YANCEYVILLE TOWN COUNCIL MEETING MINUTES Tuesday, September 12th, 2023, 6:00pm The meeting of the Yanceyville Town Council was held in the Yanceyville Museum of Art at the Yanceyville Municipal Services Building located at 158 East Church Street, Yanceyville, NC and streamed through the WebEx platform on' Tuesday, September 12th, 2023, at 6:00pm. Council Members present: Mayor- Alvin Foster, Mayor Pro Tem- Odessa Gwynn Brian Staff present in person: Kamara Barnett-Town Manager/Clerk, Miranda Harrelson- Deputy Massey, and Keith Tatum Clerk, and Kathryn Hinton-Administrative Assistant Item 1: Call to. Order Mayor Alvin Foster çalled the Town Council Meeting to order at 6:02 pm. The meeting opened with aj prayer. He asked all to stand for the pledge of allegiance. Mayor Foster also stated that the Yanceyville Town Council rules and procedures reflect the revisions oft the North Carolina open meeting law of the North Carolina General Statues, a copy oft the Yanceyville Town Council rules and procedures are available upon request. Item 2: Review and Adoption of Agenda - Mayor & Council Mayor Foster asked Town Council to review the. Agenda. After al briefi review, Mayor Pro Tem Gwynn made ai motion to adopt the agenda as with said amendments. The motion was seconded by Councilman Massey and passed with a unanimous vote. Item 3: ConsentAgenda a) Minutes from the August 1st, 2023, Town Council Meeting b) Minutes from the August 7th, 2023, Town Council Meeting Mayor Foster asked Town Council to review the Consent Agenda. After a short review, Councilman Tatum made a motion to adopt the Consent Agenda as presented. Thei motion was seconded by Mayor Pro Tem Gwynn and passed with ai unanimous vote. Item 4: Public Comment None Yanceyville' Town Council Meeting Minutes September 12h,2023 Item 5: Water and Wastewater Treatment Facilities Update: Gary Stainback, Inframark Mayor Foster introduced Mr. Gary Stainback, Inframark. Mr. Stainback presented the monthly Representative update as follows: Yanceyville Water Treatment Plant Disinfection by Product (DBP) samples, which consist ofTrihalomethanes (THM) and Haloacetic Acids (HAA) were collected on. August 15th. Caswell Pines sample results were compliant and the Providence sample was slightly elevated; however, thei running Total Organic Carbon (TOC) samples were collected, and August results indicated 54.6% Staffcollects distribution water quality samples throughout the week and collaborates with Public Works on specific hydrant flushing needs. Sample results have indicated compliance with parameters such as turbidity, iron, manganese, pH and bacteriological. Staff completed annual water hydrant flow testing. Results were sent tot the Town Staff completed thei initial water hydrant flushing event for the distribution system which average remains compliant for the sample period and year. TOCreduction. Yanceyville Wastewater Treatment Plant Treatment process was compliant in July with permit monthly limitations, but experienced Staff cleaned solids from the treatment process effluent tank and the chlorine contact tank. (Pursuant to Section 34-38 ofthe Yanceyville Town Code) Item 6: Consideration of] No Curb/Shoulder Parking on Cemetery and Gwynn Street Town Manager Barnett explained that over the last several months the Town ofYanceyville: has received several calls and correspondents with complaints about vehicles being parked int the street on Cemetery Street and Gwynn Street. Shei noted that because the vehicles arej parked in the streets Schools Buses as well as Emergency Services personnel (Fire Trucks and Ambulance) are unable to drive along the streets. She noted that after reviewing the Yanceyville 2 Yanceyville Town Councill Meeting Minutes September 124,2023 Town Code Section 34-38 the only two streets in Town that prohibit parking on the curb and shoulder are County Park Road and Barco Street. Town Manager Barnett mentioned that the only Town-owned Road is Cole Street therefore the North Carolina Department of Transportation will need to bei informed ofthis amendment. After which Town Attorney Lee Farmer will draft an Ordinance with the amendment to Section 34-38 oft the Yanceyville Town Mayor Foster asked Town Council fora a motion. After a briefdiscussion, Councilman Massey made a motion to move forward with contacting NCDOT regarding No Curb/Shoulder. Parking on Cemetery and Gwynn Street and have Town Attorney Farmer draft an ordinance with amendment. The motion was seconded by Councilman Tatum and passed with a unanimous (Councilman Massey left the Town Council Meeting due to an emergency at 6:14 pm) Item 7: Adoption of Resolution Caswell Tourism Development Authority Resolution to Authorize the Town of Yanceyville to defer the Authorized 3% Room occupancy Tax to the Caswell County Tourism Development Authority for the Disbursement for the Town of Town Manager Barnett explained that in 2007 Senate Bill F 442, Session Law 2007-224, Session 2007: makes provisions for the Town ofYanceyville Town Council by resolution to levy aroom occupancy tax oft three percent (3%) on the gross receipts derived from any room, lodging or similar accommodation ini the town, and required the Town ofYanceyville, upon levying a room occupancy tax under this act, to also adopt ai resolution creating the Yanceyville Tourism Development Authority as described in Senate Bill F 442. She noted that in 20071 the Town Council opted not to move: forward. She explained that it was her understanding that the Town didn'tmove forward, because there was only one hotel in' Town. She pointed out that in this resolution the current singlel hotel owner in Yanceyvlle/Caswell supports this resolution to begin on January 1, 2024. She also explained that within this resolution the' Town doesn'tneed to create an independent TDA, however the' Town will have representation on the Caswell TDA by appointing a member. Town Manager Barnett recommended that Town Council appoint the Town Manager or/ /Town Designee to serve behalfofyanceyvile on the Caswell Tourism Development Authority Board. Town Manager Barnett further explained that the funding does not impact property owners as iti is funded by taxes at the hotel, Airbnb, Verbo and other short term rental properties (less than 90 days) paid by visitors. She also mentioned to be proactive regarding citizens that will try to avoid paying taxes, the TDA will have inserts that go in the county's property tax mailers explaining that all short-term rentals (less than 90 days) are Mayor Foster asked Town Council foramotion. Annual Bright LeafHoedown will be held Saturday September 23, 2023. She noted that the streets ini the Downtown area will be closed from 6:00am until 10:00pm. 2. Friday, October 6th, 2023, will be the final First Friday ofthe season. The Doug Prescott Band will be providing entertainment. Please come out and enjoy the local talent. Food will be available for purchase and Cruise-in welcoming all cars trucks, motorcycles, etc. 3. Piedmont Triad Regional Council will be hosting their Board of Delegates' Annual Awards Ceremony will be held on October 18th, 2023 at 12pm at the Blue Heron Event Venue 4130 Mendenhall Oaks Parkway High Point, North Carolina 27265. The 2023 Grady Hunter Regional Excellence and Randall Billings Service Award Banquet will be held at noon at the Blue Heron Event Venue offofHwy 68 on Mendenhall Oaks Parkway inl High Point. July 2023 payment to the Town ofYanceyville, refunded or credited on the account regarding water bill. Town Manager Barnett noted that in the letter it was explained that Old Farm never received the. July 2023. When the property received the. August water bill it included the prior balance for July. She noted that the past dew balance was paid that include the 15% late fee. Town Manager Barnett explained that it isl heri recommendation that the Town neither refund nor credit the late fee for Old Farm Apartments. She indicated that the' Town has no way to validaté that thel bill was: not received, in addition a customer can always call and get thel balance on their account from the Billing/Collections Clerk ift they haven'treceived al bill. All bills are mailed out at one time we can no account for the United States Postal Service. We arei not able to set a precedent that would not be: fair to residents and businesses.
