He noted that Mr. Milton Rice, a City employee for over 20 years, had recently lost his life in a tragic accident, and that Mr. J.A. Dalpiaz and Ms. Samantha Thomas and her unborn child had also recently lost their lives in an automobile accident. He said Gaston County is in dire need ofj jobs. The official records say that unemployment is at 5.9%. The true unemployment/ underemployment rate in Gaston County is closer to 20%.. He noted that less than 4 years ago Johnston County received a $1,300,000 grant, which was spent on infrastructure, and had recently announced ai new plant that willl have over 700 employees. He said the textile industry was great for Gaston County for many years, but they lost those in the 1980s and very little has been done to fill that void in employment. He advised of other communities that were also once dependent on textiles, but are now booming. He said his theory is that they are booming because Hes said very little has been done to revitalize the western, northern, and southern end of Gaston County. He contends that the 700-acre plus property that the City owns on Dallas-Cherryville Highway needs to change from a resource recover farm to an industrial park. That should be a joint venture between the City and the County. He distributed and reviewed a map highlighting roughly 3 miles of new road to potentially service ani industrial park in this location. A copy of that map is included in the exhibit book. He said that would open up the entire north and west end of Gastonia and Gaston County and would reduce the. traffic between 17% to 21% at I-85 After some discussion, Council referred this matter to1 the Transportation Committee. Both sewer lines were extended by petition. The assessments on the agenda are used toj pay a portion of the cost associated with constructing the sewer lines. The public hearing is the final step in this process. RESOLUTION AUTHORIZING CONDEMNATION PROCEEDINGS - SOUTHI NEW HOPE Mayor Bridgeman recognized Mr. Rusty Bost, Director of Engineering/City Engineer, for the Mr. Bost said during right-of-way negotiations for the South New Hope Road widening project, they came to a resolution with the Stratford Oaks Homeowners Association (HOA). Those are. condominium units. They had agreed to: a price and toi improvements that were tol be made to the driveway. When preparing the documents to actually close on the right-of-way, they discovered that the HOA's bylaws require 100% signatures of everyone that owns a condominium. Thati is the list before Council tonight. Some of these organizations are very difficult to deal with. One isal life estate, there are several LLCs, and several hold mortgages so they are dealing not only with the property owners but also with the banks. They asked the HOA if they would go back andt talk to their owners to see if they could make any progress. They came back and said there was no reasonable chance of that happening. Unfortunately, that leaves them with eminent domain as the option of last resort. Staff recommends that Council approve the Resolution Mr. Bost and Mr. L. Bridgeman reçognized Councilman Kirlin, Chairman of the Recreation Advisory Councilman Kirlin said the Recreation Advisory Commission (RAC). met on August 11, 2015, and discussed the following items. No actions were taken on any of these items. They were 1) Citizen Comments 1 He noted that Mr. Russell Adams recently attended a City Council meeting and spoke under Public Expression regarding various recreation concerns. He advised that Mr. Adams and Mr. Larry Mclntyre came to the RAC meeting and requested information oni thej progress oft the tennis court project for Ferguson Park, Phillips Center, and Ashbrook, and asked if sidewalks were going to be installed at Ferguson Park and Phillips Center. They also asked about the status of a volleywall at Phillips Center and asked ifa second pickleball court could be added at the Adult Recreation Center. He said there was a complete and thorough discussion of all of that. Basically at this point, there are pickleball courts at Phillips Center. They are not completely accessible yet because of the need to access that through a walkway. Once completed that will be available for use. There will also be a volleywall constructed at Phillips Center with leftover project funds. There are currently three indoor pickleball courts at Phillips Center with setup and play scheduled for all day on Wednesdays, and two indoor courts at Bradley Center with setup and play scheduled for all day on Mondays. A third court willl be lined off at Bradley Center. and Council approveditu unanimously. RECREATION ADVISORY COMMISSION REPORT Commission, for the purpose ofr making the presentation.. presented for information only. -34- Page 35 Page 35 REGULAR COUNCIL! MEETING SEPTEMBER1.2015 Councilman Kirlin and Mr. Chuck Dellinger, Director of Parks and Cultural Services, 2) Project Updates - Councilman Kirlin said the downtown ballpark was discussed. There are