Review and Adopt the Agenda: Town Attorney Tom Medlin addressed the Mayora and Council regarding Item #: 3in Old Business; Vote to Approve 2019-2020 Budget Amendment to increase budget for Attorney Fees by an additional $ 25,000. and: said after some research he discovered that according to General Statutes only a majority vote is required to approve a budget amendment so the vote during the September: 12, 2019 Town Council Meeting stands as approved. Mayor Flynt said that the second part of item 3 in old business willl be discussed when they reach that item on the agenda. Mayor Flynt asked for a motion to adopt the Agenda. Jones said he found a discrepancy in the August 8, 2019 minutes. Mayor Flynt asked him what the discrepancy was that if it was something simple maybe it could be corrected tonight. Tim. Jones said he couldn'ttell them what the discrepancy is without hearing the audio. Mayor Flynt motioned to continue the August 8, 2019 Town Council meeting minutes until the November 14, 2019 meeting. Tim. Jones seconded the motion. Jones asked Mr. Medlin ifi it was okay to go ahead with the discussion he had with Mr. Medlin. Mr. Medlin told him it was okay to go ahead. Tim. Jones said that he Book 13 Page 3456 had asked the Town Clerk to reflect the discussion that took place regarding the Point of Order when Tim Jones asked if Bill Jones could: speak on the agenda item regarding the MBD proposal and that point of order is not reflected int the 9-12-19 minutes. Tim: said he believes Mr. Medlin is in agreement with him on this. Mr. Medlin spoke up and said let me clarify whatIsaid. Mr. Medlin verified that they were discussing Item #7 on page 5 at the bottom oft the page. Mayor Flynt answered yes. Mr. Medlin read the two sentences: Tim. Jones wantedi the Mayor to allow Bill Jones to: speak on this matter. The Mayor said this is a matter of Council and there is no Public Hearing to hear from thej floor. Mayor Flynt called fora Mr. Medlin said in between these sentence that Mr.. Jones did ask fora a Point of Order to allow Bill Jones to speak. And att that time Mayor Flynt called for a vote. Tim. Jones wanted this reflected int the minutes. At this time Tom Medlin turned back to Tim. Jones and ask how he wants the minutes amended. Tim Jones didn't say anything for a minute. Mayor Flynt went back to those sentences and read them again and stated that he did recognize Tim. Jones request to allow Bill. Jones to speak and he believes that satisfies what Tim. Jones is asking for. Tom Medlin asked Tim. Jones again ift there was other wording, he wanted added or did this satisfy the subject. Tim. Jones said, Mr. Medlin Icalled for a Point of Order to appeal the decision of the chair at that particular point in time sO the entire council could vote as to whether or not Bill Jones could speak or not and Idon't think the minutes as written accurately reflect that. Mr. Medlin asked again what wording would you suggest to make the minutes correct? Tim Jones said well, Mr. Medlin generally, lam against voting on any minutes until they are written and in draft formi in front of all of council. Mayor Flynt said Tim these minutes have been in your file folder since last Friday, that should have been plenty of time to review them. Tom Medlin said he will go back and say the minutes are not a verbatim transcript of what happens, it's a summary. Tom again said Tim if there iss something you think needs to changed or added you need to provide it. Ify you are not able to provide iti now then you may want to continue this sO you can provide the verbiage to be inserted sO next time this comes upi it is complete. Tim. Jones then motioned to continue the 9-12-19 Town Council minutes until the November meeting. Mayor Flynt asked for a 2nd on Tim's Motion. There was no 2nd sO the Mayor said due to lack of a 2nd the motion dies. Mayor Flynt motioned to approve the minutes as written and asked for second. Tim interjected with his motion to continue again. Again, there was no second: so his motion died. Public Safety Reports: Guilford County Sheriff's Dept: Sgt Eric Gordan In September there were answered 97 calls for service. Many were minor calls such as alarms and minor disorders. There was 1 Major Part1 1 Crime which wasa a commercial burglary where money