COUNCIL MEMBERS: Mayor Randy Braswell, Mayor Pro Tem William N. (Bill). CALL COUNCIL MEETING TO ORDER: Mayor Braswell called the meeting to order at 7:00PM. INVOCATION: Given by Mayor Braswell. PLEDGE OF ALLEGIANCE: Recited by Council members and citizens in attendance. REVIEW AND ADOPT AGENDA: Tim. Jones wanted to add a discussion of the Town'srough budget draft preferably before Mr. Pulliam leaves. Mayor Braswell placed this added agenda item after the Finance Katy Gregg thinks that there is concern when adding issues to the agenda after it has been published. A new case recently came out and the court discussed thisi issue and feels thisi is something that is bad policy that towns should stay away from. The publishing of the agenda is for the purpose of giving the public notice of those agenda items and what is going to be discussed. Adding things to the agenda the night of the meeting could possibly not give the public the appropriate notice they need. Not that this requiresa notice, but if someone wanted to be heard and couldn't be heard because the item was placed on the agenda the night of the meeting, and it wasn't on the agenda when it was published, could pose a Tim Jones said, just for the record, his request for the item remains. Jones advised that as far as hel knows, the Town does not publish an agenda fort the Wednesday Town Council Business Meetings. Katy Gregg doesn't know if an agenda is published for the Wednesday' Town Council Business Meetings, but shel knows there is an agenda published fort this meeting, the Regular Town Council Meeting. There is not a law that says agendas have to be published or even that agendas have to be used. However, the Council's policy is that they use an agenda for their meetings. The Council's policy ist that they have a deadline for items to be placed on the agenda. Iti is not a legal question. It is a policy question that is not her determination. She is just telling Council about the case law that just came out a couple of weeks ago and if Council chooses to listen to that policy and uphold Council's policy, it is Tim. Jones wanted to clarify whether an agenda is published for the Wednesday Town Council Business Meetings. Kim Hemric confirmed that an agenda for the Wednesday Town Council Business Meetings is Bill Jones made ar motion that Council adopt the agenda with no changes. Vicki White-lawrence seconded Mayor Braswell suggested removing the words "add to", "delete", and' "change" from the agenda. Items can be continued and re-arranged. Katy Gregg thinks that deleting items is fine if Council doesn'twant to discuss it. The problem is the transparency issue and making sure Council isn't voting on something without giving Town citizens an opportunity to be heard. ABOUT THE PROPOSED WATER AUTHORITY: Joe Thacker, 7936 Lester Road, Stokesdale, wanted to speak about the future of Stokesdale. He has lived in the Town of Stokesdale for more than 45 years. He has watched Stokesdale grow and change over the years. The Town was incorporated, the water system was built, and the new Town Hall and Town Park engineering firm to represent Stokesdale. to add thati item to the agenda. Council's decision. not published. the motion. could cause the appearance ofi impropriety and lack oft transparency.- motion carried with a 4to1v vote. 4to1 1vote. 2 April 13, 2017- Regular Town Council Meeting were built, which het feels were good changes for the growth oft the Town. He's noticed that changes have slowed down during the last few years. Recently there has been growth with new houses being built in Stokesdale and the water system is a big part of that. However, there has not been much commercial or retail business development in Stokesdale. In order for the Town's economy to grow, he thinks there needs to be more ofal balance with more retail and business space for downtown growth. The Town Park playground and soccer fields are being developed. He feels that it's time for other things to be added to the Park for expansion sO more people can use it. He suggests more shelter from the hot summer sun be installed over the playground and seating areas. Additional playing fields could also be useful. He also feels that Stokesdale needs a new post office location, because the existing post office is hard to get to and parking is limited and doesn'ts serve the community the way its should. He feels that would add to the Town's economy and give people an opportunity to work, grow, and stayi in Stokesdale. Houses are being built, but he feels that people just sleep in Stokesdale. They don't work or shop in Stokesdale and new businesses would create jobs and places to shop. He also feels that an ABC Store is not a good idea if the only reason is for revenue, because it puts people against an ABC: Store in Stokesdale at a disadvantage. He thought that removing the expense of a deputy would have resolved the money issue for a while. However, he hears that the Town is still short of money and he doesn't understand that. He thinks they are prolonging the inevitable which is a property tax. He doesn't like taxes, but doesn't mind paying a small property tax if he can see what the money is being used for. He wants to see if other citizens feel the same way. NEW BUSINESS: Report from Guilford County Sheriff's Department: No deputy was present to give the report. The Finance Report- = March, 2017: Philipl Pulliam, Budget Officer, provided details about the General Fund, Water Enterprise, and Water-Sewer Financial Reports for March, 2017. (Please see the Financial Reports, Consider Facility Use Agreement from NC Sand' Volleyball: Mayor Braswell said hei inspected the sand volleyball area and two new volleyball nets and sand are needed. Although fees had been previously Katy Gregg cautioned the Council, as she