ongoing meetings regarding the possibility oft this project moving forward. He asked for an update on the meeting that was held on August 25, 2015. Mr. Edward C. Munn, City Manager, said at that meeting they received some good information from a representative of Odell and Associates, which has worked on a number of ballparks. They shared the approach that is currently being taken in High Point. It is very similar to what we are talking about doing here. The representative had some éxamples oft the kind of financing that they use. He highlighted some oft those financing options. He said one oft the things that was discussed was the acquisition of property, how that needed to be done, and then how the financing could be done over aj period of time. That is where most of the conversation was involved. He thinks they had a general agreement that it is not entirely about the ballpark. It is about the blocks around the ballpark and how the ballpark itselfi is to really be the energy that redevelops the area along both sides of Franklin Boulevard. They talked again about the fact that the YMCA property will probably be available later than some of the other properties simply because the YMCA has to first build its new facility. There was also discussion that the current YMCA property lends itself to private development because of York Chester and a real strong residential and commercial component on that block that may be able to bring in upscale residential int the heart oft the City. He thinks they willl be meeting again next month. Councilman Kirlin said the RAC received an update on the Skeet & Trap Range. It was He said another project discussed was the new Lineberger Park/Greenway parking area. It was reported that the construction bids are coming in a little over the $300,000 gift that was provided, sot they are doing some value engineering to try tol bring that in] line. 3) Springfield Tripl Report - Councilman Kirlin said it was reported that the Springfield trip was ag great. success and was enjoyed by everyone that went. There was al little more money raised thans was expended, so the: remainder will go toward the reciprocal trip coming next year. Discussion ensued on plans to bring the Springfield American Legion team to Gastonia next year. Councilman Pierceall said ifi it pleases Council, he would like to give Mr. Dellinger direction to go ahead and form a committee to start that planning process, and also request that Mayor Pro Tem Craig be placed on that committee. Council expressed no opposition to 4) Potential Programming Collaboration - Councilman Kirlin noted that staff advised the RAC that they are working with the YMCA and other agencies to collaborate in the planning of potential programs to ensure that the underserved population currently being served by the YMCA will not be lost when that facility relocates. The Erwin and T Jeffers Community Centers arel being looked at as potential sites tol handle some oft those programs. Webb Theater building was held today. The owner will have six months to complete the renovation.. He hopes to be in there in time for Christmas.. CITY MANAGER'S) REPORT Mr.. Edward C. Munn, City Manager, advised that the groundbreaking for the new Lineberger Park/Greenway parking lot would soon' be scheduled. They are. trying to coordinate that with the Matthews family. -35- Page 36 Page 36 REGULAR COUNCILI MEETING - SEPTEMBER 1,2015 Mr. Munn said this year the State Housing Finance Agency funded only one project in Gaston County, whichi is an elderly project on Union Road. Artspace will have to apply for that funding He and Councilman Pierceall attended the first meeting of the Image Committee. They are developing a Request for Proposal (RFP) that will be sent to public relations and marketing firms. The Committee will evaluate the RFPs on October 15, and will bring in the finalists on October 28.. They are trying to make some selections so that all of that can get processed by late He said anotheri issue previously brought up by Council was the amount of debris and trash along streets and on private properties. Staff has met with regard to this issue. The private property issues are al little more complicated. State law restricts them from breaking the City into districts and really attacking problem areas like they used to do, and the timeframes are regulated and structured.. This is all General Fund dollars and iti is going to come to hundreds of thousands of dollars. They willl bring that information to Council shortly, but it may end up being something that is significant enough for us to possibly address with the next budget. Something that they think can be done right now is to move forward in terms of the debris, sofas, mattresses, etc., along the streets and in areas where the City can pick it) up. The City used to have three trucks, three crews that picked up whatever was put on1 the street. When the system changed, they really constricted the flow. To some degree it has