was taken. There were 51 residential burglaries. Mayor. John Flynt stated we had ani incident in one oft the neighborhoods where cars were broken into and we havel been advised to always lock our cars. Sgt. Gordan indicated: 2 vehicle thefts and 3 cars broken into in that neighborhood and the vehicles were recovered in Winston Salem and suspect this was by juveniles. Always lock your cars. Stokesdale Fire Dept.: Deputy Chief Randy Southard In September there were total of 80 calls and 35 were related to non-rescue (building, vehicle fires, fire alarms, hazardous material fires related to non-rescue and 45 rescue or medical type calls. This is fire prevention week and recommend changing batteries in smoke detectors and make escape plans at your home. Sheriff Dept. Sgt Eric Gordan wanted to commend: Stokesdale Fire Dept.) with their help in the recent bus crash on Hwy. 68 in the fast response time and the safety of the children. VII. Citizen's Comments from the Floor (3-minute Limit per Speaker) Bill Jones spoke and said he was here tonight as ai former Council Member and currently owns property in Stokesdale. He has audio that will erase some oft the confusion from last month MBD Proposal andi is longert than 3 min. and should be about 10 min. Councilman Frank Bruno aski if the audio had been edited and Bill Jones responded he had one that was 24 min. long. Councilman Frank Bruno: stated "then it's been edited". Bill. Jones stated "the one thati is 24 min. is not edited". Councilman Frank Bruno stated "youl have 3 min. sO whatever you can playi in 3 min." Mayor. John Flynt said if he would like to bring his audio into Town Hall, Council would be glad to listen to it and address his concerns. Bill Jones played the audio which had sO muchi interference no one could understand what was Steve Kingsbury feels the break-ins are related to the staffing at Guilford County Sheriff Dept. and as of Oct. 1stt they had 95 vacancies which is 14.5%. He supports 100% our deputies doing their jobs. Mayor Flynt commented there was a change in administration and there were deputies relieved of their duties and others chose to seek other employment. The ones left are working long hard hours. You should voice your complaints and concerns to the Sheriff of Guilford County and call the County being said. Mayor Flynt ask Bill. Public Hearing Friddlewood Drive (A): Adopt Resolution of Intent to Abandon Secondary Road 2110 (Friddlewood Drive) as authorized by NCGS 136-63. (B): Adopt an Book 13 Page 3458 Ordinance and Order to Close Friddlewood Drive, pursuant to NCGS 160A-299. Attorney Tom Medlin advised tonight we can only handle (A) Adopt Resolution of Intent to Abandon Secondary Road can be handled as this is required back tot the DOT SO they can remove it from their State Maintenance System. We will need to wait until DOTI has officially taken off of their Secondary Road System. Can handle Public Hearing on the closure of Friddlewood Dr and take public comments on that, just don'ttake any action ont this. You can take action on Resolution and pass that hopefully and have public hearing on the closure of Friddlewood Drive. Matt with Guilford Co. filling in for Oliver Bass presented the case. Mayor Flynt motioned to Adopt the Resolution based on the fact that it willl bei ini the best interest oft the people of the Town of Stokesdale and no property owner would be deprived of reasonable means of egress to their property and there would be no negative impact for maintenance being abandoned. Eileen Thiery wanted to make a suggestion that the gentleman taping might have the minutes of the meeting Bill Jones was talking about. She asks directly if he had this. Don responded he was not sure. Tim. Jones stated the meeting date was March 14th 2019 and the audio Bill Jones Randy Brasswell wanted to introduce himself again. Offered to anyone that would like to contact him regarding his candidacy to feeli free to contact him. He wouldn't spend huge bucks too campaign. If he gets a chair there will be no monkey business, no Quid Pro Quo. He will run the town like his business. He supports Stokesdale Fire Dept, PTA and Stokesdale Parks & Rec 2. NCDOT has requested that we vote to amend thet four attached Speed limit Ordinances to match the changes they have already