed now to ask for your assistance with an on-going matter that affects our community, safe navigation of its waterways, and the environment. Ihave attached a photo of a derelict and abandoned boat in Brooks Creek Marina. It has been abandoned 3-years since early 2021. The vessel is very large and has hundreds of gallons of fuel ini it. It is rusting and degrading, and posing a hazardous impact tot the surrounding coastal environment, as well as impacting the safe navigation of the waterway. Every new storm or high tide is concerning because if the boat moves it can crash into the docks causing thousands of dollars in damages. Iffuel spills, an environmental hazard will affect all of the surrounding coastal communities. Currently, lam aware that finding an authority from the North Carolina Federal Assembly exists that funds the inspection, investigation, and removal of abandoned and derelict vessels that are associated with either Hurricane Florence or any other past storms, and is available to address the issues that we need addressed in Harkers Island. Which is again inspection, investigation, and removal of abandoned boats. Abandoned and derelict vessels aren't just in Brooks Creek, they appear off the New River Bridge and other locations. My concern is that because we don't have aresolution in our area that addresses this issue, that we will become a dumping ground for abandoned/derelict boats by owners who anchor boats wherever they want without any concern for safety or environmental impacts. Ifone is not already in the process of being drafted, la am requesting that the Board of Commissioners draft a resolution that addresses abandoned and derelict vessels in Carteret County similar to the resolution drafted and passed in Brunswick and Dare Counties, if one has not already been drafted and submitted for the removal of abandoned and derelict vessels in Harkers Island. Beaufort, NC drafted, submitted, and was approved for funding that helped to remove three abandoned and derelict boats that washed up on the Rachel Carson Reserve. We need to take similar action sO that Carteret County does not become a dumping ground for abandoned and derelict boats. When a resolution is enacted, it provides the local and surrounding communities with clear guidance on what is allowed and actions that can be taken to address and remedy those situations. Ihave reached out to the State, butl lwant to start locally because we all have a vested interest. It takes all of us to be concerned about what is happening. Iwant safe, clean, and navigable waters for everybody. Kerry Smith, 662 West Beaufort Road, Beaufort. lam here today to address number 6 on the consent agenda, which is the lease for the old church building at the corner of Turner and Broad Streets in Beaufort. It appears that on the agenda, the lease which originally was for only one year at a cost of $1000 per month is set to be extended for only four months until the end of June. Ihave been a realtor in this town for 29 years. Ihave sold property and managed rental property for all that time. It was disclosed to me personally two weeks ago by one among you that the rent was going to increase by 200% or the fair market value. Fair market value is based on comparative analysis. So, Ihave never had a rental property, either commercial or residential, to be increased more than 15% over five years, which is tied to the consumer price index. Checking today, the inflation rate for 2023 was 4.27%. To increase the rent for the Beaufort by the Sea Community Church 200% is unconscionable in my opinion. So, lam asking you to extend the lease indefinitely on a month to month basis at the original price not to exceed each year an increase of the consumer price index or at the most 5% per year. Thank you. 883 Pam Richmond, 105 Crescent Drive, Beaufort. Ihave been conducting NarAnon meetings at the Peer Recovery Center. NarAnon is a group that is dedicated to helping families and friends of addicts. Ifsomebody loves an addict, their life becomes chaos. The people who love an addict are sicker than the addict because their whole focus is on that person. When somebody is ini that much chaos, everything about them; their emotions, their spiritual life, their mental and physical health, everything is affected by this chaos. NarAnon is dedicated to helping these people, not to cure the addict. Ithelps these people achieve a happy life and get rid of the shame, guilt, and embarrassment. Everybody deserves happiness. We have been meeting every Tuesday night ini the Peer Recovery Center on Bridges Street. It has been marvelous. We have been there about 10 years, it has been a welcoming place up until ai few years ago. We came in one night and found out that the door tot the room we had been meeting in was locked, along with all of our materials that we used during our meetings, with no explanation. We muddled through and met in a big open area. Now, I have toi tell you that anonymity is one oft the must important tenants in our meetings. We don't need people wondering in and out. When you are in an open lobby, that can happen and has happened. With a little bit of complaint, we got the room back. Next thing we know we have got a two hour notice that the room was going to be locked, again we had to muddle through. Then we were kicked into a small room that was too small for the 15 people that were meeting that night. Then we got put back out into the big room. We have been