MINUTES OPEN SESSION TOWN OF STOKESDALE 8325. ANGEL PARDUE ROAD STOKESDALE, NC27357 SEPTEMBER 02, 2021@5PM SPECIAL CALLED TOWN COUNCIL MEETING Members present were: Mayor John Flynt, Mayor Pro-Tem Thearon Hooks, Council Members: Jim Landreth, Derek Foy, Jim Rigsbee, and Deputy Clerk Priscilla Hunsucker. Town Attorney Tom Medlin attended via Zoom. 1. CallTo Order, Pledge of Allegiance, and Invocation. Mayor John Flynt called the meeting to order and Councilman Jim Rigsbee led the Pledge of Allegiance and delivered the Invocation. 2. Citizen's Comments from the Floor (3-minute Limit Per Speaker) None presented. 3. Discussion on Land Acquisition of property on Athens Road. Mayor Flynt stated that we did not advertise this meeting as a closed session and asked the Town Attorney ifthe Council could go into closed session to discuss this matter. Mr. Tom Medlin, Town Attorney explained that if Council is simply going to accept or reject the offer then that was an open session matter. However, ifCouncil wants to discuss the details, then a closed Mayor John Flynt made a Motion to enter into Closed Session at 5:05 PM for the purpose of S 143-318.11. Closed sessions. (a) Permitted Purposes. - Iti is the policy of this State that closed sessions shall be held only when required toj permit a public body to act in the public interest as permitted in this section. A public body may hold a closed session and exclude the public only when a closed session is required: (5)To establish, or to instruct thej public body's staff or negotiating agents concerning the position tol be taken by or on behalf oft thej public body in negotiating (i) the price and other material terms ofa contract or proposed contract for the acquisition of real property by purchase, option, exchange, or lease; or (ii) the amount of compensation and other material terms of an employment contract or proposed employment contract. Vote in opposition: None Motion carried. Mayor Flynt made a Motion toi reconvene in Open Session at 5:51 PM. Councilman Foy Vote in Favor: Councilman Rigsbee, Councilman Foy, Councilman Landreth, Mayor Pro Councilman Foy made a Motion to accept the offer toj purchase land at 7901 Athens Road, Stokesdale, NCi in the amount of $214,000 with a closing date of September 30, 2021. Councilman Jimmy Landreth asked for an amendment to the Motion to designate $100,000 be Councilman Foy agreed to the amendment. Councilman Rigsbee seconded the motion. Mayor Flynt expressed his concern with this purchase that Council had agreed to $205,000 as our best offer. He: noted the offer is $24,000: more than appraised value. Councilman Foy acknowledged the Mayor's concern and stated that he was. not sure what the property is actually worth but pointed out that this is al unique piece of property adjacent to Town Hall and our park Councilman Rigsbee stated that he agrees with Councilman Foy and stated that he hoped the Vote in Favor: Councilman Rigsbee, Councilman Foy, Councilman Landreth. Vote in Opposition: Mayor Pro Tem Hooks and Mayor Flynt. paid from the parks budget. and believes it tol be a good investment for the Town. Council could move forward as a group on this matter. Town Attorney Tom Medlin asked for a motion to authorize Councilman Jim Rigsbee to sign on Councilman Derek Foy made a Motion to authorize Councilman Jim Rigsbee to sign on behalf ofthe Town of Stokesdale ini regarding to this purchase ofl land at 7901 Athens Road. Vote in Favor: Councilman Rigsbee, Councilman Foy, Councilman Landreth, Mayor Pro Councilman Jimmy Landreth seconded the motion. Tem Hooks and Mayor Flynt. Vote in opposition: None Motion carried. 4. Adjournment. Mayor Flynt made a Motion to adjourn the meeting. Councilman Landreth seconded the motion. Vote in Favor: Councilman Rigsbee, Councilman Foy, Councilman Landreth, Mayor Pro Tem Hooks and Mayor Flynt. 126 Vote in opposition: None Motion carried.
