Provider is not eligible for worker's compensation coverage under the Town' 's Workers' Compensation Policywhile performing the contracted, service for the Town. The Provider understands that noj federal, state or other payroll tax ofany kind shall be withheld or paid by the Town on behalfoft the Provider or employees oft the Provider. The. Provider understands and agrees that the. Provider is fully responsible for the payment of all taxes arising from the payment ofn monies pursuant to the requirements. Greene, PLLC-FY23-514.00, FY24-$ $14,000, FY25-$ $14,000 C.R Randolph, CPA-$ $10,625 with a cap ofi no more than 3% increase for 2024 and 2025. Mrs. Thacker noted that inl her research of W. Greene, PLLC she learned that there was some tardiness in submitting the audit reports and that in some cases, Mr. Greene was replaced by the Mrs. Thacker then spoke ofl her extensive conversation with Ms. Randolph and believed her to be very knowledgeable with 31 years of experience. She stated that Ms. Randolph understands that this is a 1-year contract with a 3-year proposal submitted. Mayor Pro Tem Foy made a Motion to accept the proposal submitted by #6099f, dated March 6, 2023 from Back Yard Paradise, 3123-K Cedar Park Road, Greensboro, NC to install playground equipment under the terms ofthe proposal and in the amount of$81,692.83, of which $5,013.83 5 in sales tax which will be returned to the Town of Stokesdale. Councilman Landreth seconded Mayor Pro Tem Foy announced that the Town received: nine different proposals from three different vendors and after careful review feltt that Back Yard Paradise would be the best option Councilman Jones asked ifanyone went to look at their work? Consideration to accept Scott transcript dated May 24, 2022. (Reversed with Item Councilman Jones introduced this item and stated that he has had a discussion with Mr. Winfree inr regard tol legal concerns with this item and understands those concerns. Hel believes the citizens are entitled to transparency. He had this transcript done because the audio is not clear in some places. He noted that the minutes of the closed session have been released. He noted that the Transcriptionist in not a certified court reporter, but her business is to provide transcripts for Councilman Jones made a Motion to accept the Transcript as a supplement to the audio with whatever reservations Mr. Winfree thinks are appropriate for the closed session held March 12, Mr. Winfree identified four concerns with the release of this transcript. One being that Ms. Scott is not ai registered court: eporter/transeripionist and noted the training and qualifications required for that designation. He was concerned that she was not present at thei meeting and questioned her ability tol know who said what from an audio tape. He questioned thei format ofthe document which was a word document that is editable by anyone that received it. He also noted that she certified that it was an accurate transcript oft the recording that she received, but it has not been determined that the recording she received is an accurate and complete recording oft that meeting. Mr. Winfree stated that ifthe' Town vouches fort the accuracy oftheti transcript andi iti ist then disputed by someone, the Town may have to defend itselfin a defamation lawsuit. Council discussed the liability of accepting this transcript as part of the Town's records. #12) government entities and private corporations. 2020. Councilman Jones stated that his intent ist tol have the transcript added as a supplement to the audio recording and not the written minutes that have already been approved by Council. Mayor Pro Tem Foy stated that hel has not ever received a copy ofthis transcript and: is being asked to vote for something that hel has not seen and stated that this is senseless to do. She thanked Council for their support of Summerfield ini their fight against the de-annexation. She noted that the' Town ofOak Ridge has also] passed ai resolution in support of Summerfield. 4. Consideration of Resolution of Support/Resolution Opposing De-Annexation. Mayor Pro Tem Foy read Resolution R-2023-05 as written. Mayor Crawford made a Motion to adopt Resolution-2023-05 as follows: 1 RESOLUTION NO. R-2023-05 Al RESOLUTION OPPOSING THE DE-ANNEXATION OF CERTAIN PROPERTIES FROM THE TOWN OF SUMMERFIELD WHEREAS, The Town of Stokesdale ("Town"), by and through its Town Council, does hereby adopt the following resolution to be submitted to the Guilford County Legislative Delegation, to the North Carolina General Assembly, and desires to also communicate its position to both the WHEREAS, the NC General assembly granting the proposed de-annexation in The Town of Summerfield would usurp the role of local government and its elected officials. By extension, absent a referendum ofThe Town of Summerfield's citizens, would also go against the desire of WHEREAS, this proposed de-annexation would remove over 5 (five) percent of land from the WHEREAS, no data driven studies have been presented to reflect the fiscal impact in the short- and long-term, offering insight into the net impact that such a de-annexation would have on the WHEREAS, any de-annexation of such magnitude coupled with the strong objection of local elected officials and citizens alike would set a harmful precedent in diminishing the role of local WHEREAS, the Stokesdale Town Council submits the following: The Villages of Summerfield Farms" ("Villages") are potential tracts of proposed de-annexation. These properties total approximately 973 acres in the heart of Summerfield within close proximity to its Town Core. While two Unified Development Ordinance ("UDO") text amendment requests by the developer were denied since the Town of Summerhield's 2021 UDO changes, the Villages project has not been denied outright nor has there been a denied rezoning associated with this project. These properties are not contiguous and ad de-annexation ofthis magnitude would result ini isolated tracts and create complex town boundaries that would complicate functions of Summerfield's limited- NOW, THEREFORE, BE IT RESOLVED THAT the