knocked around for the last couple of years, and treated with al lot of disrespect. We have 81 members. We have an average of 15 people who meet every Tuesday night. The first week in February we were told, you have to be out of the building by March 1st. That sent us scrambling for a place to meet. We only want an hour or sO in a consistent environment, a private environment where our anonymity is protected. Hope Mission is a fantastic organization but they have really treated us with disrespect. No forewarning that they were going to turn this building into an office building instead ofa welcoming place for people who are having problems. We have already found a place to meet. One Harbor Church has been very open to us and letting us meet there. The reasonlam coming to youi is to make you aware of two things. One, that we have these meetings. They are important. Two, is to let you know what is happening with a County building. The Peer Recovery Center is a County-owned building. Awareness is why I'm here. I know Commissioner Farrington and his mother is who started the Peer Recovery Center, Bev Stone. When it started it was just a beautiful opportunity to come and feel comfortable, it offered classes, it offered all kinds of meetings that could be held there. found an article where Hope Mission took over the operations, but they were calling the building the Bev Stone Building. Ifeel confident that her intent was fori it to be a community building for all kinds of recovery opportunities. They have Peer Recovery Specialists. Iwent through that class to become a Peer Recovery Specialist. They had. AA there, Narcotics Anonymous, etc., and from whatlu understand they are not going to be able to meet there anymore either. With all due respect to Pastor McLendon, I know that Hope Mission does a fabulous job in our county, but they also have a lot of support from our county. But, this is a County building, andlam really sad that nowi it's lost its original intent of a community building. Hope Mission is a great program, but it is not all of the recovery programs in our county. When people can't get to their meeting or don't know where the meeting is, that could be life or death. It is critical tol know that you have got a consistent place that you can go to, where you feel comfortable and is welcoming to you. Ijust think this is a big loss. Iknow you all have gotten three messages from me in the last week, and Commissioner Chadwick is the only one who has responded. Iwant to find out what the arrangement is with Hope Mission. Are they paying big rent, then we have turned it over to them. But if they are not, then It think we need to rethink what is offered there. 884 Bryan Nicklow, 1502 Salter Path Road, Indian Beach. My comments are about the opposition tot the use of election voting computers in our county. But before I start with that, Iwould like to say that Iwent to the Board of Elections meeting the other day and $ specifically talked to them personally. Isaid when I talk about my opposition to the procedures here in Carteret County that pertains to election computers, la am not impugning their effort. I'm not impugning the Board of Elections Director, staff, or the poll workers. As a matter of fact, some of them are the most professional people I have ever dealt with. I'm here talking on a constitution level. Here are my points regarding my opposition. Ithink the election computers have security vulnerabilities. I think they have a high cost of purchase and maintaining. Ithink the administrative and logistical challenges related to the computers are cumbersome. When the Board of Elections came to our meeting in Indian Beach, the process that she explained that she had to go through to even set-up these computers is ridiculous. As a matter ofi fact, we went to the meeting where we were able to view absentee ballots, the machine was still printing off tape at the end of the meeting. You look at all of this tabulation, and it makes no sense. We need to get back to hand counts. The paper ballots are ran through tabulators, and these tabulators are vulnerable. There is also a lack of transparency. The fact that a third party has unconstitutional, unaccountable roles in the citizens' election process and are not obligated by a FOIA request from me as a citizen as to their process and procedures. Their software is proprietary. Also, the Board of Elections has hand count procedures. For example, say something happens to these machines, do we have al hand count process. Ihave asked the Board of Commissioners to require an alternate plan for hand counts in writing. Our elections should not be interfered by these machines. Purchasing these machines; the DS200 costs $200,000, the Express Vote Machine costs $224,000. The maintenance oft the machines is $37,000 annually. Machine storage is $17,000 annually. The rental vehicles used to move these machines around to the various polling places is $7,000. Let's get back to simplified living, and let's have confidence in our elections. France does single day paper ballot hand counts and have the results at the end oft the night. The whole country. Until we fix 2020, I don't think we are going to vote our way out of2 2024. I'lI finish up by saying anythinglsay about elections, I don't want it to deter people from being involved in the voting process. Show up to the polls and vote. We are in the early voting period now. March 5th is the primary election day