FINANCIAL MATTERS: FINANCIAL REPORT AS OF MARCH 31, 2023: Finance Officer Kelly Melton stated In the General Fund the Revenue Line item has used 54.68% (fifty-four point sixty-eight percent) ofthel FY: 2023/2024 budget and the Expenditures Linei item has used 47.31% (forty- In the Water/Sewer Fund thel Revenue. RESOLUTION AUTHORIZING ENGAGING MCAG FOR SETTLEMENT RECOVERY SERVICES: Finance Officer Kelly Melton stated that the Town of Sawmills intends to enter into an engagement with Managed Care Advisory Group (MCAG) for the purpose ofrecovering funds made available from a class action lawsuit filed against Visa and Mastercard. The lawsuit claims that merchants accepting Visa and Mastercard between January 1, 2004 thru January 25, 2019, paid more fees than they should have. The Town's merchant provider, First Citizens bank, has selected MCAG to assist eligible merchants with recovery services. There are no upfront fees and MCAG will charge an all-inclusive fee of twenty-five (25) percent ofa any recoveries received. The Town will receive seventy-five/(75) percent of any recoveries made. AJ Resolution is needed naming Finance Officer Kelly Melton to act as the Authorized Individual on behalfoft the Town of Sawmills. April 16, 2024 Page3of5 Rebecca Johnson made a motion, and Clay Wilson seconded, to approve the Resolution Approving Efforts to Recover Visa and Mastercard Fees making Finance Officer Kelly Melton the Authorized Individual on behalf of the Town of Sawmills. All were in favor. DISCUSSION: BAD DEBT WRITE OFF: Finance Officer Kelly Melton stated that the Town had a list of 2020 accounts that have gone unpaid for Utility and Sanitation services. The Town does not expect to collect payment for these accounts and recommends that Council approve the write offoft the accounts. The total amount of these accounts is nine thousand nine hundred forty dollars and seventy-six cents ($9,940.76). Finance Officer Kelly Melton also advised Council that included in the list are forty-six (46) accounts the Town has submitted to the NC Debt Setoff Program for Collection. Finance Officer Kelly Melton stated the Town had recovered nine thousand ninety-two dollars and fifty-eight cents( ($9,092.58) from previous years. There Clay Wilson made aj motion, and Rebecca. Johnson seconded, to approve staff to write offt the 2020 list of bad debts accounts in the amount nine thousand nine hundred forty dollars and are sufficient funds in the budget to cover this. seventy-six cents ($9,940.76). Enforcement Officer Curt Willis stated that there are sixteen (16) code enforcement cases that are open. No Council action was required. TOWN MANAGER UPDATES: Town Manager Chase Winebarger had the following updates: Town Manager Chase Winebarger stated that on May 3, 2024, from 9:00am to 11:00 am, the Caldwell County School District is having a Youth Town Hall Day at Living Hope Church. Town Manager Chase Winebarger stated that the event will host one hundred twenty-five (125) students and Mayors, Town Managers and Council members from around Caldwell County will be there. Town Manager Chase Winebarger stated that hei is going and would like to knowifanyone on Council would April 16, 2024 Page4of5 like to go with him. Town Manager Chase Winebarger stated that he will be speaking Town Manager Chase Winebarger stated that Finance Officer Kelly Melton has resolved the issues for the right-of-way contract reimbursement from the NCDOT. Town Manager Chase Winebarger: ralso stated that there has been ai new contract signed Town Manager Chase Winebarger stated that he has went to a meeting for the Green Leaf Grant with Caldwell County regarding the Evergreen project and he will let Town Manager Chase Winebarger stated that he has not heard from the architect regarding the Town. Hall or Phase 1 ofthe. Baird Drive property since the Friday before Town Manager Chase Winebarger stated that there are several properties in Town that are sanitation only accounts. Town Manager Chase Winebarger stated that public works has toj physically pick up garbage cans that are on the disconnect list and before public works employees are back at the office, the account holders have paid their sanitation bill and the public works employee has to take the garbage cans back out. Town Manager Chase Winebarger stated that the policy states that, tol have the garbage can taken back out, the customer has toj pay two (2) months sanitation bills or one (1) sanitation bill and a twenty dollars ($20.00) administrative fee. Town Manager Chase Winebarger stated that staff would like to change the policy to add an administrative fee of fifty dollars ($50.00) plus two (2) months sanitation bills, to cut down on the amount of work that Public Works has to do regarding sanitation disconnects. Town Manager Chase Winebarger stated that he would add the fee to the FY 2024/2025 fee Town Manager Chase Winebarger stated that he had spoken to a resident in Virigina Acres regarding adding four way stops to the main roadways in Virigina Acres. Town Manager Chase Winebarger stated that Highway Patrol would be the one to enforce any traffic violations regarding the four way stops. Attorney Terry Taylor stated that the Town should contact West Consultants, PLLC, the Town's