Zoning Enforcement Officer Jeannie Drake introduced the request by reviewing the staff report. Ms. Drake stated that there has been one inquiry regarding this request. After the presentation, City. Attorney Derek Taylor asked Ms. Drake: ift the two conditions had been agreed to by the developer. Ms. Drake responded that they had agreed. Mr. Taylor asked if the conditions would be in writing prior to receiving final approval. Ms. Drake stated conditions would bei in writing. Applicant Samer Hamad stated] he did not have further to discuss regarding the request. Ms. Lumpkin then asked the Planning Board members anything if they had any questions for the applicant. Glenn Curtis stated that he did not see marina included in the provided agenda packet and would like to know more. any detail oft Hamad then replied that the marina would include twenty boat slips. Planning and Inspections Director Sandi Watkins approached the podium to further clarify the information requested. Ms. Watkins stated that the purpose of the final allow the lotst tol be conveyed. The marina and individual structure configurations were plat reviewed at the Site Development Master Plan phase. Ms. Watkins said it is not unusual to not have that level of detail included on a: final plat. Ms. Watkins displayed the conditions approved the City Council and agreed upon by the developer as part of the Site Development Master by Plan approval phase. She explained that the conditions are part of the ordinance and that are allowed as part of the development. The conditions allow for an outdoor specify. private to be used for private use only by the lot owners and stipulate that all docks be deeded marina, to participating lot owners of the Residences at Bask planned development. The conditions forward to this part oft thej project even though the Planning Board is not rereviewing some oft carry the site detail that was reviewed at the Site Development Master Plan phase. The purpose of this phase ist to ensure that either the infrastructure has been installed, which it has not, or that there is as surety inj place to ensure completion of the improvements. Thei improvements that are included are listed and include completion of the utilities and the streets. A letter of credit has been reviewed and approved by the Public Services Department. Ms. Watkins explained that the letter Ms. Drake then reviewed permits that have been obtained thus far for the included bulkhead permits issued September 12, 2023 andi retaining wall fence permits project, issued which on March 28, 2023. The applicant, Samer Ms. Lumpkin mentioned that the City had received a grant to address stormwater runoff. Ms. Watkins explained that the Cityi is working through the details of the grant with the granting agency, but in short, construction costs have increased significantly and now exceed the original grant award amount. She stated that the referenced stormwater work is a City project, and while in close proximity tot the Residences at] Bask] project site, the projects are not directly related. Regarding stormwater permitting, Ms. Watkins explained that stormwater permits are not issued by Morehead City. Morehead City requires that the applicant provide evidence that approvals have been obtained through the permitting agencies and the applicant has provided proper the duep prior to final plati recordation. The tides can cause flooding in the street without stormwater runoff being present. Mr. Oden confirmed the bulkhead had been installed. Chairperson Sally Lumpkin then asked the applicant, Samer Hamad, to approach the podium. Mr. Hamad explained that the property was filled with concrete previously. By removing the concrete and creating more: impervious space, it willl bel helping the drainage ini the area versus: making it worse. Chairperson Lumpkin asked if there was any public comment. Hearing none, Ms. Matt. Johnson stated that the conditions listed seem to have been met through a letter of credit for those items. He asked ifit would be redundant to include the water access fee in the surety contingencies. Ms. Watkins stated that the $25,000 water access fee should not be Ini response to a question about aj proposed condition to require the developer to request City acceptance of the streets, Ms. Watkins explained that having the City explicitly accept the streets for dedication is to place the streets into the City's street system for maintenance purposes. The conditions are included for the developer's awareness and to ensure that the streets become part of the city street system once construction has been completed and approved for acceptance by City Council. Ms. Tootle asked if the streets would be maintained by the City. Mrs. Watkins confirmed that the streets are proposed to be maintained by the City as public streets. She continued stating that the ordinance had recently been amended to allow limited The applicant, Samer Hamad, had a question regarding the conditions, in that the language indicated that the final plat approval is contingent upon a resolution accepting the streets into the Town street system following construction of the streets. He said the final plat approval needs to be completed prior to the construction of the streets. City Attorney Derek Taylor said that once the streets are built, a resolution must be submitted as acceptance of a public street by the' Town. The contingency for Final Plat approval is that the applicant agrees to submit a request for resolution once the streets are completed. Mrs. Watkins stated that the resolution would be completed following construction of the streets and brought before City Council. She explained that the Public Services Department will verify that the street meets City construction standards. Ms. Lumpkin asked at what point would the applicant receive final plat approval. Ms. Watkins stated the plat would be eligible for recordation when the applicant submits a mylar and the water access fee. Mr. Taylor proposed a change in the wording oft the contingencies. Ms. Watkins edited the wording to state, "Owners agree that a resolution accepting the streetsi into the town street system is required. Following construction oft the streets, please submit the draft resolution for review att thati time."
