ORDER OF BUSINESS The Pittsboro Board of Commissioners met in Regular Session on Monday, April 8, 2024, at 6:00 p.m. in ther meeting room att the Chatham County Agriculture and Conference Center with Mayor Kyle Shipp presiding. The meeting was called to order at 6:00 p.m. Mayor Shipp requested a moment of silence with the recitation of the Pledge of Allegiance led by Elected Town Officials Present: Mayor Kyle Shipp, Mayor Pro Tem Pamela Baldwin, Commissioners John Bonitz, Jay Town Staff Present: Town Manager Jonathan Franklin, Assistant Town Manager/Director of Engineering Kent Jackson, Town Attorney Paul S. Department Of Month Update Police Chief Shorty Johnson presented the Board with an update to the Board regarding the Police Department. Assistant Town Manager/Director of Engineering Kent. Rezoning Request: PB-23-527- N M1-CZ Shramek Conditional Rezoning Mayor Pro Tem Baldwin made a motion to enter public hearing, seconded. by Commissioner Foley. Aye-5 Nay- 0 Planning Director Randy Cahoon-Tingle presented the item to the Board. Nikkolas Shramek supplied the Board with additional information of the request. Steve Marcum, 2340 US Business West, Pittsboro opposed the conditional rezoning request. Davys Lenz-Weisbecker, 99 Reeves Road, Pittsboro opposed the conditional rezoning request. Ken Henderson, 2294 US 64 Business West, Pittsboro opposed the conditional rezoning request. Written comments were submitted to the Board and included at end of minutes. Public hearing comments were heard from the following: Commissioner Foley made a motion to close public hearing, seconded by Commissioner Bonitz. Aye-5 Nay-0 Commissioner Farrell made a motion to deny the conditional rezoning request which does not match the Land Use Plan, seconded by Mayor Pro Tem Baldwin. Aye-2 (Farrell, Baldwin) Nay-3 (Foley, Vose, Bonitz) Commissioner Bonitz made a motion to table this item for staff to work out additional conditions for approval before the May 13th meeting and additional items will include the site must have annexation before construction stage, construction plans must comply with dark sky protection ordinances before the final site plan approval, change opaque screen to a fence in the buffer that's an eighty (80) foot buffer on the side and sixty (60) foot buffer on the front, and add fence for security, add the condition of rooftop solar, there will be no structures located in natural resource area, and up to date technology on security cameras or technology to take advantage of low light conditions, and hours of operation 7:00 a.m. to 6:00 p.m., seconded. by Commissioner Vose. Ihave read and understand the legislative request by Mr Shramek for rezoning allowing My wife and I own and reside at 2539 us 64 Business West. We also own the pasture land that surrounds us known as 2537 us 64 Business West. Our property borders the lots that are up: for rezoning. The eastern border our property shares 1,447 ft ofboundry with the proposed rezoned parcels. Please consider the following points while making your decision 1.7 This conditional rezoning will make possible al business that is accessible 24hr a day 365 days per year with no onsite employees or security force. Ifthis use is allowed we will be extremley worried about seçurity and privacy. The impact ofai rezoning to allow this business will affect the quiet enjoyment of our home and property and will put our neighbors 2. Ini the Terms and Conditions Exhibit B, I see not one serious mention of security. In fact in the 23 stipulations the of Exhibit B the word security only appears twice, ini the same sentence, and only as it'pertains to lighting. A quick search of storage site crime emphasises the fact that security should be the main issue that the board considers. A quick glance tells me that security concerns are one of the reasons why the storage units I drive past are out in the open with no trees for screening. Ihave to believe that storage business owners are aware that screening could increase the risk oftheft or illegal activities. Please think about the last couple ofstorage units you have seen and whether or not they look like the one proposed by Mr Shramek. In trying to protect the aesthetics ofthe town Mr Shramek and the board will be creating a risk to all oft the immediate neighbors and the community at large. You cannot have as screened, unmanned, 24hr accessible business without inviting trouble. We citizens depend upon the board toj protect our homes safety and properties value as well as provide for the needs of the community. Limiting the overnight hours to Mr Shramek's business may help aleviate some of our concerns. Ift the campus was locked down after midnight and until 7 am it would certainly help with our peace of mind and go a long way b. Item 7 calls for lighting ifp provided must comply with section 6.6 ofthe UDO. This allows for lighting at al height of3 37 ft above finish grade. Even with "full cut off light fixtures" this will undoubtedly create "light tresspass" on ours and our neighbors property. Combine this with the need for 24 hr lighting and its a very real impact on everyones lives. Can the board specify ai reduced height for these security lights? Wouldn't the typical street c. Item 10 calls for a type E landscape buffer (as per section 5.3.3 oft the UDO) on the Option 1 does not include a fence, option 2 includes a fence or wall of at least 6ft. Iask that you specify option 1 but include a fence or wall and change the spec of mature evergreen tree height to 16ft. Due to the fact that my house sits on an elevation 101 to 20 ft higher than the proposed storage site the 16ft height is necessary to achieve the intended However well these solutions may work, approval oft this rezone would greatly impact the quiet enjoyment of our property. These measures may help with some ofr my concerns but they do not eleminate them. The approval of this request would have an immediate and negative impact on our neighborhood peace ofn mind, and property value The Terms and Conditions page state the opinion that the "proposed use will support future development in the immediate vicinity" and I guess that is to be seen. However, is changing the zoning to. Manufacturing District - Light Industrial the correct use Doesn't al business like this belong on aj parcel more suited to industrial use?
