MINUTES OF THE REGULAR MEETING OF THE HISTORIC PRESERVATION COMMISSION SANFORD, NORTH CAROLINA The Historic Preservation Commission met in regular session in the Buggy Conference Room, 115 Chatham Street, Sanford, NC, on Monday, January 22, 2024, at 6:001 PM. ROLLCALL Members Present: Jason Cline, Chair Aidan Harbison, Vice Chair Charles Petty Jim Erb Nate Dobbs Delorian Wicker Aaron Shephard Council Member Absent: Linda Rhodes Staff Present: Liz Whitmore, Historic Preservation Planner II Angela Baker, Clerk to the Board Kevin Hornik, Attorney APPROVALOF AGENDA Having noted the presence ofa a quorum, Chair Cline called the meeting to order, and entertained a motion to approve the agenda. Board member Harbison made the motion, seconded by Board member Petty, the motion carried unanimously. APPROVAL OF MINUTES Chair Cline asked for a Motion to approve the December 7,2023, minutes. Board member Petty made a motion, seconded by Board member Erb, the motion carried unanimously. PUBLICCOMMENT None NEW BUSINESS Chair Cline read the quasi-judicial reference statement. Chair Cline read the Conflicts of Interest statement. Conflicts of Interest: Chair Cline had a conflict of interest in the case, friend / family, and was recused. Vice Chair Harbison replace Chair Cline to conduct the meeting. Historic Preservation Minutes 1.22.24 2 Administer the Oath: Vice Chair Harbison called all participants speaking in favor of, or against the COA's, as well as staff, to come forward to be sworn in for testimony. Applicant Vann Vaughn and StaffLiz Whitmore appeared and took the oath. A. COA-23-71 - Application by Vann Vaughn, who wishes to build a chicken coop 10' X 20' (200 sq. ft. in the rear yard). Additionally, the applicant had built a chicken coop 10' X 20' (200 sq.ft) without the benefit a Certificate of Appropriateness. The applicant now wishes to remove the chickens and convert this to a shed. Staff Presentation: Staff Whitmore stated that the Historic Preservation Commission received ac Certificate of Appropriateness: COA-23-71 application from Vann Vaughan, owner 323N. Vance Street, who wishes to build a chicken coop 10'x20' (200 sq.ft.) in the rear yard. Additionally, the applicant had built a chicken coop 10' x 20' (200 sq.ft.) without the benefit ofa Certificate of Appropriateness. The applicant now wishes to remove the chickens and convert this into a shed. It was advertised in accordance with the General Statutes and the site was posted on Wednesday, January 10, 2024. The Staff Report was entered into the Record. Exhibit A, page 8 front façade and Exhibit B, page 9 is the side façade of the subject building, Guidelines: The following criteria should guide rehabilitation: 7. Accessory Structures. The private garage, evolving from the carriage house and horse barn outbuildings of the 19th century, was modified in the early 1900s to store an automobile. The earliest garages were simple frame structures with no finished floor, and often could only accommodate a single automobile. Guidelines a. Does not apply. b. Does not apply. Replacement materials should be congruous with historic materials in composition, Comment: The applicant is not replacing an accessory structure. However, the material used to construct the new chicken coop should be selected to compliment the historic district and other accessory structures within the Rosemount McIver Park Historic District. The existing chicken coop (Exhibits C&D) that is going to be converted into a shed was built without benefit ofa COA (Exhibit A, page 20) so there was no opportunity to evaluate the materials that were used to construct this building. size, shape, color, pattern and texture. Historic Preservation Minutes 1.22.24 3 d. Does not apply. Rosemount McIver Park Matrix The Rosemount McIver Park Matrix, page 81, is silent on the installation of storage buildings. However, number 40 on page 81 of the matrix states the following: any repair, replacement, installation or removal not specifically indicated on the matrix is Major Work. The applicant will also have to be in conformance with the Chicken Permit application which he will obtain from Current Planning staff and will need zoning clearance as well as a building permit for the original structure that was built without the benefit of approval from Historic Preservation approval, building permit and zoning clearançe for the proposed chicken coop. Staff Comments and Analysis: applicable to this case. Board Questions The commission may choose to agree or disagree with the staff's synopsis of the facts Board member Shephard asked if the windows and doors are going to be wood. Board member Dobbs asked which street would the shed be facing. Staff Whitmore said that it would be facing Vance Street. Staff Whitmore said that they will be all wood. Board member Erb asked for clarification regarding the 50ft. from a structure. Staff Whitmore said that it would 25ft from the property line and 25ft from an adjoining Attorney Hornik stated that the setbacks and those issues are not within the Boards prevue. The Boards scope of review is limited to whether the materials, the siding, the design, as structure. proposed are or not incongruous with the character of the district. Applicant's Testimony: Vann Vaughn, 323 N. Vance Street, Sanford. No questions for the applicant. Motions: Board member Dobbs made a motion that the Historic Preservation Commission find as fact that the proposed project COA-23-71, 323 N. Vançe Street, who wishes to build a chicken coop 10 x 20' (200 sq. ft) in the rear yard. Additionally, the applicant had built a chicken coop 10' X 20' (200 sq. ft.) without the benefit of a Certificate of Appropriateness. The applicant now wishes to remove the chickens and convert this into a shed and paint it blue to match the house, is not incongruous with the character of the district, for the reasons that there are other sheds and chicken coops in the Historic area; and materials used will mirror the Historic Preservation Minutes 1.22.24 4 house and will be approved at staff level, are for the following reasons generally in harmony with the criteria in the design guidelines and the special character of the neighboring properties and the historic district as a whole. Seconded by Board member Petty. The motion carried. Final Motion: Board member Dobbs made a motion based on the preceding findings of fact, moved that the Historic Preservation Commission grant a Certificate of Appropriateness to owner Vann Vaughan and approve the proposal shown in COA-23-71, 323 N. Vance Street. Motion seconded by Board member Petty. The motion carried. Old Business COA's will be sent by email. ADIOURNMENT With no further business to come before the Board, the meeting was adjourned on motion of Board member Petty, seconded by Board member Wicker, and unanimously carried.