has before with waiving fees, that they have to make sure that they are not being given an emolument or a privilege, so they can'tj just waive fees just because they want to be nice. They have tol be very careful iny waiving feesini making suret that therei is absolutely nof favoritism shown and no discrimination shown. The Constitution of North Carolina says you cannot give someone a privilege or an emolument, and ify you're going to be doing something like that, your need aj policy that sets out we will waive in A, B, C, and D situations, and that way it can be checked to make sure. All Council members voted aye Resolutions (3) for NCDOT Road Additions: The three Resolutions pertained to Moore's Mill Road, Bill Jones made a motion that Council authorize the Mayor to sign these Resolutions with these three streetsi in Old Moore's! Mills subdivision. Frank Bruno seconded the motion. All Council members voted aye and the motion carried. UNFINISHED BUSINESS Stokesdale Water System: Citizens' Comment Period ont the Stokesdale' Water System and the Proposed Regional Water Authority: John Flynt, 8133 Belews Creek Road, Stokesdale, wanted to know if the agenda item, Continued - Emergency Access Water Usage Policy, was continued from a previous meeting or are they continuing it from tonight to a meeting in the future, because he thinks there are at few people that would like have some input in that discussion. Mayor Braswell said that following their joint meeting with the Stokesdale Town Council and the Stokesdale Fire Board, staff and himself began putting together the Emergency Access Water Use Policy. It's in a draft form which he gave to Council at last Wednesday's (Town Council Business Meeting) meeting for their input. Once Council provides their input, ChiefTodd Gauldin, himself, and staff members will get together and work on a final draft. The reason he wanted it on the meeting agenda for tonight is because it is a very important item. It will stay on the agendas for the Wednesday Town Council Business Meetings and Regular Town Council Meetings until this Council adopts that as policy.J John Flynt said that speaking asa citizen and also as a membero of thel Board oft the Fire Department, he knows that there are others on the Board, as well as the Fire Chief, who have some great concerns about the rough draft proposal that they've seen today, and before Council votes on it, they would certainly like to have some input from citizens on it. He would hope that these discussions would be held at the Thursday Regular Town Council Meetings rather than the Wednesday Town Council Business Meetings which are inconvenient for citizens to attend. That policy just doesn't make sense. In their opinion, they would be the only municipality in the country to preclude fire trucks from tying onto the Town's water fire hydrants without al backflow prevention valve. It just seems extraordinarily restrictive and they have some grave concerns about it and they would like those concerns to be heard before the Other Issues Pertaining to the Water System: Mayor Braswell advised Council that they began the Mueller training process for the hotrods last week. Het thinks they need experts that understand the potential of backsiphonage to look at that and bless that procedure, because they are connecting to the Town's drinking water supply, sO this does have to be addressed. Once they get to what they think isat fair policy, Council will meet with Chief Gauldin and the Fire Board. Hei thinks that it's very important they get to this part. Council has worked on al Bulk Water Policy and it's been implemented andi is working for the Town. The emergency side ofi it is something that's going to require aj joint effort. Obviously, no one is going to stop anyone from getting emergency water, but he thinks they have to put something solid in place SO John Flynt thinks that the Town's neighboring fire departments should be a part of this. Before Council sets policy, he hopes they would have an open discussion with the Fire Department. Backflow prevention valves that go on a fire truck may not even be available on the market from a manufacturer. Those are. the kind ofi issues that need to be discussed before Council writes a policy. Mayor Braswell said that was a piece of paper that he put his thought down on. There is no policy. This is a worksheet document that Council is working on. Evidently, someone gave this draft to him. He doesn't have anything to hide. He just wants Council to have an opportunity to work on it. When he feels they have something that makes sense, then they will go to the Fire Department with it. Backsiphonage is a very important part of this. Council is in the very first stage of this. There are two reasons for this policy. He doesn't thinki it's fair for avery small group of citizens (on the water system) to pay for water for several fire districts when the district would be able to divide up those costs, and most importantly, they can't risk contaminating the John Flynt said that there are fire departments all over the country and no other fire department seems to be concerned about backflow prevention. It seemsi ironic that the Town of Stokesdale is the onlyt town that seems concerned about a backflow prevention issue. He thinks that if it was a significant problem, other towns, like New' York City, would have the same concerns about water contamination. He wonders why Stokesdale is the first town that's ever addressed thisi issue. Mayor Braswell: said hei isn'ts sO sure that Stokesdale is the only town concerned about this issue. He assumes that New York City is getting their water from a pressurized system, so the risk ofcontamination exists in arural fire department. Ifit didn't, those air gaps wouldn't be on those fire trucks. Council