The Regular Meeting of the City Council of the City of Whiteville was called to order on Tuesday, August 10, 2021, at 6:30 p.m., at 317 S. Madison Street, Whiteville, NC, Advisement of Virtual Meeting. This meeting was made available in a virtual environment. Viewers were invited to submit public comments via the Q&A function located within the Microsoft Teams application or by contacting the 28472. He presented Proclamation No. 2021-P-27 to the coaches and the 8.2) Recognition of the Central Columbus Dixie Darlings Softball Team Wins Mayor Mann congratulated the Central Columbus Dixie Darlings Softball Team on their victory winning the State Championship game. He presented Proclamation No. 2021-P-28 to the coaches and the Series Championship team. State Championship team. 9) BUSINESS 9.1) Discussion Pertaining to Filling a Vacant Seat for an Unexpired Term on Mayor reported that Council Member Justin Smith resigned from City Council on Friday, July 30, 2021. Mr. Smith served on Council representing District 1 in the City. Mr. Smith's termi is set to expire in 2021. The City's Charter refers back to NCGS 160A-63 and a couple of blog posts from the UNC School of Government is included which explains the process for filling unexpired terms. Council may appoint a qualified candidate to fill the term until the next election. Ther next election is November 2, 2021 (now rescheduled for March 8, 2022). Whoever is appointed by the Council, MUST file for this seat for the rest oft the unexpired term, ift that person desires to continue to serve out the rest of the term. Any other qualified person can run for the seat as well. The person elected toi this seat for the unexpired term willl hold the seat until 2025. Mayor Mann stated that he would prefer to fill the vacancy the same way Council did for Mr. Leder's seat backi in the spring. Other members of Council concurred. Mayor Mann suggested at timeline and itv was briefly discussed. Council concurred to accept applications from interested citizens beginning Wednesday, August 11th through Tuesday, August 31st at 5pm. Also discussed, was to hold as special meeting to accept brief presentations from citizens who submitted applications for the vacant seat. Mayor Mann explained thati in accordance with the City Charter, Section 2.4, the Council shall elect one ofi its members as Mayor Pro Tempore to perform the duties ofl Mayor during his or her absence or disability, in accordance with general law. He explained thatt the City is entitled to be reimbursed fort the cost associated with the employment, training, equipment and ancillary costs of employment as ac City of Whiteville Police Officer int the event the employee leaves the employment oft the City of Whiteville within two (2) years. He advised that! he was recommending a change to the current agreement in place by revising the agreement in order to establish an average cost of five thousand dollars ($5,000) and the amount ofr repaymenti is based on a prorated scale of $5,000.00 divided by twenty-four (24) months. This revision will allow police officer employees to quickly identify the amount ofr repayment to the City should they decide to leave City employment within the established two-year period. Brief discussion Kevin Williamson MOVED to approve revising the Police Officer Employment Agreement to reflect an average cost of $5000 and a pro- rated repayment plan reflective of 24 months divided into $5000 for a monthly payment, with the agreement being subject to the approval ensued. from the City Attorney. He explained that the FYE2022 Budget Amendment #3i is needed to appropriate funds for the demolition of the Lewis Smith Shopping Center. He reviewed with Council the bids received for the demolition and recommendedi that DLS Ground Maintenance Inc. be awarded the bid. He also explained Jimmy Clarida MOVED to approve awarding the bid award to DLS Ground Maintenance Inc., and approving FY21-222 Budget Amendment FYE BA#3. Brief discussion ensued. Mr. Currie explained that the trees were mistakely sprayed by City employees and explained howi it happened. Council Member Williamson also asked for an update regarding COVID- 19. Mr. Currie advised that Hal would update the Council later in the meeting. Council Member Collier inquired as to the status of thel bridge project at West Whiteville Park. Mr. Currie advised that all contracts have been signed and contractors are waiting materials for the project tol be shipped. He reported that there are still supply chain issues. Mayor Mann asked Ms. Ward to report on the Main Street Designation recently awarded to the City. Ms. Ward provided al brief report. Mr. Lowder provided an update on matters relating to COVID-19. 11) REPORTS 11.1) Manager's Update Mr. Currie reported on thei following 1) the Commerce Street project, 2) Waste Management: follow up meetings, 3)Mollies Branch Phasel project, 4) outdoor lighting at Nolan Park and the Recreation Complex, and 5)! Mollies Branch Phase Il project. Mayor Mann asked Chief Ipock for al brief update regarding matters at Sandy Ridge Apartment, Chief Ipock provided an update. Council Member Collier asked Chief Ipock about what could done about basketball games (including the hoop stand) being played in the streets in his neighborhood.
