TOWN OF STOKESDALE REGULAR TOWN COUNCIL MEETING 8325 Angel Pardue Road STOKESDALE, NC: 27357 August 8, 2019at7PM I.Call to Order: Mayor Flynt brought the meeting to order. Attendees: Mayor Flynt, Mayor Pro Tem Hooks, Council: Frank Bruno, Deanna Ragan, Tim. Jones, Town Clerk Alisa Houk, Town Attorney Michael Thomas. II. Invocation: Allen Mears, Bethel United Methodist Church II. Pledge of Allegiance: Lead by Mayor Flynt IV. Review and Adopt Agenda: Tim Jones asked that Council consider moving the announcement ofa Special Called Meeting on 8/16/2019 regarding the NW Guilford Feasibility Study to an agenda item so it may be discussed. He would like to see it made Agenda Item # 8. Mayor Flynt asked ift there were any objections. No one objected so this item was added to the Agenda as Item # 8 for discussion. Tim. Jones also said that he has had a number of citizens voice concerns about work being done by NCDOT in the way ofs surveying and planning for al highway project. He doesn't have the project in front of him but he believes it is going to be a widening along Hwy 65 to Hwy 68. Mayor Flynt stated that he doesn't believe iti is going to be a widening project, but yes there may be some changes made, SO yes, we will talk about the highways. Make that # 91 to discuss highway projects they may come in the next months. Mayor Flynt motioned to add numbers 8 and 91 to the Agenda. Thearon Hooks seconded the motion. Mayor Flynt answered yes, she came in privately on 8/6/2019 and was sworn into office. Mayor Flynt introduced Deanna to the Citizens. He also introduced Attorney Michael Thomas, who is stepping in this night for Tom Medlin who could not be here. Attorney Thomas works ini the same firm with Attorney Medlin and they will be standing in fore each other in situations where they are available the night ofar meeting. V. Approval of Minutes: July: 11, 2019 minutes: Mayor Flynt asked for a motion. Thearon Hooks motioned to approve the. July 11, 2019 minutes. Frank Bruno seconded the motion. Jones: No Deanna Ragan: Yes Guilford County Sheriff's Report: Captain Hall reports that ini the month ofJ July there were 87 calls fors service. There was no violent crime, 1 burglary, 31 thefts. Hei told us that he is going to be moving into another position in another area in August and that Captain George Moore would bet taking his place at Stokesdale Fire Dept Report: Chief Todd Gauldin said Stokesdale Fire Dept. had 63 calls for service in the month. July, 40 medical calls and 231 fire related calls. For the Fiscal Year ending June 30, 2019 the the meetings. Fire Dept. had serviced 978 calls. VII: Citizen's comments from the floor (3 Minute Limit per Speaker): Eileen Thiery from Springdale Meadows: Says she was asked by Ann Kallam to speak about thei traffic, speeding, and rumors of allowing twin trailer trucks to drive on NC Hwy 65, between US Hwy 158 and US Hwy 68N. She said there is too much: speeding. They want to know ift the Town can do something to slow Pamela Thomas Hwy 65: Daughter of Ann Kallam wants to know why there are passing zones on this same stretch of highway? She also wants to know why we don't have more sheriff's monitoring this area. Pamela then presented the Mayor with a petition signed by some residents protesting the Janet Brown from Dorsett Downs: complained about Republic Services request for an increase in rates when their service history is bad. They miss pickups, they break cans and don'treplace them in a timely Iral Landis from' Weatherstone: complained about Republic Services. Said they broke his recycle can and he has been calling weekly forar replacement. Its been 6 weeks and he still doesn't have a new can. Mary Maness from Tree Court: Says water stuffi is messed up. Its being sold but she still doesn't have it. She also says that the cut through at Hwy 158 and Hwy 68 on Clintwood should be shut down before Mary. Jordahl from Stokesdale St: Is complaining about Priority One parking the cars and trucks he has for sale in the median along Stokesdale St. and blocking the view of people coming out onto Hwy 158 from Vaughn St. She iss surprised there haven't been more accidents than there already. She counted 16 cars in the median today. Mary then brought up that the properties including hers along Stokesdale St. are losing value because oft the old abandoned home next to the old Hunnicutt house, and the abandoned house and trash all over the yard that belongs to Tim. Jones. Mary wants to know when the Town is going to make him clean up his properties? She also said the town needs to have Deputies down the traffic and to not allow twin trailers on this stretch of road. widening of Hwy 65 and allowing twin-trailers. manner. someone gets killed. 