worked, buti in many neighborhoods there is al Iot of dumping. He noted the difficulties int trying to catch individuals who are dumping. He said they frankly do not have enough trucks and people tol keep up withi it. They went from three crews to one. They are proposing to activate another crew, which will cost about $80,000. They already have an extra truck. There are funds available in terms of a fund balance in the Solid Waste Fund. Iti is about $430,000. They are proposing to draw that down and activate that crew. Staff will monitor that and collect data, and discuss it again during the budget season.. Ifsomeone puts something out on the street, they want to see that it does not sit there any longer than a week. Sometimes it is three or four weeks and that not good for the neighborhood or for the City Mr. Munn, Mr. L. CITY COUNCIL REPORTS Mayor Pro Tem Craig - She said she wanted to remind everyone that there will be a Coffee with a Cop event at Firestone Grill on Friday, September 4, from 8:30 a.m. to 9:30 a.m. She thinks this is a great program where people can meet the officers and have a conversation with them.. She would encourage everyone to tryt toj participate in that. Shel hopes everyone has as safe Labor Day. Councilman Pierceall - He said Mr. Munn has already touched on the Image Campaign Committee meeting. There will be more to report once the Request for Proposals are received. The Coffee with a Cop is a great program and al local eatery, Firestone Grill, is hosting that. They want to come before Council and thank the City for Laurel Lane has been paved from Garrison Boulevard to Robinwood Road. They did an excellent job. Hei thanked those involved with that project. He noted that someone dumped al lot oft trash on] Laurel Lanej just off Garrison Boulevard that needs to bej picked up. He saidt this past Sunday, he was invited to speak at First Baptist Church in Lowell. interviewing eight candidates for that position over the next two days. and: some cardboard boxes att the access road to the sewer outfall. Itis aj peaceful, prayerful, silent witness to the sanctity of! human life in the womb. For one hour on October 4, participants will line the sidewalks of Garrison Boulevard between New Hope Road and Union Road in Gastonia and Main Street at Central Avenue in Belmont, and willl hold signs and pray for our country and the unborn. Signs will be provided. The aim is to form a living, praying monument to life. At least 70 Life Chains will be held in cities and town across North Carolina and thousands will take place across the United States and Canada. Both in the City of Gastonia and Gaston County, all properties are zoned residential.. There is public water and sewer available to the site. The Future Land Use Map in the 2025 Comprehensive Plan for the City of Gastonia does indicate residential for the subject property, as well as the surrounding properties. The applicant's request to zone the site to RS-12 is consistent with the Cramer Woods Subdivision directly north of the site. Their request is to basically combine this roughly 22 acres with the 37 acres immediately to the west sO that they have a comprehensive community that they will be developing which, from a service standpoint, will all be within the City of Gastonia and will all be the same zoning and the same development regulations. They are not quite certain why this 22 acres was originally excluded from an annexation that took place on or about the year 2000. This is really filling Mr. Lamar Anthony.4757 McDade Lane. Gastonia - He said he is representing the parents ofNew Hope Elementary School. He is requesting that Council vote no1 to the zoning change and the annexation request by LiveWell Developers. The plan is to build 100 plus houses off Stowe Road, which is a rural road with two-way traffic. When parents are dropping off and picking up their children, Stowe Road becomes extremely congested and at times blocked. If an emergency were to occur at the school, emergency services would basically have to wait until the traffic cleared Stowe Road to gain access to the school.. He expressed concern that the additional housing would make that situation even worse. He also expressed concern regarding the amount ofl housing being constructed off] New Hope Road. He was advised that these. newly developed houses will fall under the jurisdiction of New Hope Elementary School and Cramerton Middle School. He cited statics regarding the ratio of students to teachers, which he said indicate that New Hope Elementary School is already at or over capacity. He said the addition of these new 100, plus houses off of Stowe Road will further Mr. Lamar said another reason that they ask Council to vote no to the proposed changes is the economic impact that it will have on the surrounding community with added pollution and dangerous congestion. New Hope Road is turning into a Franklin Boulevard or a Wilkinson Boulevard. The only difference is New Hope Road is a rural, green