Record of Deeds to Cemetery Lots. Perpetual Care Funds. Conduct prohibited. Unless specifically provided otherwise, this chapter applies only to cemeteries that are owned, maintained or operated by the town. SECTION 15-21. Sale ofLots. (a) The sale oft town cemetery lots shall be under the supervision oft the town clerk. (b) The price to be charged by the town for lots in the town cemetery shall be as established from time to time by the board ofa aldermen. SECTION 15-22. Record of Deeds to Cemetery Lots. No land tol be used in any town-owned cemetery as a cemetery lot or for burial purposes shall be sold or conveyed except by deed conveying such land for such purposes. A record of such deeds shall bel kept in an appropriate book and this book and all other cemetery records as may: from time to time be used shall be kept in the office oft the town clerk. SECTION 15-23. Perpetual Care Funds. The board ofa aldermen may establish a perpetual care fund for the purpose of maintaining any ofthe cemeteries oft the town. Such fund shall be established and administered as the board ofaldermen may deem best. State law references: Trust funds for cemeteries, G.S. 65-4 et seq. SECTION 15-24. Perpetual Care Guarantee. The Town ofVanceboro guarantees perpetual care ofall lots sold in the Town of Vanceboro Cemetery. SECTION 15-25. Conduct Prohibited. (a) No person shall remove or cause to be removed from any burial plot any flowers, shrubbery, floral designs or any pots, vases or racks containing the same unless he shall first deliver to the Town Clerk, the written permission of some member ofthe immediate family of the deceased person who is buried within the plot; however, nothing contained in this subsection shall be construed sO as to prevent the town from removing dead flowers and designs without the permission otherwise required by this subsection. (b) It shall be unlawful for any person. to enter within or upon any town cemetery between the hours of sunset and sunrise at any time, unless he shall have a written permit to do sO from the Town Clerk oft the cemetery. (c). No person shall at any time loiter within a town cemetery. (d) No person shall dig any grave, put any fence, gravestone or board, make or construct anything, or dig up any sod on aj private burial lot, except under the direction and by the (e) No person shall remove the stakes or boundary stones from al burial lot, nor remove any! board, gravestone or other memorial or monument which may have been erected at any grave; nor shall any person deface, injure or desecrate any board, stone or memorial (f). No person shall cut or in any other manner: injure or destroy any tree, shrub or plant, or wantonly injure or destroy any flower, either wild or cultivated, in the town cemetery. (g) Noj person shall pass into or out oft the town cemetery over the walls or fences. (h) Noj person shall discharge any: firearms in the town cemetery. consent of the owner thereof. in any manner. (i) No person shall deposit or cause to be deposited any filth or unclean or offensive (). It shall be unlawful for persons to use the town cemetery as a playground, and it shall matter in the town cemetery. be the duty oft the town to prevent such use. SECTION 15-26. Specifications for lots, markers, monuments. (a) Mausoleums and cement slabs shall not be permitted in any town-operated cemetery. (b) It shall be unlawful for any person to build any curb, wall or fence ofa any kind on or around any loti in the town cemetery.