3442 taking care of the drug problems in Town. She says she witnesses drug deals in the cemetery behind her Mayor Flynt explained that Council can ask our planner to research the zoning of the median that runs along Stokesdale Sta and Hwy 158, but it won't be an easy task and won't be a quick fix. These properties are not owned by the Town: SO the Town has noj jurisdiction over them. He told the crowd that it took house weekly. the Fire Dept. over 6 years to claim ownership oft their section oft the median. VIII. New Business: 1. Republic' Waste Presentation: Anthony Krasienko, Municipal Service Mgr. for Republic Services: In answer to some oft the complaints tonight, Anthony said he agrees that Republic Services has had some service issues and they still have room to improve. Anthony gave aj power point presentation oft the services that Republic Services offers and what their cost are to provide these services. He then gave us al break down of what amendments Republic Services is asking us to make to our Franchise Ordinance Agreement with them. The Second. Amendment proposed by: Republic Waste Services A. The Town and Republic entered into that certain Franchise Ordinance and Agreement for Residential Solid Waste and Recycling Services, dated April 20, 2006, as amended and restated pursuant to the Franchise Ordinance and Agreement for Residential Solid Waste and Recycling Services on October 27, 2011, as amended by the First. Amendment to Franchise Ordinance and Agreement for Residential Solid Waste and Recycling Services dated July 1, 2016 (collectively, the Agreement"). B. Republic is now: asking the Town to agree to extend the. Agreement and modify the terms as identified below. 3. Section 6 entitled Frequency ofF Pickup is modified to provide that Republic will provide recycling curbside collection services once every other week, for a total of26 collections per year. Republic shall continue to provide once a week residential curbside collection services for solid waste to any resident in the Town who desires and contracts Republic for such services. Fora a Total broken down as follows: $12.33/month- -1 1x/wk Trash $3.50/month EOW Rec Collection $2.33/month Rec Processing $18.16/month total $54.48 per Qtr At the suggestion of Attorney Thomas, Mayor Flynt motioned to refer the Republic Services amendment request to our Town Attorney Tom Medlin fori review and after his report back to set a Public Hearing in the September 12, 2019 Town Council Meeting for the October 10, 2019 Town Council Meeting. Frank Bruno explained that thei island near the concession stand needs to have curbing installed around it. Due to drainage issues from rain and snow run off water runs under the parking lot and is eroding the pavement and washes grass, mulch and anything put int the island out and leaves mud and mess it is also destroying the sidewalk. Frank looked ats several options and obtained a quote from Beaver Outdoors for $45001 to install curbing to reroute water and prevent continued erosion. He asked Gene Robertson for Yates Construction for al bid as well but when Mr. Robertson saw Beaver's bid, he said he couldn't do it for less than what they Bid. Frank Bruno motioned to approve Beaver Outdoor Solutions bid of $3800. To maximum of $4500.00to install curbing around the island in question. Thearon Hooks seconded the motion. Planning Board Rules & Procedures: Frank Bruno said he has been helping staff look at the Rules and Procedures oft the Planning Board, who is on the active board and who are alternates, whoi is overlapping who. He stated the chart was almost impossible to figure out but they finally did. He said then one oft the staff asked about the Rules and Procedures and whether they were being followed as they should. The Rules and Procedures oft the Planning Board arei in everyone's folder tonight andi it looks like these Rules and Procedures were written up by the Planning Board themselves. This is fine but he also found in our Town of Stokesdale Ordinances Under Administration: Article 9-2.2 That the Planning Board shall consist ofi five members and mayl have alternates, appointed by the Town Council. Frank went on to describe the appointments within the Planning Board of its officers and their duties. Hei isn'ts sure how or why the Planning Board went from 5 members to having 7 sitting members during meetings because we only have 5 sitting Council members there shouldn'tneed tol be but 5 sitting Planning Board members. His feels we should, go back to the Town's Ordinance policy and procedures for the Planning Board and go back to! 5 sitting members and if they want! 5 alternates to cover absences that is fine. He commended everyone that volunteers to sit on this Board and thanks them for their services but he feels that we need to go back to the Town's Ordinance and Article 9. Attorney Thomas agrees that Stokesdale's' Town Ordinance, Article 9 rules supersedes and Rules and Procedures written by the Planning Board. He reiterates that the Planning Board serves at the pleasure of the Town Council. Tim. Jones made a motion to have the Town Clerk research and fine the minutes where these Planning Rules and Procedures were voted on to be changed from the original Town Ordinance, discuss these changes review withi the Planning Board and make any comments known to us and bring back to another Council meeting. Discuss and vote on revisions to' Town Park Rules and Regulations: Town Clerk Alisa Houk asked Council to consider allowing her to make corrections to the hours of operation, take away the 30-day advance notice rule. Frank Bruno motioned to approve the changes to the Town Park Rules and Regulations. Mayor Flynt seconded the motion. Vote: Mayor Flynt: Yes Thearon Hooks: Yes Frank Bruno: Yes Deanna Ragan: Yes Tim. Jones: Yes 5. Discuss and vote on revisions to Water Application. Town Clerk Alisa Houk asked Council to consider allowing heri to make corrections toi the Water Application to correct the cost of1 the customer