voting. Wrap up with two awareness issues, be aware that we have political prisoners ini this country and human trafficking. Research whatlsay. Ihave been here since Linda Clay was on this Board, which was a long time ago, my friend has visited me here several times. llove Carteret County, I love to live here and being a part of the community, and Ihave not personally had any bad instances. But my friend was watching Netflix and she saw what is going on with Silver Dollar Road. Ifeel remised that it is not being addressed. There is no remedy for it, this happens all over. My issue is someone being locked up for $400,000 dollars over eight years. That is the longest time anybody has ever been inj jail for civil contempt. The longest time int the country. The soul of America is what makes us unique. Among all nations, we are the only country founded on an idea. The idea that we are all created equal. We deserve to be treated with equal dignity throughout our life. Why we still grapple today with the moral sin of slavery, our country's original sin, we never walked away from the fight. Throughout history, Black Americans have never given up on the promise of America. They have fought for centuries against slavery, segregation, and injustice. They have helped redeem the soul of our nation insuring the promises in our founding document. We are notj just words on a page, but a lived reality for all people. Int the process, the vibrance of black history your service. 885 and culture has enriched every aspect of American life. That was taken from Joseph Biden. I just want you toi imagine your son on the street corner with someone kneeling on his neck for nine minutes and he is screaming for his mother. Iti is a tragedy, that we all share. This has to Chairman Farrington said just to make it clear that we appreciate everyone who has spoken tonight, we don't speak back to the issue. We will look at all of these, and just want to make change, and I thank you for your time. sure you are all aware of that. VI. County Attorney Chairman Farrington opened the floor for any discussion. Commissioner Cavanaugh stated he brought this up at the last meeting. Ivoiced my whole opposition to the proposal to replace our attorney. Since that time, Istill haven't found a valid reason to justify why our attorney, Mr. Wheatly, needs to be replaced. lunderstand his contract ison a month by month basis and he has been our attorney for over 35 years. That is a long time. But he hasn't made any mistakes that I am aware of. He has always fulfilled all of his duties and obligations. lam opposed to replacing him at the current time. Commissioner Wheatly stated the County Attorney was hand delivered a letter from the Board, unsigned that actually terminated him. I'I read the statement "that being said, the Board by consensus (Commissioner Wheatly stated consensus means that it is an agreement that the majority of the Commissioners made outside of a meeting), has decided to terminate our legal relationship effective January 1, 2024." That was a month and 19 days ago. You don't see anybody sitting over there tonight. Since that time, I have checked and there has been no other letter to counter that letter. So, the County Attorney assumes at this time that he has been terminated being there has been no other letter written or delivered stating otherwise. Amlright oramlwrong? Commissioner Cavanaugh stated we need an attorney opinion on that. Chairman Farrington stated the County Attorney is being paid at the present time. Vice-Chairman Mansfield said there has been no official action taken on the County Attorney, that's why it's on the agenda this evening, and an unsigned letter, I can write a check, a million dollar check for someone here tonight and not sign the check. When you go to cash it at the bank you are not going to get anything. That letter, I don't know how or what it was, but that never had his [Farrington] stamp on it and nobody else signed the letter. So, that's what we are here to discuss tonight. Commissioner Cavanaugh asked why was it even sent. Vice-Chairman Mansfield stated he doesn't believe it was sent. To the best of my knowledge, I was told that someone from his office went and picked it up. My question is how did he even know there was a letter. Commissioner Cavanaugh said it was delivered to him is my understanding. Vice-Chairman Mansfield said I don't think that is correct. 886 Commissioner Wheatly said that he believes that it is correct. Ibelieve that Mr. Farrington and Mr. Shinn both called me and told me that they had made a decision to terminate the County Attorney and that they were going to send a letter to him and spoke with Ms. Turner and she was told to mail the letter and I had called my brother who is the County Attorney and told him that a letter was on the way to him, and he had his secretary, Stacie Cape, call Ms. Turner and Ms. Turner delivered the letter to them. This letter was a result of a consensus that Mr. Chadwick, Mr. Shinn, Mr. Farrington, Mr. Mansfield, and Mr. Quinn all agreed to. That's how the letter came about. There is no point in denying it. To send an unsigned letter, Ihave even heard the explanation that it was a draft letter, well would you send a draft letter to a man to review the letter that's terminating himself. That is just foolish to even put that out there. Here is a copy of the letter. It is unsigned. To Mr. Mansfield's point, it is unsigned. But to say that it wasn't