community area where families reside and where children cross the street to go to school, to play sports, andt to visit their friends. They cannot afford to open Stowe Road up to additional traffic and hope and pray that the children make it across the street safely. He understands the need for growth, but they need growth with responsibility. They do not need housing developments stacked on top of each other. They do not need overwhelming congestion and traffic further endangering the lives of their children. The citizens of New Hope request a traffic study of Stowe Road and a further study of the economic impact that these several thousand houses Councilman Pierceall advised that the request before Council was to annex the property and to assign City zoning. They used to require that 150% of the improvements in a subdivision be posted by either a letter of credit, al bond, or cash, and the City could choose the form of credit. Gaston Community Action has been operating the Head Start program for 50 years. Head Start is a preschool program that provides educational, health, dental, and disability serviçes to 460 children in Gaston and Lincoln counties each year. Because of this they are planning to have a celebration on November 5,2015. They are asking the City of Gastonia to co-sponsor this event by covering the Gastonia Conference Center rental charge of $700. The total cost of the event willl be approximately $2,800. Inc. Engineer, and Ms. Susan Kluttz, Revenue Administrator, for the Mr.. Carpenter said for some time, it has been their focus for the City to increase its online presence. A çouple of years ago, they started looking at the website and have worked hard to rewrite that and make it more pleasant and functional, and to prepare it for some of the online initiatives that will be presenting tonight. They also considered opportunities in the other departments for citizen convenience and increased customer service through online presence. Some opportunities were identified right away with Engineering, Finance, Public Works, Enterprise Services, and Recreation. Tonight they would liket to: show the results ofa partnership with Information Technology, Engineering, and Finance. Ms. Kluttz will be talking about the new Customer Self Service (CSS) portal, which went live the beginning of August. There are about 555 people enrolled in the portal now and about 110 people have signed up for paperless billing. Mr. Bost willl be talking about a product called IBuild (al building permit and inspections application) and a product called Active City Projects. The Active City Projects application went live last week and the IBuild application went live in July. They are very proud of these Ms. Kluttz and Mr. Bost then presented a PowerPoint presentation outlining the information that can be obtained through the Customer Self Service, IBuild, and Active City Projects applications. He advised of the 1) Request for 2016 Downtown Concert Series - He said the Gastonia East Rotary Club came forward wanting to extend the agreement that they had with the City this past year. for the Downtown Concert Series. There was al lot of discussion on the success of that and on some possible tweaks and changes. He advised that the Gastonia East Rotary Club would like to continue with eight concerts on alternating Fridays, as in the 2015 season. Based on their contract with the City of Gastonia for the 2015 season, the Rotary Club is requesting $5,000 each for eight concerts with the same services that the City provided for the 2015 season. Woodhouse and Co., 156 South Street (Standard Building), are partners in GTown Standard Partners. They requested a façade grant and an up-fit grant for the building at 201 West Main. Avenue, which they recently purchased from Mr. Greg McAllister. They would like to improve the aesthetics of that building and they are planning to add some residential units. The request that they made was substantial.. It would have come close to emptying the IDEAL grant fund. Although the Committee loved the project and the idea that that building would look better and that there would be more residential units downtown, they felt that expending that fund sO early in the fiscal year would probably not. be prudent. The Committee voted 2-0 to recommend. approval of an IDEAL grant to GTown Standard Councilman Pierceall made a motion to accept the recommendation of the Central City Revitalization and Housing Committee. The Zombie Walk is in its fourth year and will be collecting food for B.R.E.A.D, Inc. That event has been very successful and this year they have added al Downtown. Antique Festival. This was presented for information. 