Public! Hearing. P8Z#22-08-01 Rezoning Petition 27 &2 29 Cart Path Rd. Mayor Mann opened the Public Hearing at 6:32 pm. Mr. Lewis presented the application submitted by Zachary and Mariah Strickland. He explained that the applicant has requested the property located at 27&2 29 Cart Path Road be rezoned from RA-201 to RA-20MH. Mr. Lewis reported that staff has provided notice of the hearing, including mailed notice to the applicant and to adjacent property owners, advertised notice in the newspaper, and posted notice on site. He described the site and area characteristics as being a single parcel, Columbus County Property #80235, approximately 4.0 acres in size. The property is within the City's ETJ and is currently zoned RA-20. He reported that the site is undeveloped and is used as agricultural currently; the property is adjacent RA-20MH zoning to the east and RA- 20 to the north, south, and west. He reported that the property immediately adjacent is developed with manufactured homes. Ms. Strickland made a brief comment regarding the property. Brief RA-20t to RA-20MH discussion ensued. Mayor Mann closed the Public Hearing at 6:37 pm. 9) BUSINESS 9.1) Discussion & Dedision-P8Z#208-01 Rezoning. Petition 27 &29Cart Mayor Mann asked if Council wanted to discuss the matter before acting on the request. Brief discussion ensued between Council Member Worley and Mr. Lewis regarding the ETJ boundary and how the ETJ relates to the City. Mr. Lewis read the Consistency & Reasonableness Statement into the record: Chapter 3 of the City of Whiteville Land Use Plan identified a goal to ensure the City has a well maintained, affordable, and diverse housing stock available to current and future residents. A policy and strategy of the Land Use Plan is to encourage a variety of dwelling unit sizes to allow for smaller, low-cost units. The rezoning is appropriate and in the public's interest at this time. Jimmy Clarida MOVED to approve the Statement of Plan Consistency Path Rd. RA-20 to RA-20MH and Reasonableness. Board and Board of Adjustment Re- The Planning Board and Board of Adjustment currently have four members that wish to be reappointed. They are Mr. John Barkley, Ms. Sheila Mills, and Mr. Doug Spivey. The County Commissioners reappointed Mr. Sammy Jacobs on August 1, 2022 and Mr. Freddie Edwards is scheduled for reappointment by the County Commissioners on August 29, 2022, for the City's ETJ area for the Planning Board and Board of Adjustment. Two seats remain vacant in the ETJ area (county commissioner's appointments). for the Planning Board and Board of Vickie Pait MOVED to approve the reappointment of Mr. John Barkley, Ms. Sheila Mills, and Mr. Doug Spivey for a term begininning August 1, 2022 and ending August 1, 2025 to the Planning Board and Board of Adjustment. The approved Classification Plan dated June 14, 2022, was approved for (2) positions. In the FY2022-23 budget for the Police Department, there was only one (1) position that was approved and allocated for the Technical Services Division Manager. In addition, she explained that the Economic Development Planner position's FLSA Status is being recommended to be changed from non-exempt to exempt (pursuant to the FLSA job Jimmy Clarida MOVED to approve the FY2022-23 Allocated Position- duties test). Classification Plan Amendment 1. Vickie Pait SECONDED the motion. Resolution to Apply for Additional ARP Funds for Sewer Mr. Currie explained that this application is for ARP (American Rescue Plan) funds to continue sewer improvements to the City's collection system. The sewer lines involved are located on Thompson Street ($5 Million) and in the Pinewood Subdivision ($2 Million). He reminded Council thati in the Pinewood subdivision, the City was putting together a CDBG project for sewer work. The funding was not received for the project and now the City is applying for ARP funds for the project. Thompson Street has several issues involving water and sewer and if funded, this will replace all the sewer lines down Thompson Street. Vickie Pait MOVED to approve Resolution No. 2022-R-148. VOTE: 6-0 (Unanimous) Helen BI Holden, Emory Worley) Nays: 0 Absent: 1 (Kevin Williamson) 9.5) Authorizing Resolution to Apply for ARPFunds for Water Line Replacement and Generator Installation on Wells Yeas: 6 (Terry Mann, Jimmy Clarida, Vickie Pait, Tim Collier, Mr. Currie explained that Resolution No. 2022-R-148, allows the City to apply for ARP funds to begin water line replacements in the City. He advised that the first project will be to replace the lines along Thompson Street ($1.5 Million). A second phase of this project is to add five (5) standby generators to the wells that produce the City's water supply. He stated that currently the City only has two wells with standby generators. Mr. Currie explained that there is currently sidewalk work being done on that street. Council Member Collier reported that he had been asked why there were no flowers on the sidewalks past the Columbus County Arts Council. Brief discussion ensued from Ms. Ward and Mr. Currie. Mr. Currie and Ms. Ward reported that there were no sidewalks to put flowers on past the Arts Council. Council Member Worley asked for an update pertaining to the development of a Food Truck ordinance. Mr. Lewis explained that the special meeting scheduled for Thursday, September 1st with the Planning Board would address that those concers/comments. Mayor Mann provided an update regarding the buyout program which was held at the Dream Center on August 22nd. He reported that he had received an email from ENCOR earlier in the day that the City is approved for 24 properties. He and Mr. Currie reported that additional meetings would be held on September 7 at the Dream Center and one on September 8th at the Depot. Mayor Mann commented that he thought the National Night Out campaign was very successful and was a great thing for the community. 11) REPORTS 11.1) Manager's Update Mr. Currie reported that the NCSU Coastal Design Lab will hold two public meetings for residents in and around the Mollies Branch area of the City. One will be September 7th at the Dream Center and the other at the Depot on September 8th. These meetings will be to address the possibilities of stream restoration of the branch. He reported that ARPA applications were on the agenda (two resolutions) that will allow staff to prepare an application for sewer and water improvements. For the sewer improvements, this will represent approximately $7 million in work on the system. For the water improvements, it will represent $2.25 million on the water system. These two applications are valued at $9.25 Million. If the City can be funded for these projects, it will be a game changer for the City. He advised tha the City's systems are in poor health and this will be in addition to the $11.2 million sewer funding that Chief Ipock presented the new police officer badge to the Council.
