The purpose of this Chapter is to regulate the storage, collection and disposal of solid waste and recyclable material in the Town of Vanceboro. This Chapter is adopted pursuant to the authority contained in N.C.G.S. Chapter 160A, governing powers of municipalities and various federal and state statutes specifically regulating Solid Waste and Recycling. SECTION 56-11. Definitions. A. Bag (bagged, bags) and box (boxed, boxes) means to securely contain a quantity of residential solid waste, refuse, trash or garbage in ai manner to prevent spillage during collection. Each bag or box must not exceed fifty (50) pounds in weight. B. Bulky wastes means household furniture, mattresses, bedding and bundled carpet. C. Garbage (also known as waste, trash, refuse, junk, rubbish, and litter) is defined D. SECTION 56-14. Prohibited Items. As ofJ January, 2012 North Carolina no longer allows the following materials/items to be placed in landfills, sO the town is not permitted, and will not collect these items from residential and/or commercial garbage. 1. Televisions 3Page Adopted May 6, 2013 In addition to this list, the Town of Vanceboro will not pickup any bulky waste. These items can be taken to the Craven County Solid Waste Convenience Center free of charge and placed in designated collection areas. The convenience center is located at Bailey Lane in Vanceboro and its phone number is 252-244-1436. It's hours are 7:00 AM-6:30PM-T Tuesday, Thursday and Saturday; and 1:00 PM-630PM-Sunday. SECTION 56-15. Construction and/or Demolition Materials. All construction and demolition contractor and any others disposing of construction and/or demolition materials shall provide on-site receptacles/bulk containers for scrap building materials and other trash produced by those working on the site. All such materials shall be contained and the site maintained in a clean and litter free condition. Dirt, mud, sand, construction materials or other debris deposited upon any public or private property as a result of construction or demolition shall be immediately removed by the contractor and in all cases by the end of the workday. Costs for removal of building materials shall be borne by the contractor or owner. No construction or demolition waste or debris shall be placed in a municipal solid waste container or recycling container for collection by the Town or the Town's contractor(s). Lot clearing waste, including any taken from the town street right-of-way, shall be removed from the site by the contractor and disposed ofin an approved site. SECTION: 56-16. Penalties and Enforcement. A. A violation of any provision of this ordinance shall be punishable in accordance with the provisions of NCGS$14-4 ("Violation of local ordinances misdemean- or") and NCGS9I60A-303.1 ("Regulation of the placing of trash, refuse, and B. Penalties: Except as provided in subsection (b) ofNCGSS14-4, any person found in violation of this ordinance shall be guilty of a Class 3 misdemeanor and shall be fined fifty dollars ($50). Any person found in violation ofl NCGS9160A-303.1 shall be fined fifty dollars ($50) or imprisoned not exceeding 30 days, or both, for each offense.