an official letter, well he is not sitting there. He is gone. You terminated him. You terminated him in violation of the contract that we signed. The contract I have right here also. The contract calls for 60 days notice. He wasn't given 60 seconds. And, just the fact that you would terminate someone, here is the 19th of February and to terminate someone on the 20th day of December before Christmas, and we could have all this time to do so, and nobody went to my brother and explained to him what the situation was and told him. He would have stepped away, helped you find another person to take his place. The County has ongoing cases right now, the Greenbox case, the case with the librarian, there is other stuff going on and we don't have an attorney. We need one here tonight, but we don't have one. Because this thing was bungled up and it needs to be straightened out, and it needs to be straightened out tonight. Chairman Farrington stated he would take a motion determining if this Board would like to Commissioner Cavanaugh asked if he is making a motion to terminate him. Chairman Farrington responded well we have got to straighten it out. Chairman Farrington asked if there were any other comments. continue the contract with Attorney Wheatly. Commissioner Cavanaugh said Iwould like to have a reason why he is being terminated. Commissioner Chadwick stated he would like to make a motion to discontinue the legal contract with the Wheatly Law Firm pursuant to our agreement. Chairman Farrington said, and that agreement being that he is paid for 60 days. Commissioner Chadwick stated, correct. Just like he has been paid for the past 60 days. Commissioner Cavanaugh asked if he could read the part of the contract that deals with the Commissioner Chadwick said he did not have that ini front of him. Commissioner Wheatly Commissioner Chadwick continued, it said to the effect that we give him 60 days notice. Commissioner Cavanaugh stated he wanted to hear the actual language. Commissioner Wheatly state he had the actual language. He read the following: "This agreement can be terminated by County or Wheatly upon 60 days of notice to the other. Until it termination of service. What is the verbiage ofi it. stated he did. 887 is terminated, the engagement of Wheatly as attorney for the County shall continue indefinitely." That's what the language of the contract says. It was signed Commissioner Mansfield. Commissioner Cavanaugh responded thank you. Commissioner Shinn stated, Mr. Chairman, It think as the motion was stated, that he will be paid for 60 days from here out. Ithink that is compliant with the contract, and II second Mr. Chairman Farrington said alright, then asked if anyone would like to discuss this further. Commissioner Wheatly replied, I would sir. This agreement that was made to terminate the Vice-Chairman Mansfield replied, well I'm not sure about any meetings, Iwas not here in December. Iwas out of town, but there has not been a decision made. There is a motion on the floor right now to not renew the contract and there is a second and there is discussion, but he has been paid for January, he has been paid for February. He has not been dismissed. I actually went and sat down with him at his office. He and I went over that. He understands that, whether he chooses to be here or not. lapologize for the way this has all happened. It has not gone down the way it should have. But that has not been my fault. Commissioner Wheatly, technically you probably should be recusing yourself from this matter, but Iknow the rules are just for some of us. He hasn't been fired. He was paid in January. He has been paid in February. Right now the discussion is are we going to continue to use him. Commissioner Cavanaugh you had a question as to a reason, but for Lori, Tommy Burns, or for the County Commissioner Wheatly stated this meeting that started this termination letter was done at Cox's restaurant. A secret meeting. We as a Board should never allow secret meetings to be held or done. We should not operate like that. We should always operate out front. Ms. Turner, our Clerk, did not write this letter on her own. Ms. Turner was instructed by the members of this Board, certain members of this Board, to write this letter. She did not write it on her own and go down to my brother's office and give it to him. She was told to do that. We need to come clean Chairman Farrington stated, well Mr. Wheatly it's clear, I'm not going to speak to the insights of this situation because I don't have to. You know yourself that three Commissioners can communicate. That is such a non-issue. The letter, what it all boils down to what my statement is, is Claud Wheatly is one of the finest attorneys in Eastern North Carolina. We made that clear. He has done an awesome jobi for this county. Iffour Commissioners on the Board, or more, want to look at hiring another attorney, we are allowed to do that. We are allowed to have ac conversation. You know good and well we are allowed to that. So, I'm not going to get into the innuendo, with all the talk about this said, and that said because it's, I'm not going to say it's not true, it doesn't make any sense at all. We are allowed to have a conversation among ourselves. We do it as part of the practice of what we do. We are not always at this table. We talk about things that are coming up amongst ourselves but never more than three commissioners. So, there are no secret meetings. Iwill make that