Mr. Currie and Mr. Carlton Williamson explained that legal matters are still slowing the transfer of ownership. The City intends to take ownership of the park once all legal matters have been resolved. 8.1) Public Hearing-Annexation (Ordinance No. 2021-Z-18) & Rezoning P&Z#21-03-01) 181 W. Love Mill Road Mayor Mann Opened thel Public Hearing at 6:38 pm. Mr. Lewis presented the application to Council explaining that the applicant has requested annexation of approximately 3.67 acres and rezoning of6 6.33 acres from B-31 to R6-MF. Mr. Lewis explained that staff has provided notice of the hearing, including mailed notice to the applicant and to adjacent property owners, advertised notice in the newspaper, and posted notice on: site. The Planning Board held a public hearing on March 2, 2021 and recommended rezoning of the property from B-31 to R6-MF. The property is two (2) parcels, Columbus County Property #5751 & #77993, approximately 6.33 acres in size. Property #77993 is within the City! limits andi is currently: zoned B-3. Property #5751 is located int the City's ETJ. The applicant will petition to City Council forp property#5751 to be annexed into the Cityl limits, prior to development, and at a public hearing where City Council will consider the applicants rezoning request. The site is an undeveloped, wooded lot located to the rear of commercial development. The site is surrounded by properties zoned B-3 on the north, RA-20 on the west, and R6-MF on the north as shown on the attached map. The closest properties zoned R6-MF and developed as multi-family is located immediately adjacent on the north on' W. Hay St. All adjacent properties appear to be developed with commercial, multi-family, or residential property. The proposed R6-MF district is established principally "for multifamily use," according to the Zoning Ordinance, andi isi intended to be' "located near higher intensity land uses (commercial and office and institutional uses) and away from lower density uses such as the RA-20 and R-20 districts." Mr. Lewis advised that as noted above, the property is largely adjacent to a large RA-20 district ont the west. Additionally, while the property is also adjacent to B-3 district to the east, those districts are developed with moderate to heavy commercial development. Permitted Uses and Standards: The uses permitted int the existing and proposed! zoning districts are found in the attached tables. The uses permitted in the R6-MF district are substantially similar to those permittedi in the R6 district with the addition of multifamily residences. He explained that among the uses permitted by right in the R6-MF are bed and breakfast/tourist homes, multifamily residences, single family dwellings and duplexes, family care homes, and churches. Dimensional Standards: The site is large enough to accommodate the minimum dimensional standards of the proposed zoning district. Residential minimum lot sizes are 6,000 SF for the first unita and 3,000 SF for each additional unit (i.e. 9,000 SF for a duplex, 15,000 SF fora a quadraplex). He: advised that the existing B-3 district has nor minimum lot size, but residences are not permitted. He advised that the R6-MF alsor requires a 6' vegetated buffer adjacent to the abutting RA-20 residential: zoning districts. Mayor Mann asked if anyone present wanted to comment for or againist the application. Mr. Charlie Irick, the applicant, provided comments relating to affordable, work force housing, rental ranges based upon income, and ifapproved expects construction to begin in the first quarter of next year. Brief discussion ensued with the Council regarding crime rates Mr. Daniel Jeff Davis spoke in opposition of the application; he stated that he has concern with crime rate, water protection, and a decline in his home/property values. Mr. Nick Hayes spoke in opposition of the application, stating that he concurred with most everything said by Mr. Davis. He also stated that he was concernedi for wildlife int the proposed area. He stated that he was not surei ift this would be the rightl location fort this project. Mayor Pro Tem Smith asked Mr. Lewis about stormwater and development. Mr. Lewis explained that process and reported that this meeting and the Planning Board meeting were both properly advertised ina accordance with NC General Statutes. Brief discussion ensued Mayor Mann Closed the Public Hearing at 7:05 pm. 9.1) Discussion & Decision-Annexation (Ordinance No. 2021-Z-18)& Rezoning (P&Z#21-03-01) 181 W. Love Mill Rd Mr. Lewis reviewed with Council his conclusions and recommendations regarding Case No. 21-03-01. He stated that Council was being asked toa approve or deny an annexation and rezoning petition submitted by Mr. Charlie Irick. Mr. Lewis advised that his conclusions includes concerns about the traffic impact on the surrounding area, but encourages the need for workforce housing on the City limits. He advised that staff will work with the developer and other department heads to resolve any outstanding issues during the site development review process. Mr. Lewis recommended actions were (1)approve an annexation petition of approximately 3.87 acres, described in Ordinance No. 2021-Z-18, (2) review and adopt a Statement of Plan Consistency and Reasonableness, modified as needed, and (3) recommend approval or denial of the rezoning of approximately 6.33 Justin Smith MOVED to approve the Statement of Plan Consistency and among the Council. 9) BUSINESS acres from B-31 to R6- MF. Mayor Mann called as special meeting for Monday, May 3, 2021 at 12:30 pm with the Planning Board to discuss Land Use Amendments in Chapter 160D. 9.3) Firehouse Subs Public Safety Foundation Grant Award Amendments Chief Yergeau reported to Council thatthe City, on behalf of Whiteville Fire Department, was awarded thel Firehouse Subs Public Safety Foundation grant fors six (6) Phillips FRx AEDs and Accessories fora total of $9,673.50. He advised that the award is funded 100% by Jimmy Clarida MOVED to approve the acceptance of the grant award from Firehouse Subs Public Safety Foundation in the amount of Firehouse Subs Public Safety Foundation. $9,673.50 for six Phillips AED's and accessories. The propoerty is located at 424 Virgil Street. The Adams Company submitted a bid tabulation sheet, along with a recommendation to award the bid to Corbett Demolition for the amount of$ $6,200. Her reported that this project will improve drainage from the east side of downtown to the swamp. The project includes installation ofar new drain line, new catch basins, and minor water line work due to the location oft they water line. He stated that this project is self-funded and the amount is $295,000 which includes construction, engineering, administration, and site observation. The cost of construction did come in lower than anticipated and should be a slight savings at the end of the project; provided crews do not encounter problems during the installalation. Recommendation To consider approval of the tentative Bid/ Award to Hickman Utilities fort the Justin Smith MOVED to approve a tentative bid award of $179,725 to Hickman Utilities for the Commerce Street Stormwater project. Mr. Currie advised that he would follow up on the issue. Mayor Pro Tem Smith made a comment referring to the earlier special budget workshop meeting, stating that he would like Mr. Currie to get a more current estimate for the concession stand/restroom building project for the Parks and Recreation department. Mr. Currie said he would follow up and provide the new estimate to Council for their consideration. Council Member Clarida commented on the illegal dumping in the City, Chief Ipock responded to his concerns. Council Member Williamson stated that he wants to see signs in the City standing straight. Mr. Currie responded by stating he would see thati it is addressed. Council Member Williamson also stated that he would like to see more beautification at the entrance of the road leading down to the Recreation Center.