service fee from $30.50 to $25.00 which was voted on several months ago. Also, to change the Impact feei to Capacity Use Fee and make some areas bold SO citizens may see them better. Frank Bruno motioned to approve the Town Clerk to make these revisions. Review of current Budget versus Actual Financial Statement for 2019-2020: Mayor Flynt turned this topic over to Tim Jones as this was added to the agenda by him. Tim Jones said yes this was his request and that this afternoon at about 4pm he just received the financials that he hopes are the financials that he has been asking about for several months now. He thinks he sees them but he certainly hasn't had an opportunity to review them. He would like the Finance Officer to lead us through them. Mayor Flynt spoke up and said well the Fiscal year from July 1, 2019 -June 30, 2020 just began. July: 1, 2019 sO the only month that would be included on these financials is the month of July. The bank statements for. July 1-July 31 have not come in yet so the Finance Officer and Budget Officer are not able to reconcile July until those statements come in. So, at this time we don't have financial statements for the first month (July) of 2019. Tim said well up until up until this year the Town of Stokesdale has been printing up al Budget VS. Actual every month. Mayor Flynt said you have a lag time. There is no way to have accurate financial records for a month until the statements are reconciled. 7.Review of current Budget versus Actual Financial Statement for 2018-2019: Town Clerk. Alisa Houk told Tim. Jones he has in his hands the Budget VS. Actual Financials from July 1, 2018 through June 30, 2019. Frank Bruno brought up that we can't officially close out. June 30, 2019 Budget ending until we receive the balance of State Utility Franchise Tax money until the check comes in September. Mayor Flynt stated that we are currently: showing 2018-2019 over budget in General Fund by $36,920. Butas Frank said we willl be receiving $6603.00 refund from Sale Tax, approximately $ 89,586. In the Utility 8. Announcement of a Special Called Meeting on 8/16/2019 at 10:00am to discuss the NW Guilford Feasibility Study: Mayor Flynt announced that we are going to call this meeting to talk with both of our Franchise tax. Which will bring us to a positive ending budget of $52,660. 3445 engineering firms McGill and Associates, and Hazen and Sawyer and share thoughts about the future of anyi involvement int the Feasibility Study and where it has been going fori the last couple ofy years between Stokesdale, Oak Ridge, Summerfield, and members of the Board of Guilford County. Based on conversations with Mayor Sullivan of Oak Ridge they are not going with the Water Authority. Mayor Flynt wants this discussion to bring all of Council and Citizens upt to speed on Stokesdale's interest. 9. Discuss highway projects they may come int the next months: Tim Jones asked the citizens in the audience to raise there had if they are concerned about the work going on around Hwy 65 and Hwy 68. There were only a couple of hands so Tim said apparently most of the citizens concerned have already left the meeting. Tim would like to contact NCDOT to come and address the public and council. Mayor Flynt addressed concerns by saying that the NCDOT is doing studies but these studies are still in the drawing stages. They do plan to hold al Public Hearing sometime int the Fall. Possibly in November close to Thanksgiving. Tim. Jones asked the Town Clerk to make notes oft the two project numbers that may include some of the items discussed tonight regarding Hwy 65 and Hwy 68. Project numbers TIPR-5823 and Project 47095.1.1. X. Committee and Board Reports: Frank Bruno reminded everyone that we have the Farmer's Market beginning 8-20-2019 and continuing every Tuesday evening from 4 -7 7pm in the Town Stokesdale Town Hall 911 Memorial will be held on front walkway under the flags of Town Hall on 9-11- Stokesdale 30th Anniversary of Incorporation will be held in the Town Park on 9-21-2019 beginning at Park parking lot through October 28, 2019. 2019 at 11:00am. (We would like someone to sign the National Anthem). 1pm Rain Date will be 9/28/10. Franki is looking for someone to play music during the celebration. Mural Dedication and Clock Dedications will take place at 11am also on 9-21-2019 outside beside the clock and Mural in downtown. These dedications willl be held by The Friends of Stokesdale. Christmas Tree Lighting and Christmas Parade are still in planning stages. XI. Departmental and Administrative Report: Town Clerk Alisa Houk gave the financial reports..attached. Also, Alisa Houk announced that we finally received our $75,000. Check from FEMA for the repairs that had to be done to our water line along Hwy 158 due to erosion from heavy rains during Hurricane Florence. XII. Closing Comments from Council Deanna Ragan agreed let's make these meetings shorter and shorter that's all she has to say. Frank Bruno talked about the tragedies of 911 and others since then and just asked everyone to keep the people involved in these tragedies in their prayers. 3446 Thearon Thanked everyone for being here and staying and talk al little also about the tragedies of 911 Mayor Flynt reminded everyone that we hope to have the maintenance and painting of the Elevated Water Tank completed by next week and have it back online.