will meet with Chief Gauldin, and they will work out some of the details that he thinks could be cumbersome ini the event of an emergency. Bill Jones has a problem with a draft document that Council is working on being released to the public and wants to know ifi it is acceptable to release it to the public. Katy Gregg said that it is a difficult question because it's going to depend on what the topic oft the draft document is and where it is. It could possibly be a violation oft the public records law. Bill Jones said that when you are still working on something with one person'si idea on it and someone releases it to the public and it becomes a talking point, which is an inaccurate talking point, then he thinks it presents a problem. He has a problem with whoever on staff or Council released that document. He has a big problem with that. The Mayor said two or three times that once Council has something they think is fair, they will sit down with Chief Gauldin and whoever else at the Fire Department that wants to talk about it. Mayor Braswell said everyone has to work together and hes stillr needs input from Council. This item will be continued until they can come upy with a draft to work with. 5 April 13, 2017- Regular Town Council Meeting Continued- - Lighting Request- Highway 158/Main Street: Frank Bruno spoke with Al Brady, a Senior Engineering Technologist from Duke Energy on Thursday last week. He asked Frank Bruno to count the white (new) lights and yellow (old) lights downtown and get back with him in the next few days to negotiate a price. This agenda item will be continued until the next Wednesday Town Council Business Continued- - Discussion of Needed Park Repairs for May 6th Make-A-Difference Day: Frank Bruno said that $500.00 has been donated for Park repairs. They need to decide what they want to do and what materials to purchase. Discussion took place about various things that could be done. This item will be Continued = Discussion of Engineering Firm to Represent Stokesdale: Mayor Braswell advised that Council has been meeting with three different engineering firms. They need the Resolutioni for Exemption for the Town of Stokesdale from Engineering Services Qualification-Based Selection Process, which is the Mini-Brooks Act. The exemption would be done publicly. Katy Gregg gave a description about what this Tim Jones wanted to know if this can be passed with a stipulation that in the event that does go over $50,000.001 for that particular vendori if Council approves them, that there's some sort ofs sunset built into itthatt their: status as a vendor would expire. Katy Gregg advised that the statute says that exemption will not work for contracts that are over $50,000.00, sO it has to be a contract that is under $50,000.00 in order to qualify for the exemption. Tim. Jones asked if they could put in a self-limiting status where the vendor would automatically expire if $50,000.00 was exceeded. Keith Tuggle Mowing has been doing a good job mowing the grass at a reasonable price. He had asked Keith Tuggle to send Kim Vicki White-lawrence said she spoke to a vendor about the possibility of adding some fitness equipment along the walking track. Ordinance Review Committee: Tim Jones advised that there is a meeting scheduled next week on Tuesday, April 18th, and there are a number of things on the agenda that they are workingon. have been working on updating the Emergency Contact List and the door hangers. She is waiting on a quote from the vendor for the fitness equipment. 6 April 13, 2017- Regular Town Council Meeting Mayor Braswell asked Katy Gregg if she would be attending the Ordinance Review Committee Meeting. Katy Gregg said that as far as right now she is available to attend the meeting. Mayor Braswell thinksitis really helpful. Katy Gregg said it is impossible for her to attend all of the Ordinance Review Committee meetings because they are meeting so frequentlya and because of herwork: schedule and her other clients. She certainly encourages that communication. She has received copies of most oft the ordinances that the committee has passed on and are ready to go through the other channels, SO she can look at them. Frank Bruno asked about the information on the Planning Board members and their terms. Some members' terms have expired and some are willing to continue beyond their terms expiration. The member term information will be brought to the next Town Council Business meeting to be addressed. Departmental and Administrative Report-Town Administrator: Kim Hemric: said that! 535 water bills were mailed out today. This was the first month that the new e-reader system was incorporated for approximately 88 meters. The Town now accepts Visa, Mastercard, and Discover online at olesaemcgpportal.com, twenty-four hours a day, seven days a week. A payment can also be called inb byt telephone to 336-645-3308, twenty-four hoursac day, seven days a week. Payments can: still be made at Town Hall on Monday through Friday from 9:00am to 5:00pm, and a drop box for payments will be installed outside of Town Hall very soon. Alisa Houk was hired a month ago for the internal water position and is doing a phenomenal job. ANNOUNCEMENIS: Mayor Braswell read the announcements listed on the agenda. COMMENTS FROM COUNCIL: Tim Jones thanked eight people for sitting through the meeting until the end. He is still not in favor of a property tax for Stokesdale and he favors limited government. He favors doing only what they have to do and letting the citizens have the freedom to: spend their own money and have the other freedoms afforded by our constitution. The Town still doesn't have their sales and use tax distribution money. He has communicated with the Guilford County Commissioners and it is a hard sell because they can't get