Madison Street, Whiteville, NC, 28472 The Regular Meeting of the City Council of the City of Whiteville was called to order on Tuesday, August 8, 2023, at 6:30 p.m., at 317 S. Madison Street, Whiteville, NC, 28472. 1) ROLL CALL PRESENT: ABSENT: Terryl Mann, Jimmy Clarida, Tim Collier, Helen BI Holden, Vickie Pait, Kevin Williamson, and Emory Worley None. OTHERS IN ATTENDANCE: Darren Currie, City Manager; Bonnie Williams, City Clerk; Colburn Brown, Finance Director; Doug Ipock, Police Chief; Robert Lewis, Planning Director; Hal Lowder, Emergency Services Director; Joseph Williams (The News Reporter); AC Cutler; Josh Harris; and Marilyn McKoy 2) CALL TO ORDER 3) INVOCATION Mayor Mann called the meeting to Order at 6:30 pm. Led by Council Member Collier. 4) PLEDGE OF ALLEGIANCE Led by Mayor Mann. 5) ADOPTION OF AGENDA Tim Collier MOVED to approve the adoption of the agenda as presented and amended by removing item 11.1, Closed Session. VOTE: 7-0 (Unanimous) Nays: 0 Absent: 0 Yeas: 7 (Terry Mann, Jimmy Clarida, Tim Collier, Helen B Holden, Vickie Pait, Kevin' Williamson, Emory Worley) 6) APPROVAL OF MINUTES 6.1) Consideration for Approval of Minutes Emory Worley MOVED to approve the minutes for the regular meeting and closed session held on July 25, 2023 as presented and amending the minutes for the Closed Session by inserting the word, 'suggested" after Mr. Currie's name in Section 2. (Terry Mann, Jimmy Clarida, Tim Collier, Helen B Holden, Vickie Pait, Kevin' Williamson, Emory Worley) 7) PUBLICCOMMENT None. 8) BUSINESS 8.1) Consideration for Ordinance No. 2023-0-91:AText Amendment to Amend 70.99 and 80.99(7,Relating. to Penalities for Traffic Code and Chief Ipock explained that police department staff have been working on animal control violations. He reported that they discovered that City Ordinances 70.99 and 80.99(7) regarding penalties, were not compliant with the City's fee schedule. He recommended a text amendment to the City Code so it complies with the Schedule of Fees adopted in June 2023 by City Council. Brief discussion ensued. Vickie Pait MOVED to approve Ordinance No. 2023-0-91. Jimmy Clarida SECONDED the motion. VOTE: 7-0 (Unanimous) Nays: 0 Absent: 0 Animal Violations Yeas: 7 (Terry Mann, Jimmy Clarida, Tim Collier, Helen B Holden, Vickie Pait, Kevin' Williamson, Emory Worley) 9) COUNCIL COMMENTS Council Member Pait offered comments regarding a mattress and boxspring on Calhoun and Lewis Streets that was removed by the City's Public Works department, stating that she was glad to see it removed. Council Member Williamson asked about the process for filling potholes with gravel. Mr. Currie explained that process. Council Member Worley thanked Chief Ipock and his staff for their work regarding the National Night Out event on August 1st. He also asked about employee turnover since Council approved increased salaries for the FY2023-24 budget year. Brief discussion ensued with Mr. Currie providing comments pertaining to today's work culture and ethics. Mayor Mann reported that the Council has been invited to the Whiteville City Schools Annual Back-to-School breakfast on Wednesday, August 23rd. Council Member Pait reported that she would not be present for Council's next regular meeting on August 22nd; she stated that she would be attending a work related conference. 10) REPORTS 10.1) Manager's Update Nor reported was provided. 11) CLOSED SESSION - AMENDED AGENDA-ITEM REMOVED 11.1) Pursuant to NCGS 143.318.11 (a)(1)(4) Ms. Marilyn McKoy asked ifs she could be heard. Mayor Mann invited her tos speak. Ms. McKoy asked if the City would repair potholes on Baldwin Circle. Mayor Mann and Mr. Currie advised that they would have stafft to take al look at the issues and try to make the situation better. Williams, CITY CLERKI IIITEN ORDINANCE NO. 2023-0-91 CITY OF WHITEVILLE, NORTH CAROLINA AN ORDINANCE, AMENDING TITLE VII, CHAPTER 70.99 AND TITLE VIII, CHAPTER 80.99(7)) REGARDING PENALTIES FOR VIOLATIONS WHEREAS, Title VII, Traffic Code, Chapter 70.991 Penalties ist the ordinance applicable top penalties for violations relatedt to the regulation oft the operation or parking of vehicles; and WHEREAS, Title VIII, Animals, Chapter 80.99(7) Penalties is the ordinance applicable NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Whiteville, North Carolina Chapter 70.99 and 80.99(7)i is hereby amended as follows. SECTIONI. $ 70.99 PENALTY. If any person shall violate an ordinance regulating the operation or parking of vehicles, he or she shall be responsible for an infraction and shall be required to pay a penalty efmet-more-than- $50 as provided in the annual Schedule of Fees as SECTION II. $ 80.99(7) PENALTY.