Stokesdale Town Council opposes de- annexation of the aforementioned properties that would result in said properties within the Town ofSummertield's. limits being within Guilford Coumy'ssalejurisiction. In addition, the Townof Stokesdale opposes all significant de-annexation efforts that oppose the desire of any Town ofs Summerfield and Guilford County upon approval. the majority oft the Town of Summerfield's citizens. He reported that they have received bids for the: replacement of light poles and with the previous cost ofthe LED lights, the total amount was $108,000. Given what's already been paid the amount remaining is $68,000. However, the organization is not asking the Town for the full Council complimented Mr. Balmforth on the improvements made thus fari to the baseball fields. Council asked questions in regard to the financial position of the organization and how much money they have raised towards the improvements. Mr. Bamforth explained the fundraising efforts foranew amount but for help in reaching that goal. playground which netted $33,000. 1 Mr. Balmforth stated that estimates were prepared by professionals which will meet requirements. Mayor Pro Tem Foy then stated that hel had a conversation with Mrs. Martin today ini regards to the Town's Development Ordinance and 160D regulations and the need to codify all of the Town's Town Clerk Martin explained ai major change to the Development ordinance adopted by the NC General Statutes known as 160D. In previous discussions with Mr. Oliver Bass, she assumed that it had been adopted and the Town's ordinances amended accordingly. However, in conversations with Mr. Snyder, 160D has not been adopted as is required by the NC General Statutes. Mrs. Martin explained her conversation with Municipal Code, an organization that prepares codes all across the Country on the best way to tackle this issue. They recommend ai re-write given the significant changes that will be required by 160D. The estimate gaven today is approximately $20,000. Mrs. Martin then explained that once, you reach 5,000 in population in your community, the NC General Statutes requires you tol have all your general operating ordinances codified into a publication like your Development Ordinance. The estimate from Municipal Code for that project is also in naming for previous donors. recognized this is uncharted territory for Stokesdale. operating ordinances and asked her to explain. approximately $20,000 as that project will be prepared from scratch. 2 Councilman Jones asked if she has this in writing. It was also suggested that wel have a separate line item for the expense side ofreviewing these plans by the Town Engineer and that it be as separate item from reviews in general for our water system. Following the discussion, it was recommended that we increase the line item for Engineer and Consulting to $55,000. Schedule of] Fees and Charges: Council discussed the lost key fee. Council discussed fees for shelter and field rentals and the desire to be reasonable. Staff suggested Town Clerk Martin pointed out the Street Closing fee changes. She explained the recent case in Angel's Glen cost the Town $1,357.46 for the advertising. She noted that $250 is extremely low. Robbie, Here are the items of concern we expressed at the meeting with DOT regarding intersection (Ellisboro Rd/Belews Creek Rd and Hwy 158/ Belews Creek Rd) as well as the concerns for the feeder streets intersecting with Belews Creek Rd between the Hwy 68/Belews Creek Rd intersection and the Hwy 158/ Belews Creek Rd intersection. If the travel lanesi in all directions at thei intersection of] Hwy 158 and Belews Creek Rd arei made left-turn, right-turn and a straightla lane wel believe it willa add tot thes speed that vehicles traveling east bound on Hwy 158 proceed through thei intersection due to not having to slow for traffic. This problem would only be compounded due tot the fact there is as slight knoll as you approach the intersection east bound, then would in a very short distance before proceeding into a Ifat traffic roundabout is constructed at the Ellisboro Rd/Belews Creek Rd intersection and nothing is done at the Hwy 158/Belews Creek Rd. intersection, due to the amount of tractor- trailer traffic that passes through those intersections it will back traffic through the Ellisboro Rd/Belews Creek Rdi intersection roundabout). Due to the short distance between the two (2) intersection and the length of a tractor trailer you currently have to set through atl least two (2) light changes or more depending on the amount of traffic stopped to clear thei intersection. The feeder/side streets that intersect with Belews Creek Rd. (Newberry St, Lester Rd and VaughanSt): are not: suitablei for handling tractor trailer traffici in any form should traffic need to bec detoured for any reason. We feel that this is an area that DOT should really take al look at. These are the main issues we saw that would arise if all of these concerns are: not addressed. Again as first responders we. like many others feel that the road system currently inj place could handle traffic in Stokesdale 25 years ago (the two (2) intersections in question have always presented an issue) but we have out grown the current road system andi it will continue to worsen as thei town continues to grow. Extending thei term of the Ancillary Intergovernmental Water Services Agreement Increasing the purchasing allocation from 300,000 gallons-per-day to 500,000 Reflecting the Town of Stokesdale, North Carolina's current rate as the wholesale rate, as defined in the Winston-Salem / Forsyth County Utility Commission's Adding provisions regarding water quality, water pressure and water booster from the year 2030 to the year 2050; and gallons-per-day; and Water System Policy Resolutions; and pumps; and WHEREAS,int theaboyementioned lamendment, the' Town of Stokesdale, North Carolina agrees to pay the Winston-Salem / Forsyth County Utility Commission a Lump Sum Reserve Capacity Fee of $128,000.00 by January 25, 2024, due to the increase of the purchasing allocation from 300,000 gallons-per-day to 500,000 gallons-per-day.