the Town's citizens interested in contacting their elected representatives: about it. He knows that Bill. Jones works real hard on this from time to time. He wanted to state publicly that hei is willing to reach in his pocket and give Mr.. Jones a hundred dollars towards a website or any brochures or communication tools that he can utilize and he would challenge the rest of the Council to be willing do that. If he can't donate his time to the cause Mr. Jones has taken up, then at least he can offer him some Frank Bruno would like people to get involved. It was great seeing some people at the meeting tonight. The Planning Board and Ordinance Review Committee need volunteers. Stokesdale doesn't have a property tax and it's nice not to have a property tax, but that means they need more volunteers. They need people to help out and give Town Council theiri input because it helps them do their) jobs better. Bill Jones said that sometimes it doesn't seem like it, but they really do support the Fire Department members attending the meeting. They are the onlyt thing standing between us and some bad stuff, and it'sr notonly fire. He really appreciates being able to depend on them to show upy when called in an emergency. He does have someone helping him build a website and is stilli in contact with the Guilford County Commissioners: about the sales and use tax distribution money. He thinks ift the money is raised in Stokesdale, its should stay in Stokesdale. Just because Stokesdale doesn'tchoose toi impose a property tax cash. He would like to thank everybody for coming. shouldn't prevent them from receiving sales and use tax distribution money. 7 April 13, 2017- Regular Town Council Meeting VickWhite-lawrence saidi its seems that they are all on the same pagei ini terms of asking for feedback. She doesn'theart from people al lot. She usually only! hears from people whent they are upset about something. The downside to that is that Council is not always able to respond the way some citizens want them to, but she thinks they all try to be as responsive as possible. That'sat tradition that Stokesdale Town Councils have had for years. They do the best they can. She encourages everyone to continue letting Council know ift there are issues that need to be addressed. They don'tknow unless someone lets them know. Mayor Braswell confessed that he doesn't read the local news, sO if anyone has a problem or anything good to say, they are going to have to call him or come see him. He has expressed many times over the years why he stopped reading it, sO if someone sees him someplace like at a restaurant and he doesn't react the way they expected, he didn'tread about it. The local paper calls him and asks him questions and he does the very best he can to give at fact-based answer. Not his opinion, but what he'sl learned by serving asa Town Council member of Stokesdale. He wants to make sure everybody hears him. He thinks that there were some views expressed at the meeting tonight that were not the views oft the entire Board. He honestly believes this is one of the greatest communities that you can live in and he believes that both of these Boards (Town Council and the Fire Department) work together and support each other. He has always supported the Fire Department members. He's been to Raleigh to fight for the Stokesdale Fire Department and this district to get an increase, sO he would like their help supporting the Town's water system. To trya and sensationalize bits and pieces of the draft, he thinks is not a fact-based statement. The leadership of these Boards will take this to the community. He thinks it'sag great opportunity for the Fire Department to support the Town's water system. Let's work together to get the facts to the people. This isa very intelligent community. He understands that there have been some complaints and safety concerns about the Town Park, sO he would like license plate numbers and pictures of the individuals responsible sO they can got to jail. ADDITION OF STREETS OR ROADS TO THE NORTH CAROLINA SYSTEM OF SECONDARY ROADS OLD MOORE'S MILL SUBDIVISION WHEREAS, the Town of Stokesdale wishes to cooperate in any way possible with the North Carolina Department of Transportation, Division of Highways, to place streets and roads within the incorporated limits of the Town on the North Carolina System of Secondary Roads, operated and: maintained by the North Carolina DeparmemtofTampomution, and WHEREAS, certain property owners within the Old Moore's Mill Subdivision have petitioned the North Carolina Department of Transportation to accept for state maintenance of Moore's Mill Court as is defined on the Old Moore's Mill Subdivision Plat as recorded on December 15, 2006 in Plat Book 167, Page 134 of the Guilford County Register of] Deeds Office; and WHEREAS, Moore's Mill Court is a twenty (20) foot wide, paved road, spanning approximately 0.11 miles in length, with ai fifty (50)fotrightofway: and certain utility easements; and WHEREAS, the North Carolina Department ofTransportation, Division ofH Highways, has conducted a Secondary Road Addition Investigation and drafted a Report, dated May 03, 2016 indicating that such road meets the minimum requirements for addition into the Secondary Road System ofthe State ofNorth Carolina; and WHEREAS, the cognizant District Engineer of the North Carolina Department of Transportation does recommend the addition ofMoore's Mill Court to the Secondary Road System ofthe State ofN North Carolina; and NOW, THEREFORE, BE: IT RESOLVED, that the Town of Stokesdale's Town Council requests that subject street, Moore's Mill Court, be added to the North Carolina System of Secondary Roads upon meeting all criteria as established by thel Department ofTransportation. 13+h (KW) This the 12th day of April, 2017.