very clear. There is a Commissioner Wheatly stated he would like to say something else iflcould Mr. Chairman. The meeting that I'm referring to ended up with five Commissioners. You said that you could have a Chadwick's motion. County Attorney, where was this meeting held? I'm not disputing the fact the Board has the right to terminate the County Attorney. I'm just saying that the way that they went about it was dirty pool. But to handle it the way that you did, but to have a meeting and then to say it was only three people but you come up with five votes, even if two of them were over the telephone, don't think that is quite kosher as to the open meeting laws to have five when you can only have Chairman Farrington stated he would agree with that, but you are carrying me into this, sO I'm going to go ahead and tell you what happened. Commissioner Wheatly said please do. Chairman Farrington continued, there were three people who met at Cox. That has already been stated by Commissioner Cavanaugh in his comments that he read last month when I was not here. But in the whole process of doing what we are doing, and again I don't want to offend anybody especially Mr. Claud Wheatly, but ini the process of doing this as Commissioners, we have his brother on our Board. No big deal, we have had that for eight years now. But, Ihad to contact you. Idid it with Commissioner Shinn and I think we will leave it at we know what happened on that phone call. That phone call ended with you calling your brother. It's kind of hard to go sit down with someone when you have that situation. I'm sorry it's that way but it is. That is what happened. That's the truth. Believe me, Iwas on vacation last month, andls sat there the whole time wondering why I probably should not have contacted you then I would have been in another hornet's nest because you are a Commissioner. Ifeel like I did what Iwas supposed to do when I contacted you along with Commissioner Shinn on the phone. So, to do it all over again, lwould have walked into your brother's office and would Iwould have told him to his face. Commissioner Wheatly stated that is what you should have done. Chairman Farrington continued and I wish I would have done that but Ic could not have done that without contacting you first and it didn't work out that way. So, all said that's what happened. That's what went down and we have got a motion and a second and Iv would like to get it over with. Commissioner Cavanaugh asked who seconded. Commissioner Shinn replied that he did. Commissioner Wheatly stated he would like to say something else first please. When If first ran, one of the things that popped into my mind was the possibility of a conflict of interest. I contacted the lady at the Institute of Government, and Ia asked her about a conflict of interest. I wish Mr. Burns was here tonight. He knows very well what I'm talking about. The way she explained it to me, a conflict of interest results when there is a monetary exchange of something of value like a job, position, land, etc. That transfer between two people who are connected, that is what you call a conflict of interest. Today, Icalled a lady by the name of Kristina Wilson, she is a professor of government at UNC. lalso have her telephone number if anybody would like it. There was a letter in the paper written by Ms. Smith saying in her opinion it was a conflict of interest. You can call this lady, she will explain to you what a conflict of interest actually is. There is no conflict ofi interest between my brother andlb because there is no monetary exchange of any kind of value. That eliminates the term of conflict of interest. As far as when the discussion was made, I was excluded from the discussion. lam an elected official of District 5. Ishould have been involved ini that discussion but I was not. Iwas called on the telephone by Mr. Shinn and Mr. Farrington and Iwas told the decision has already made to terminate my brother and they were going to issue him a letter. That is what Iwas told. That contradicts what you said about no knowledge of the letter, sO forth and so on. The letter was not created by Ms. Turner, the letter was created by the people on this Board. That letter was wrong, and you need to admit to it because the people out there realize what you have done. You have opened a can ofv worms, and now you have got to cover it back up. What you did was wrong. This Board has the right to terminate the County Attorney at any time, but there is a way to do things and there three in a meeting. Would you agree with that? 889 is a way not to do them. You don't treat someone who has given as much service as he has given to this county like a dog and send him a letter four days before Christmas and tell him he is terminated and give him no notice. None, zero. You don't do people like that. At least I don't do people like that and I didn't expect for any of ya'll to do that either. Thank you, Mr. Chairman. Chairman Farrington said thank you sir and I don't agree with our conversation on the phone but Vice-Chairman Mansfield stated for the record, you can't keep repeating a lie over and over and make it the truth. Itj just doesn't work that way. Commissioner Wheatly replied, that is what I'm trying to tell you. Vice-Chairman continued, there was no illegal meeting. Igot called on the phone the same way you called. That doesn't make it illegal. For that matter, if you didn't bully and do everything that you did, we