4) Discussion of] In-Kind Services Requests Councilman Pierceall said members of Council have commented on in-kind services during Council meetings. The Committee asked staff look at this. Included in the agenda is a chart showing in-kind services cost estimates over the course ofs several years. KEY Division] Manager of Fleet Services EXHIBIT 3-1 INTERLOCAL AGREEMENT FOR THE PROCUREMENT OF BUSES AND BUS EQUIPMENT AND PARTS THE CITY OF ROCKY MOUNT THE CITY OF GASTONIA BETWEEN and This INTERLOCAL AGREEMENT is entered into this day of 2015, by and between the CITY OF ROCKY MOUNT, a North Carolina entity with the status of Municipal Corporation (the "Procuring Agent") and the CITY OF GASTONIA a North Section 1. Purpose of Agreement. The purpose of this Agreement ("Agreement") is to allow the parties to obtain buses and bus equipment and parts more quickly and less Section 2. Delegation of Authority. The Principal hereby delegates to the Procuring Agent the authority to conduct a procurement for the manufacture and delivery of low floor transit buses, alternate equipment, optional equipment, and identified spare parts (said buses, equipment, and spare parts are referred to hereafter as the "Goods") and to enter into procurement contract(s) for the purchase of the Goods on behalf of the Principal. This Agreement does not obligate the Principal to purchase any of the Section 3. Effective Date of Agreement This Agreement shall become effective Section 4. Procurement Procedures. The bids shall be reviewed by the persons designated by the Procuring Agent and the Principal, and they will present a recommendation to the Authority Board of the Procuring Agent for the award of the procurement contract(s). The Authority Board of the Procuring Agent may consider, but is not bound by the recommendation. Once the procurement contract(s) have been executed by the Procuring Agent and the vendor(s), a copy of procurement contract(s) shall be forwarded to the Principal. Upon receipt of the procurement contract(s) the Principal may issue its individual Purchase Order(s) to the vendor(s) that has/have executed the procurement contract(s). The Principal shall thereby be able to buy the Goods from the vendor(s) and not from the Procuring Agency. In no event will the Procuring Agent assume any responsibility for any contract (Purchase Order) resulting from this agreement between any Principal and any! bus or bus equipment provider(s). Section 6. Record Retention. The Procuring Agent and the Principal agree to retain all documentation relating to the procurement for a period of not less than five years after the date of the last vehicle delivery pursuant to the procurement, except in the event of litigation or settlement of claims arising from the performance of the procurement contract(s), in which case the Procuring Agent and Principal agree to maintain. same until all such litigation, appeals, claims or exceptions related thereto have been resolved. Section 7. Miscellaneous. (a). Duration. This Agreement shall be perpetual, from the award of the procurement contract, unless terminated earlier by mutual agreement. The governing body of each party hereto has determined that this duration is reasonable. On such termination, obligations ofe either side that are still executory are discharged, but any rights based on (b) Appointment of Personnel. The City of Gastonia shall designate persons to carry out the Principal's obligations under this Agreement. (c) Amendment and Termination. The Procuring Agent's sole responsibilities under this Agreement are to conduct a procurement as described in this Agreement and to enter into the procurement contract(s) for the benefit of the Principal, also as described in this Agreement. In performing under this Agreement, the Procuring Agent is acting as the agent on behalf of the Principal, provided that the Procuring Agent may also purchase Goods for itself from the same procurement contract(s). The Procuring Agent does not warrant, or give any opinion, that this procedure, by which the Procuring Agent solicits bids and enters into procurement contract(s) on behalf of the Principal, will be successful or effective. The Principal shall not hold the Procuring Agent liable for any deficiencies in, or failure of, this procedure. The Procuring Agency shall not be liable for any breach of the procurement contract(s) by the vendor(s) or by the Principal, and the Purchase Order(s) issued by the Principal shall SO state. The Principal shall indemnify the Procuring Agent for, and hold the Procuring Agent harmless from, any claim by any person, firm, or corporation regarding this procedure or regarding the sale or purchase of the Goods. The Procuring Agent shall not be considered the buyer or seller of any of the Goods, and the PROCURING AGENT SHALL NOT BE LIABLE TO THE PRINCIPAL ON ANY EXPRESS OR IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO MERCHANTABILITY OR FITNESS FOR: A PARTICULAR Section 8. Governing Law and Forum. This Agreement shall be construed and interpreted in accordance with the laws of North Carolina. The exclusive forum and venue for all actions arising out of this Agreement that are between the parties to this Agreement shall bet the North Carolina General Court of. Justice, in Gaston County.