made. Ordinances: 14, 25, 41, and Add Ord.105. Ordinance to Repeal Ordinance #14 speed limit was set Feb.14, 1991 portion of 158 to! 55mph and in Nov. 18, 1999 decreased to 45mph. Ordinance #14 is no longer necessary. NCDOT ask has is very clear. and Park improvements. us to repeal this. Tony with Republic Services gave reasoning fori the increase. Rated at time of Contract: Disposal $36.00 Current $42.00 Cost of Recycle Processing $20.00 Current $135.00 Diesel Fuel $2.45 Current $3.05 Potential increase was $2.98 Now $2.33 There are only 21 towns int the area with weekly recycle. Ift the customer needs al larger can they can be delivered toi them. To go to every other week this will make the roads safer with recycle trucks only being on the road 26 weeks a year instead of5 52. This will also cut down on repairs to Mayor Flynt request confirmation on the cost: Present is at $50.49 and new rate willl be $54.48 with recycle going to bi-weekly. This would be a monthly increase from $16.83 to $18.161 Tony Steve Kingsbury's complaint on the billing that was made retro. July, August & Sept now: showing Elleen Thiery agrees with the increase and is happy with her trash being picked up. Ini the last John Flynt advised complaints have been going up and the gentleman working with the Town is no longer with the company. Tony will have a new person assigned to us to check in at the end of the day every Wednesday. Thearon Hooks ask what is the current number of residents being picked up in Stokesdale. Tony advised 1447. Frank Bruno ask if we choose not to agree to every other week what would be the price per month. Frank Bruno stated we do have our Quick Books and that is backed up however we would need for the whole system and this would be a yearly contract $875.00 with tax $934.06 but we do get the tax money back. Tim. Jones said we previously had back up to the Cloud. Frank Bruno stated only back up was to the hard drive on one computer in house, never to the Cloud. Tim. Tim Jones is afraid we will encourage people to hang out inj park when we don't want them to and if power is not shut off anyone can use the lights and receptacles. Reconfirm Stokesdale Planning Board Rules of Procedure Frank Bruno presented with discussion of Rules for Terms allowed, Chairman, Vice Chairman and Planning Board Members. Tim Jones stated most towns are at $.10 and our cost is too high and he feels we are not following the Statue. Atty Tom Medlin there are other provisions when there are large quantities needed and it is upi to the Town to determine the cost and not to make a profit. He gave example: Clerk of Court and Resister Book 13 Page 3464 of Deeds the fee is $1.00 for 15t page and $.25 for every copy their after. The Mayor advised when considering the cost, you have to consider cost of paper, ink, copier Flynt and Tim. Jones motioned we reduce the cost of a single sided from $.25 to $.10 and we reduce the cost of CDs from $5.00 to $2.00. NO second/ motion dies for lack of second. staff time. IX. Old Business: 1. Jones stated he feels Mr. Medlin is not hearing him and feels he has a right on the: statue to have access to the Atty Medlin. Also, he rejects to information being withheld from him and he is part oft the Board. He asks Atty Medlin if he feels he could defend this in Court and both parts of this is legal. Atty Medlin stated "yes". He presented this as alll have access to him without going thru a Staff Member ort the Mayor, but come directly to him. He will respond to all Council Members with the appropriate response. And there may be limited situations hei fells may not be appropriate at that time to respond to all, but will advise Council at that moment however, he will notify all Council he had been ask a question and by who and when he responded to that question. He drafted this as such and feels this is fair to all Council Members. Tim. Jones said thank you for addressing my questions. John Flynt commented there mayl be a number ofi items that cannot be responded to as then this would become Public Record. John Flynt is that one of the privileges that Members of Council has when you are elected and sworn in, they are, given a Master Key to the building and aj personal access code toi the security system to have direct access for after hours.