engineers, to do a traffic study to see if stop signs will help and have a letter from West Consultants, Town Manager Chase Winebarger stated that the Town had a main line break on Highway 321A last week. Town Manager Chase Winebarger stated that the Highway 321A is the oldest main water line in the Town and would need to be replaced in the future. Town Manager Chase Winebarger stated that there also needs to be more valves placed on the main line to help keep more water running to customers. Town Manager Chase Winebarger stated that he would like tol have a five (5), seven (7) and ten (10) year water line replacement plan drawn up to be able to plan for water line but Council did not have to. with an increase inj payment for mowing and snow removal. Council know when a decision on the grant has been made. Easter. schedule for Council to vote on with the budget. Newton RESOLUTION 2024-2 RESOLUTION TO OPPOSE THE CITY OF CHARLOTTE INTERBASIN TRANSFER REQUEST WHEREAS, North Carolina Environmental Management officials are currently reviewing a request from the City of Charlotte to modify their certificate increase their current transfer of33 million gallons per day to 63 million gallons of water per day from the Catawba River Basin to WHEREAS, this latest request is a trend of additional interbasin transfer water usage from the the Rocky River Basin; and Catawba River as evidenced by the following: Charote/Miclenburgs previously approved certificate of 33 million gallons per day Concord and Kannapolis's previously approved certificate of 10 million gallons per day interbasin transfer to the Rocky Riveri in 2002; and interbasin transfer to the Rocky River in 2007; and WHEREAS, the net effect of the aforementioned actions will result in a total increased usage of 73 million gallons per day from the Catawba River Basin to the Rocky River Basin; and WHEREAS, the Catawba River and its tributaries are not an unlimited supply of water as evidenced by previous years of drought conditions experienced most notably by the Upper WHEREAS, the Town of Sawmills and the Western Piedmont Region is considered a growth area for the North Carolina with additional water needs in the future; and that there's a valid concern that interbasin transfers of this magnitude may effectively subsidize growth in receiving WHEREAS, issues of equity and sustainability are in question, as itinvolves one region bearing the environmental and infrastructural costs of supporting growth in another region, and it is essential to consider the long-term implications and fairness ofs such resource allocations; and WHEREAS, reducing the flow ofthe Catawba River by transferring water could lead to greater concentrations of pollutants in the river, ai reduced flow rate diminishing the river's natural ability to dilute and transport pollutants, and have detrimental effects on aquatic ecosystems, WHEREAS, the Town of Sawmills is concerned the proposed interbasin transfer will limit the amount of water available for withdraw to support growth in our area due to regulation limits Catawba Basin and the entire State ofNorth Carolina; and areas using the limited water resources oft the Catawba River Basin; and recreational activities, and public health within the Catawba River Basin; and under state and federal laws; and WHEREAS, the Town of Sawmills does hereby express its concern about the long-term availability of water within the Catawba River Basin and believes transferring water from the Catawba River Basin to the Rocky River Basin could indeed limit future growth opportunities WHEREAS, the Catawba Wateree Water Resource Management Group is actively working to update its water supply master plan for the entire river basin and Charlotte should wait until that WHEREAS, previous studies for the Catawba River called for the elimination of interbasin transfers as a strategy to protect the river and water supplies during drought conditions and an IBT should be a temporary measure to accommodate growth and not aj permanent solution; and WHEREAS, the 2015 Water Supply Master Plan for the Catawba River projected Charlotte's current IBT would be sufficient through 2065 and that Charlotte should not increase its IBT for WHEREAS, Charlotte should instead use that time to implement water infrastructure and WHEREAS, water availability is crucial for sustaining economic development, agriculture, and quality of life in growing communities and if water is diverted elsewhere, it may constrain the ability of communities within the Catawba River Basin to support their own development and WHEREAS, our region should not be forced to give up its potential growth opportunities to NOW, THEREFORE, BE IT RESOLVED that the Town of Sawmills requests that the North Carolina Environmental Management Commission deny the City of Charlotte interbasin transfer request to modify their certificate to transfer 63 million gallons of water per day from the for local communities in the Catawba River Basin; and process is complete; and its growth needs over the next 30 years; and policies to eliminate its current IBT certificate issued in 2002; and population growth; and subsidize Charlotte growth with our water resources; and Catawba River Basin to the Rocky River Basin.