wouldn't be in this situation today. You know what you have Iwill leave it at that. done and we are trying to take the high road and IV will leave it at that. Chairman Farrington asked that the motion be repeated. Commissioner Chadwick stated that we are going to discontinue the contract with the Wheatly Law Firm in accordance with our agreement following the letter of the law to a tee. Commissioners in favor of the motion were Chairman Farrington, Vice-Chairman Mansfield, Commissioner Shinn, Commissioner Chadwick, and Commissioner Quinn. Discussion on the Jail Diversion Program between Hope Recovery and the Sheriff's Office Pastor Gene McLendon stated, in 2021 we approached the Sheriff about creating a jail diversion program. That has evolved into a 40 bed program that stays full. 20 of those participants are out oft the Carteret County. jail. Our entire team is all in recovery, with Pastor Gene stating he has been clean for twenty-seven years. The Sheriff determines those that can come live with us. We provide all services (medical, housing, etc.) We hire internally. There are 23 employees now. They come out of homelessness or drug treatment programs. 80 people walk through the Peer Recovery Center daily. We have a professional Clinician. The Sheriff's office is always there to help us. We meet with Asa every month. We had 101 clients last year. 80% completed the first 90 day program. Our program costs an average of $40 a day VS. $55 a Sheriff Buck echoed what Gene talked about. Iti is a fantastic partnership. Carteret County is a recovery county. In 25 years, people have said there is no help here, but it is just they have to know where to go geti it. We have more resources than most. We have done a loti in recent years. The PORT Team, the new facility in Sea Level, etc. Programs include an electronic monitoring program that has morphed into recovery from substance abuse. Most offences are tied to alcohol and drugs. There is a 64.4% completion rate from this program. 63% success rate for not reoffending. Ithink we are doing great work. We are getting people out of our jail. This past year we received a grant for the opioid blocker program. We have been working with Dr. Kerry Willis on this program. It started April 2023. We have 21 participants. 6f failures, but 5 of those were in the program only shortly. 2008 is when the electronic program started. It keeps people from sitting in ourj jail receiving no services. We saved over $200,000 after all costs. Our jail has a 116 bed capacity. 70 people are currently out on monitoring. Now we have 131 in our beds. Commissioners Comments Commissioner Shinn stated he wanted to thank everyone for coming out and for the comments made during public comments. Hopefully the derelict boat issue will be taken care of shortly. He thanked Brooke and the PORT Team for their efforts. Also thanked Pastor Gene and Sheriff Commissioner Cavanaugh thanked. everyone for coming out. There is a countywide effort to solve the drug problem, but he wants to see it below the state average considering we are a rural and law-abiding county and mostly a retirement county. He worries about the Narcan program; seems like a safety net. Thanked Dr. Williams, Brooke, Sheriff Buck, and everyone working to solve the drug problem here in our county. He is looking forward to the Sea Level Vice-Chairman Mansfield reiterated the others comments and thanked County employees. Commissioner Wheatly stated the Beaufort by The Sea Church lease was extended for four months, and what they have done to that building is phenomenal. That church has built a following of over 130 people. We should do what we can to help the pastor continue to grow that church. This was a tough meeting to sit through. Ihave tried to take the high road. My brother wasn't fired because of anything that he did, it was to get to me. Rob would have worked out a time to leave and helped the new person with the transfer, but the goal was to take a shot at me. Secret meetings saying it was a conflict ofi interest is not true. My daughter-in-law sits on the school board but sO does Chadwick's wife. In a small county it is not unusual to have family sitting on boards. There are a few people who wanted to make a political gain off of my brother. But they don't know him very well; it does not keep him up at night. They don't know me very Buck. We raised $15-$20,000 in each boy's name; there will be $2,000 scholarships at East Carteret High School. We are working on ditches. We are half way through our communities. Beaufort by the Sea Church I support, would like to see the County sell them the building. The Pruitt facility is opening tomorrow. Sea Level opening soon. Several tornadoes hit Atlantic, and the State did not pick up all debris. County stepped up to get that picked up. We are moving the county forward. Commissioner Quinn offered condolences for Tommy's family. He thanked the PORT Team, and all those that came out. The drug epidemic has touched his family personally. He also reminded everyone that as a History Professor we should recognize Black History Month. Chairman Farrington thanked everyone for coming out. He addressed the meeting space needs for drug addiction programs at the Peer Recovery Center. He was glad to hear the derelict boat issue was being worked on. He stated it is not easy being a county commissioner, and this was a hard meeting. It's been a hard past two months. We are good team, we are not XIII.
